Langford, Assistant City Manager— Operations/Director of Development Services RE: P.R. NO. 23159 — A resolution authorizing a payment to the Jefferson County Tax Office. Introduction: This agenda item intends to seek City Council' s approval of P. R. NO. 23159 authorizing a payment to the Jefferson County Tax Office in an amount not exceed $39,841.32. Funding is available in the City Manager's Contingency Account No: 001-01-005-5470- 00-10-000. Background: On March 23, 2023, the Jefferson County Tax Office contacted the City of Port Arthur to inform that there were several properties listed in the City's name as registered owner that are due and owing in property/improvement taxes. Some of the properties were acquired through the Jefferson County Sheriff's Sale and were resolved by the City's Housing Division. However, there are tax balances associated with the former banking location of 441 Austin Avenue, occupied by Capital One Bank that assessed property and improvement taxes in the amount of$39,841.32 y-t-d. Budget Impact: The current tax balance is $39,841.32 up until May 31, 2023. Following this date, the City will be charged interest and penalties increasing the tax amount. Funding available in the City Manager's Contingency Account No: 001-01-005-5470-00-10-000; Project No. MA0023-OTH-OCS. Recommendation: It is recommended that the City Council approve P. R. NO. 23159 authorizing a payment to the Jefferson County Tax Office in an amount not exceed $39,841.32. Funding is available in the City Manager's Contingency Account No: 001-01-005-5470- 00-10-000. A RESOLUTION AUTHORIZING A PAYMENT TO THE JEFFERSON COUNTY TAX OFFICE IN AN AMOUNT NOT TO EXCEED $39,841.32; FUNDING AVAILABLE IN THE CITY MANAGER'S CONTINGENCY ACCOUNT NO: 001-01-005-5470-00-10-000; PROJECT NO. MA0023- OTH-OCS. WHEREAS, pursuant to Resolution 07-514, the City of Port Arthur entered into a lease agreement with Capital One, National Association ("Capital One") to occupy a portion of the building located at 441 Austin Avenue, Port Arthur, Texas; and WHEREAS, the lease agreement was for two full years of the commencement date of June 1, 2008, with the option to renew for two (2) consecutive two (2) year terms; and, WHEREAS, in accordance with Article II, Section 2.03 Rent of the Lease Agreement, the Tenant shall not be responsible for any maintenance or operating costs, real property taxes or insurance on the Property other than as expressly stated; and, WHEREAS, there is currently a balance associated with the space leased by Capital One National Association in an amount not to exceed $39,841 .32, if paid before May 31 , 2023, as delineated in Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the City Council of the City of Port Arthur hereby authorizes a payment to the Jefferson County Tax Office in an amount not to exceed $39,841.32; funding available in the City Manager's Contingency Account No: 001-01-005-5470-00-10-000; Project No. MA0023-OTH-OCS. yr,.
