Subject: P. O. No. 6034; Council Meeting September 1, 2009
Attached is P. O. No. 6034 amending Section 18-32 of
the Code of Ordinances of the City of Port Arthur as to
provide certain amendments thereto; pertaining to permit
fees, repealing -all ordinances or parts of ordinances in
conflict therewith, and providing for an effective date.
It modifies the ordinance as to give the building
official more discretion as to issue a new permit without
assessing the full amount of the permit fee with justifiable
cause demonstrated.

ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 18-32 OF THE
CODE OF ORDINANCES OF THS CITY OF PORT ARTHIIR,
AS TO PROVIDE CERTAIN AMENDMENTS THERETO
PERTAINING TO PERMITS FEES; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
THEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on January 2, 2008, by Ordinance No. 08-02, the City
of Port Arthur adopted the International Building Code, 2006
Edition published by the International Code Council, Inc.; and
WHEREAS, the City Council deems it in the best interest of the
citizens to amend Section 18-32 by inserting a provision modifying
Section 105.5 of the 2006 International Building Code as to add the
following language thereto:
"If the permit has expired, the building official is
authorized to issue a new permit without assessing the full
amount of the permit fees upon written request with
justifiable cause demonstrated."
NOW THEREFORE, BE IT ORDAINED BY THE CITY COIINCIL OF THE CITY
OF PORT ARTSIIR:
Section 1. That the facts and opinions in the preamble
are true and correct.
Section 2. That Section 18-32 of the Building Code of
Ordinances is hereby amended by inserting an amendment to Section
105.5 of the 2006 International Building Code, as follows:
"105.5 Expiration. Every permit issued shall become invalid
unless the work on the site authorized by such permit is

commenced within 180 days after its issuance, or if the work
authorized on the site by such permit is suspended or abandoned
for a period of 180 days after the time the work is commenced.
The building official is authorized to grant, in writing, one or
more extensions of time, for periods not more than 180 days each.
The extension shall be requested in writing and justifiable cause
demonstrated.
If the permit has expired, the building official is
authorized to issue a new permit without assessing the full
amount of the permit fees upon written request with justifiable
cause demonstrated."
Section 3. That all ordinances or parts of ordinances in
conflict herewith are herein repealed, but only to the extent of
said conflict.
Section 4. That this being an Ordinance amending an
Ordinance which does not carry a penalty, and does not require
publication, it shall take effect immediately from and after its
passage.
Section 5. That a copy of the caption of this Ordinance
be spread upon the Minutes of the City Council.
