RE: PR 23093: Authorizing the City Manager to enter into a contract with Fittz& Shipman,
Inc.,of Beaumont,Texas,for construction management services associated with the Sabine
Pass Boat Ramp Improvement and Area Rebuild.Project No.PR0007-CON.
Introduction:
The intent of this agenda item is to seek the City Council's approval for the City Manager enter into a contract
with Fittz& Shipman, Inc.,of Beaumont, Texas, for construction management services associated with the
Sabine Pass Boat Ramp Improvement and Area Rebuild for the amount of$69,600.00.
Background:
Pursuant to Resolution No.21-136,City Council approved entering into an agreement with Fittz&Shipman,
Inc., of Beaumont, Texas, for planning and design services associated with the Sabine Pass Boat Ramp
Improvement and Area Rebuild for the amount$167,600.00.
Fittz & Shipman, Inc., of Beaumont, Texas, has established itself as a pre-qualified firm and has provided
the initial professional engineering design services for the Sabine Pass Boat Ramp Rebuild and staff
recommends they provide the construction management services for this phase of the project.
PR 23093 is being submitted by Fittz & Shipman, Inc., of Beaumont, Texas, for professional services
associated with the construction phase of the Sabine Pass Boat Ramp Project for the amount of$69,600.00.
Budget Impact:
Funds are available in the Other Capital Outlay Account No. 152-60-415-8525-00-00-000. Project No.
PR0007-CON.
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR 23093 with Fittz& Shipman, Inc.,
of Beaumont, Texas, for construction management services associated with the Sabine Pass Boat Ramp
Improvement and Area Rebuild for the amount of$69,600.00.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH FITTZ & SHIPMAN, INC., OF BEAUMONT, TEXAS, FOR THE
SABINE PASS BOAT RAMP IMPROVEMENT PROJECT IN SABINE PASS, TEXAS,
FOR THE AMOUNT OF $69,600.00. FUNDING IS PROVIDED THROUGH A GRANT
FROM THE TEXAS PARKS AND WILDLIFE DEPARTMENT (TPWD) AND IS
AVAILABLE IN ACCOUNT 152-60-415-8525-00-00-000; PROJECT NO PR0007.
WHEREAS, the city of Sabine Pass has been severely impacted over the years by
hurricanes and catastrophic rain events; and,
WHEREAS, the Department of Commerce National Oceanic and Atmospheric Administration
(NOAA) and the Texas Parks and Wildlife Department (TPWD) established Hurricane Harvey Disaster
Recovery Grants for the purpose of improving water access capabilities; and,
WHEREAS, pursuant to Resolution 20-425 the City Council authorized the City Manager to
participate in and accept funding from the Harvey Fisheries Disaster Relief Grant Fund through the
TPWD in the amount of $1,000,000.00 for the purpose of reconstructing the Sabine Pass Boat Ramp;
and,
WHEREAS, pursuant to Resolution 21-136, the Port Arthur City Council authorized the City
Manager to enter into an agreement with Fitz & Shipman, Inc., of Beaumont, Texas for the Sabine
Pass Boat Ramp Improvement Project for professional engineering services associated with planning
and design for the amount of $167,600.00; and,
WHEREAS, Fittz & Shipman, Inc., of Beaumont, Texas, has established itself as a pre-qualified
firm and has provided the initial professional engineering design services for the Sabine Pass Boat
Ramp Rebuild and staff recommends that they do the construction management phase of the project;
and,

WHEREAS, Fittz & Shipman, Inc., of Beaumont, Texas, has submitted a supplementary
agreement for the Construction Phase of the Sabine Pass Boat Ramp Improvement Project for the
amount of $69,600.00, See Exhibit A; and,
WHEREAS, funding is available in the Other Capital Outlay Account No. 152-60-415-
8525-00-00-000, Project No. P0007-CON; and,
WHEREAS, approval of PR 23093 is herein deemed an appropriate action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is herein authorized to enter into a contract with Fittz & Shipman, Inc.,
of Beaumont, Texas for the Construction Phase of the Sabine Pass Boat Ramp Improvement Project
for the amount of $69,600.00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.

RE: Sabine Pass Boat Ramp Improvement Project
Construction Phase Services Proposal
Dear Mr. Cannatella:
Fittz &Shipman, Inc. is pleased to provide this Proposal for Construction Phase Services for
the Sabine Pass Boat Ramp Improvement Project in Sabine Pass Texas.
SCOPE OF SERVICES
Construction Administration Scope of Work:
• Provide Project Management services to direct supervise and coordinate the various
items of work within this Phase, including review of activities of subcontracted engineers.
• Assist in the preparation of formal Contract Documents.
o Periodic services of a Resident Project Representative as intervals appropriate to the
various stages of construction to observe and to evaluate the progress and quality of
work, and to determine in general if the construction is proceeding in accordance
with the Contract Documents. ENGINEER will work closely with the Resident Project
Representative (when required by CITY) to insure that complete, accurate
construction records, reports and information are being provided and that the
quantities and quality of work done by the Contractor are consistent with the Contract
Documents.
o Provide services of a Resident Project Representative and other field personnel as
required by the CITY for on-the-site determination of the quantities and quality of the
work done by the Contractor, and to provide construction records, reports and
information to the ENGINEER or Project Engineer.
• Arrange for construction testing as required by the Project, for the CITY'S account.
• Consult with and advise with the CITY, issue all instructions to the Contractor requested
by the CITY, and prepare and issue routine change orders with CITY'S approval. On

matters requiring the CITY's involvement the ENGINEER shall provide the CITY'S
designated representative with all facts germane to such matters along with a complete
recommendation for the CITY to consider. Upon the decision of the CITY, the
ENGINEER shall be notified of the CITY'S decision with instructions to inform the
Contractor. All matters of this nature shall be reduced to writing for the record as soon
as practical. The ENGINEER shall have other duties in this regard that may be included
in the General Conditions of construction contract documents.
• Review samples, catalog data, schedules, shop drawings, laboratory, shop and mill tests
of material and equipment and other data which the Contractor submits. This review is
for the benefit of the CITY and covers only general conformance with the information
given by the Contract Documents. The Contractor is to review and stamp his approval
on submittals prior to submitting to ENGINEER, and review by the ENGINEER does not
relieve the Contractor of any responsibility such as dimensions to be confirmed and
correlated at the job site, appropriate safety measures to protect workers and the public,
or the necessity to construct a complete and workable facility in accordance with the
Contract Documents.
• Obtain and reviews monthly the final estimates for payments to Contractors, furnish to
the CITY any recommended payments to Contractors and assemble written guarantees
which are required by the Contract Documents.
• Perform a walk through and prepare a punch list.
• Conduct, in company with the CITY, a final inspection of the Project for compliance with
the Contract Documents, and submit recommendations concerning Project status, as it
may affect CITY'S final payment to the Contractor. The ENGINEER shall assist the CITY
with close out documents.
• On the 11th month of the warranty period, The ENGINEER shall assist the CITY with an
inspection of the project and coordinate any defects that needs to be addressed.
Schedule of Work
Fittz &Shipman, Inc. is prepared to begin work upon authorization of this proposal.
Scope of Work Qualifications
Services or fees not included in this contract include:
• Civil Engineering Services;
• Surveying Services;
• Coordination of bidding or construction activities;
• Fulltime site observation/inspection of construction;
• Coordination and fees associated with construction quality assurance testing (i.e.
subgrade density testing, concrete strength testing, etc.): or
• Windstorm insurance certificate.

Although these services are not authorized, this contract may be amended to provide additional
services at the published standard rates.
STRUCTURAL ENGINEERING COMPENSATION —Fixed Fee
Fittz&Shipman, Inc. proposes to provide the above outlined Construction Phase Services on
a fixed fee basis listed below:

In the event of efforts beyond the anticipated scope of services, Fittz & Shipman, Inc. shall
notify you regarding the need for amendment of this agreement regarding scope and
compensation. Fittz &Shipman, Inc. shall submit monthly statements for Services rendered
based on percent of task complete and for Reimbursable Expenses incurred. Reimbursable
Expenses mean the actual expenses incurred for Application Fees, and similar Project-related
items. Reimbursable Expenses shall also include the amount billed to Fittz & Shipman, Inc.
by special consultants employed by Fittz & Shipman, Inc., (as authorized by you) for such
consultants' services and Reimbursable Expenses plus a management fee of 15%.
We appreciate your confidence in Fittz &Shipman, Inc. for this project. If you wish to discuss
our scope of services, scheduling, or compensation, please feel free to call. If this proposal
meets with your approval, please return a signed copy to our office.
