Langford, Assistant City Manager— Operations/Director of Development Services RE: P.R. NO. 23168 — A resolution appointing a Planning and Zoning Commission member. Introduction: This agenda item intends to seek the City Council s approval of P. R. NO. 23168 appointing a member to the City's Planning and Zoning Commission, pursuant to Article XI, Section 1, of the Charter of the City of Port Arthur, to serve out the unexpired five (5) year term created by May 6, 2023, City Council Election, where Tiffany Hamilton, prevailed as the District 2 City Council Electee. The term shall expire on October 30, 2024. Background: In accordance with Article XI, Section I, the City Planning and Zoning Commission shall be composed of five (5) members and appointed for a term of one, two, three, four, and five years, respectively, and annually thereafter, one member shall be appointed for the term of five (5) years. Members of the City Planning and Zoning Commission shall be appointed by a majority vote of the members of the City Council and may be removed for cause at any time. Currently, this position is being held by Tiffany Hamilton, who was appointed to fill the unexpired term created by the death of Fernando Ramirez, who passed away on January 31, 2023. Ms. Hamilton was appointed to the commission on March 14, 2023, and has diligently served since then. On May 6, 2023, Ms. Hamilton prevailed as the District 2 Electee for City Council, disallowing her continued appointment as a Planning and Zoning Commissioner. NO. 23168 appointing a member to the City's Planning and Zoning Commission, pursuant to Article XI, Section 1, of the Charter of the City of Port Arthur, to serve out the unexpired five (5) year term created by May 6, 2023, City Council Election, where Tiffany Hamilton, prevailed as the District 2 City Council Electee. NO.23168 05/11/2023 PDL PAGE 1 OF 2 RESOLUTION NO. A RESOLUTION APPOINTING A MEMBER TO THE PLANNING AND ZONING COMMISSION OF THE CITY OF PORT ARTHUR, AND WHOSE TERM SHALL EXPIRE OCTOBER 30, 2024. WHEREAS, there is a vacancy on the Planning and Zoning Commission created by the City Election held on May 6, 2023; and, WHEREAS, Tiffany Hamilton prevailed as the District 2 City Council electee; and, WHEREAS, pursuant to Section 1 of Article XI of the Charter of the City of Port Arthur, it is necessary to appoint a person to fill this unexpired term; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1: That the facts and opinions in the preamble are true and correct. Section 2: That is hereby appointed to serve as a member of the Planning and Zoning Commission to fill the vacancy created by the May 6, 2023, District 2 City Council Electee Tiffany Hamilton and shall serve out the unexpired term until October 30, 2024. Section 3: That in accordance with Resolution No. 98-157, appointees shall immediately contact the City Secretary's Office and be sworn in, receive a copy of the Charter, the Zoning Ordinance, and attend an orientation seminar. Section 4: That this Resolution shall be effective immediately. Section 5: That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. READ, ADOPTED AND APPROVED this day of May, A.D., 2023, at a Regular Meeting of the City Council of the City of Port Arthur, Texas by the following vote: AYES: MAYOR P.R.
