AN ORDINANCE AS IT PERTAINS TO HOIISE BILL 2113 AND SEPTEMBER llT" WHEREAS, House Bill 2113 grants a fire fighter the same number of vacation days and holidays, or days in lieu of vacation days or holidays, granted to other municipal employees, with at least one day being designated as September 11T", as delineated in Exhibit "A", attached hereto. WHEREAS, House Bill 2113 also stated that a police officer shall be granted the same number of vacation days and holidays or days in lieu of vacation days or holidays granted to other municipal employees and WHEREAS, the fiscal analysis of the Legislative Budget Board attached hereto as Exhibit "B" indicates that there was no fiscal implication to units of local government being anticipated and WHEREAS, the Articles of Agreement between the City of Port Arthur and Local 397, International Association of Fire Fighters provides for ten (10) paid holidays or days in lieu thereof as follows: 1. New Year's Day 2. Martin Luther King Jr. Day 3. Good Friday 4. Memorial Day 5. Independence Day 6. Labor Day 7. Thanksgiving Day Z.po6031 8. Day after Thanksgiving 9. Christmas Day 10. One "Floating" holiday as designated each year by the City Council NOW THEREFORE, BE IT ORDAINED BY THE CITY COIINCIL OF THE CITY OF PORT ARTHIIR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That September 11th is herein designated as the official floating holiday of the Port Arthur Fire Department. Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. No. zll AN ACT relating to the holidays for members of fire and police departments in certain municipalities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 142.0013 (c), Local Government Code, is amended to read as follows: (c) A fire fighter [ ] shall be granted the same number of vacation days and holidays, or days in lieu of vacation days or holidays, granted to other municipal employeesi_at least one of which shall be desicmated as September 11th. SECTION 2. Section 142.0013, Local Government Code, is amended by adding Subsection (d) to read as follows: (d) A police officer shall be Granted the same number of vacation days and holidays, or days in lieu of vacation days or SECTION 3.
