RE: P.R. NO. 23213 —A resolution calling for a public hearing to consider the
abandonment of an approximate 0.1377-acre portion of a dedicated alley
right-of-way.
Introduction:
The intent of this Agenda Item is to request a public hearing to consider the
abandonment of approximately 0.1377-acre (6,000 SF) of a dedicated portion of an
Alley right-of-way located in Block 180, Port Arthur, Jefferson County, Texas.
The request is being made on behalf of Lamar State College — Port Arthur for the
construction of a new Allied Health and Science Facility.
Background:
An application was submitted on behalf of Lamar State College — Port Arthur on May
23, 2023, requesting consideration for abandoning a portion of an alley right-of-way
between New Orleans and Vicksburg Avenues and 5th Street and Procter Street.
In accordance with Chapter 94, Article VI, Section 94-383(b), before an abandoning
ordinance can be considered by City Council, the following must occur:
1. A recommendation shall be requested and received from the planning and
zoning commission.
2. A public hearing shall be held with notice furnished to all property owners
within 200 feet and published in the official newspaper of the city.

The Planning Commission will hold a public hearing on June 26, 2023, to discuss this
request in an open session.
Budget Impact:
An appraisal has been requested from a licensed and qualified real estate appraiser,
which will provide a current, fair, and reasonable valuation for consideration for the
proposed acquisition of said right-of-way.
Recommendation:
It is recommended that City Council approve P.R. No. 23213, calling for a public hearing
to consider the abandonment of approximately 0.1377-acre (6,000 SF) of a dedicated
portion of an Alley right-of-way located in Block 180, Port Arthur, Jefferson County,
Texas.
A public hearing shall be held on Tuesday, July 18, 2023, at 10:00 a.m.

A RESOLUTION CALLING FOR A PUBLIC HEARING TO
CONSIDER A PROPOSED ABANDONMENT FOR
APPROXIMATELY 0.1377 ACRES OF LAND CONSISTING OF A
DEDICATED PORTION OF AN ALLEY RIGHT-OF-WAY,
LOCATED IN BLOCK 180, PORT ARTHUR, JEFFERSON
COUNTY, TEXAS.
A23-03 — LAMAR STATE COLLEGE — PORT ARTHUR
WHEREAS, the Port Arthur Planning and Zoning Commission is recommending
that City Council consider an abandonment for approximately 0.1377-acre of land
consisting of a 20' x 300' dedicated portion of an alley right-of-way, located in Block 180,
bounded by New Orleans Avenue, Vicksburg Avenue, 5th Street, and Procter Street, Port
Arthur, Jefferson County, Texas, as delineated in Exhibit "A"; and,
WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to
consider the abandoning, vacating, and relinquishing streets, alleys, and easements; and,
WHEREAS, City Council has the authority to vacate, abandon, or close a street
under Sections 311 .001 and 311 .007 of the Transportation Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the Planning and Zoning Commission will hold a public hearing for this case
on June 26, 2023.
THAT upon abandoning and vacating streets, the City shall have the right to retain
utility easements if desired.
THAT a public hearing to consider whether to grant the applicant the abandonment
as delineated in Exhibit"A" shall be held on July 18, 2023, at 10:00 a.m. in the City Council

Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and
videoconference.
THAT notice of the public hearing shall be published at least fifteen days prior in
the City's official newspaper before going to the City Council.
THAT a copy of the caption of this Resolution is spread upon the Minutes of the
City Council.
READ, ADOPTED, AND APPROVED this day of June, A.D.2023, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote:
