AT GULFWAY DR. nrt rthuur INTEROFFICE MEMORANDUM Date: May 9, 2023 To: The Honorable Mayor and City Council Through: Ronald Burton, City Manager From: Calvin Matthews, P.E., Water Utilities Director RE: PR 23005 —Ratification of Sewer Main Emergency Repair on Orange Avenue at Gulfway Drive Introduction: The intent of this Agenda Item is for the City Council to ratify the emergency repair of the 12" sewer main on Orange Avenue at Gulfway Drive (State Highway 87). The condition of the sewer pipe created a situation that would cause damage to the highway and present a danger to the citizens if not taken care of. Background: The 12" sewer main on Orange Avenue which crosses Gulfway Drive (State Highway 87) was in need of urgent repair, to prevent the situation from worsening, causing sanitary sewer backup in residences and damage to the highway. On February 23, 2023, the City Manager signed an emergency memo, authorizing the repair. The original estimate for the repairs was $50,000.00, but due to the complications found after excavating, additional work was required. Global Drilling, Inc. of Winnie, Texas was called to make the repairs. Budget Impact: The total budgetary impact is $186,700.00 and funding is available in Account No. 405-40- 000-8516-00-00-000, Project No. WS0016-CON. Recommendation: It is recommended that City Council approve Proposed Resolution No. 23005, ratifying the emergency repair of the 12" sewer main as described/outlined above. A RESOLUTION RATIFYING THE CITY MANAGER'S DECISION TO AUTHORIZE THE EMERGENCY REPAIR TO THE SEWER MAIN ON ORANGE AVENUE AT GULFWAY DRIVE (STATE HIGHWAY 87), FOR THE TOTAL NOT TO EXCEED AMOUNT OF $186,700.00 FROM WATER UTILITIES ACCOUNT NO. 405-40-000- 8516-00-00-000, PROJECT NO. WS0016-CON. WHEREAS,the sewer main on Orange Avenue at Gulfway Drive(State Highway 87)was in need of urgent repair, to prevent the situation from worsening, causing sanitary sewer backup in residences and damage to the highway; and, WHEREAS,on February 23,2023,the City Manager signed an emergency memo(Exhibit "A"), authorizing the repair by Global Drilling, Inc. of Winnie, Texas; and, WHEREAS, the original estimate for the repairs was $50,000.00, but due to the complications found after excavating, additional work was required; and, WHEREAS,pursuant to Section 252.022(a)(1),this procurement is necessary to preserve or protect the public health or safety of the municipality's residents; and, WHEREAS, it is authorized pursuant to Section 252.022(a)(3) of the local government code because of the unforeseen damage to public machinery, equipment, or other property. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, City Council hereby ratifies the City Manager's decision to authorize the emergency repairs for the total not to exceed amount of$186,700.00 (Invoice attached as Exhibit "B") from Account No. 405-40-000-8516-00-00-000,Project No. WS0016-CON; and, PR No. 23005 5/9/23 bw Page 2 of 3 THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the Meeting of the City Council.
