RE: PR23155: Sabine Pass Boat Ramp: Amendment No. 2—Extension of contract time
with the Texas Parks and Wildlife Division for the reconstruction of the Sabine Pass
Boat Ramp. Project No. PR0007-GRA.
Introduction:
The intent of this Agenda Item is to authorize the City Manager to execute Amendment No. 2 with the
Texas Parks and Wildlife Division(TPWD)that extends the original contract completion date of May
31,2023 to the new contract completion date of December 31,2023 for the reconstruction of the Sabine
Pass Boat Ramp in Sabine Pass, Texas.
Background:
Pursuant to Resolution No. 20-425, City Council agreed to participate in and accept grant funding from
the TPWD for the reconstruction of the Sabine Pass Boat Ramp in Sabine Pass, Texas. The monies
were secured through the Harvey Fisheries Disaster Relief Grant Program.
The Sabine Pass Boat Ramp Rebuild and Area Improvements Project experienced delays in procuring
materials, sheet piling,the installation of offshore protection, and rain prior to the start of construction.
The TPWD has submitted an amendment to the original contract document that extends the project by
7 months. Section IX. TERM OF CONTRACT, is amended to extend the contract completion date
from May 31, 2023 to the new contract completion date of December 31,2023.
Budget Impact:
Funding for this project is not impacted by Amendment No. 2.
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR23155 that authorizes the City
Manager to execute Amendment No.2 with the Texas Parks and Wildlife Division(TPWD)that extends
the original contract completion date of May 31,2023 to the new contract completion date of December
31, 2023 for the reconstruction of the Sabine Pass Boat Ramp in Sabine Pass, Texas.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AMENDMENT NO. 2 TO THE CONTRACT BETWEEN
THE CITY OF PORT ARTHUR AND THE TEXAS PARKS AND
WILDLIFE DEPARTMENT (TPWD) ADDING 7 MONTHS TO THE
ORIGINAL CONTRACT COMPLETION DATE OF MAY 31, 2023
TO THE NEW CONTRACT COMPLETION DATE OF DECEMBER
31, 2023 FOR THE SABINE PASS BOAT RAMP REBUILD AND
AREA IMPROVEMENTS PROJECT. FUNDING IS NOT
IMPACTED. PROJECT NO. PR0007-GRA.
WHEREAS, pursuant to Resolution No. 20-425, City Council agreed to participate and
accept the grant funding for the reconstruction of the Sabine Pass Boat Ramp from the Texas
Parks and Wildlife Department (TPWD); and,
WHEREAS, the City of Port Arthur entered into an agreement with the Texas Parks &
Wildlife Department (TPWD), by way of a grant, from the Harvey Fisheries Disaster Relief
Grant Program for the reconstruction of the Sabine Pass Boat Ramp; and,
WHEREAS, pursuant to Resolution 22-450, the City of Port Arthur entered into an
agreement with Elite Contractors & Equipment, LTD, of Kirbyville, Texas, for the construction
of the Sabine Pass Boat Ramp and Area Improvements Project; and,
WHEREAS, there were significant delays in procuring materials, sheet piling,
installation of offshore protection devices, and rain prior to the start of construction; and,
WHEREAS, the TPWD, having examined the specifics for the delays, has agreed that
the delays were justified and extended the contract completion by seven (7) months; and,

WHEREAS, the TPWD has submitted an amendment to Contract No. CA-0001129,
Section IX. TERM OF CONTRACT, that extends the contract from its original contract
completion date of May 31, 2023 to the new contract completion date of December 31, 2023,
see Exhibit A; and,
WHEREAS, approval of PR23155 is herein deemed an appropriate action; now
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is authorized to execute Amendment No. 2 to change the
original contract completion date of May 31, 2023 to the new contract completion date of
December 31, 2023; and,
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

AMENDMENT TO CONTRACT

It is mutually understood and agreed by and between the undersigned contracting parties of the above
numbered Contract to amend said contract as follows:
In accordance with the terms of the above referenced contract executed March 19, 2021 and
Amendment 1 executed October 31, 2022, TPWD hereby amends the project entitled, "Sabine Pass
Boat Ramp Rebuild and Area Improvement," as follows:
Section IX.TERM OF CONTRACT, is amended to extend the contract by 7 (seven) months. The new
contract termination date is December 31, 2023.
The total reimbursable contract amount remains and shall not exceed $1,382,751 (one million three hundred
eighty-two thousand seven hundred fifty-one dollars) with sources as per the funding breakdown provided
below. Budgeted monies not spent in Fiscal Year (FY) 2023 are eligible to be rolled over to FY 2024.
