HomeMy WebLinkAboutPO 6025: APPROVING THE 2009 TAX ROLLMemorandum City of Port Arthur, Texas Finance Department To: Steve Fitzgibbons, City Manager From: Rebecca Underhill, Assistant City IV~ Date: August 27, 2009 Subject: Proposed Ordinance No. 6024 and 6025 RECOMMENDATION Pursuant to Section 26.05 of the Texas Property Tax Code, Proposed Ordinance No. 6024 Adopting the 2009 Tax Rate and Proposed Ordinance No. 6025, Approving the 2009 Tax Roll for the City of Port Arthur are presented for City Council consideration and approval. BACKGROUND The proposed tax rate for 2009 is $0.792 per $100 valuation. With a 20% homestead exemption, the proposed tax rate would provide an effective tax rate of $0.634 for all homestead owners. Senior citizen and/or disabled homeowners receive a $25,000 exemption in addition to the 20% homestead exemption. Seniors and disabled homeowners also have their property tax frozen. The 2009 taxable value is $2,050,239,332. This represents a $79,325,465 or 4.02% increase the 2008 taxable value. The 2009 value will produce a tax gross levy of $16,237,896 based on the City's proposed tax rate of $0.792 per $100 of valuation. AN ORDINANCE APPROVING THE 2009 TAX ROLL FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF PORT ARTHUR; AND PROVIDING FOR THE INTEREST AND SINHING FUND AND APPORTIONING EACH LEVY FOR A SPECIFIC PURPOSE. WHEREAS, pursuant to the provisions of Section 26.01 of the Texas Property Tax Code, the Chief Appraiser of the Jefferson County and Orange County Appraisal Districts has certified their approval of, and forwarded to the Tax Assessor-Collectors the appraisal roll to be used for the captioned yeaz; and, WHEREAS, pursuant to Section 26.04 of the Texas Property Tax Code, the City Council of the City of Port Arthur has approved said Appraisal Roll for the captioned yeaz and the Jefferson County Tax Assessor-Collector has calculated and publicized the effective tax rate and roll back tax rate for 2009 and, WHEREAS, pursuant to Section 102.005 Local Government Code the City Manager filed the proposed City Budget with the City Secretary (Clerk) before the 30th day before the date of this ordinance levying taxes for fiscal yeaz 2009 - 2010; and, WHEREAS, by Ordinance No. the City Council adopted an Ad Valorem tax rate of seventy-six cents ($0.792) per One Hundred and No/100 ($100) Dollazs valuation of property; and, WHEREAS, pursuant to Section 26.09 of the Texas Property Tax Code, the Tax Assessor- Collectors having applied the adopted Tax Rate of $0.792 to each listing on the approved Appraisal Roll and having calculated the Tax Liability of each listing; NOW, THEREFORE, BE I1' ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. The Appraisal Rolls as approved by the Jefferson County and Orange County Appraisal Districts with the tax amount entered shall become the Tax Roll of the City of Port Arthur for the Tax Year 2009. Section 2. There is hereby levied for the current year 2009 and there shall be collected for the use and support of the Municipal Government of the City of Port Arthur, and to provide interest and sinking funds for the fiscal year ending September 30, 2009 upon all property; real, personal and mixed, within the corporate limits of said City subject to taxation, tax of seventy nine point two cents ($0.792) on each One Hundred and No/100 ($100) Dollazs valuation of property, said tax being so levied and apportioned to the specific purposes hereinafter set forth, and comprising the gross amount of $16,237,896. (a) For the maintenance and support of the general government (General Fund), a tax of thirty eight seven four six nine ($0.387469) on each One Hundred and No/100 ($100) Dollars valuation of property, comprising a tax amount of $7,944,042. (b) For the Interest and Sinking Fund, a tax of forty and four five three one cents ($0.404531) on each One Hundred and No/100 ($100) Dollars valuation of property, comprising a tax amount of $8,293,854. Section 3. That pursuant to Resolution 04-76 adopted by City Council on Mazch 2, 2004, the gross tax levy be reduced by $293,319 to reflect the tax amount lost to frozen senior citizen and disabled accounts. Section 4. The Jefferson County Tax Assessor-Collector (who, pursuant to contract, is the Tax Assessor-Collector for the City of Port Arthur) and the Orange County Tax Assessor-Collector are hereby directed to prepaze Tax Statements and proceed with the Collections for the 2009 taxable year, and the amounts collected shall be deposited in the Depository of the City of Port Arthur, to be distributed in accordance with this Ordinance. Section 5. There is hereby levied and there. shall be collected in accordance with the provisions of section 102-111 of Article IV of Chapter 102 of the Code of Ordinances, City of Port Arthur, Texas, from certain persons, firms, associations, or corporations, pursuing occupations taxed by the General Laws, of the State of Texas, an annual Occupation Tax, provided by the State Laws, which may be paid as provided the State Law. Section 6. This being an Ordinance not requiring publication it shall take effect immediately and be in force from and after its passage.
