RE: PR 23175—Memorandum of Understanding between Lamar State College Port
Arthur(LSCPA) and the City of Port Arthur Police Department to provide
communication services with regards to Motorola portable communication
radios.
Introduction:
The intent of this Agenda Item is to seek the City Council's approval to execute a
Memorandum of Understanding between Lamar State College Port Arthur(LSCPA) and the
City of Port Arthur Police Department to provide communication services with regards to
Motorola portable communication radios.
Background:
The mission of this Memorandum of Understanding is to provide for the utilization of
resources as well as communication and coordination of efforts within the boundaries of
LSCPA and the City of Port Arthur.
To ensure that communication and that the sharing of information is conducted the Port Arthur
Police Department will allow LSCPA to utilize seven(7) Motorola portable communication
radios owned by LSCPA that will be programed to comply with the Department of Homeland
Security, Project 25 (P-25), allowing for each radio to be interoperable.
This Memorandum of Understanding sets forth the operational procedures and responsibilities
of LSCPA and the Port Arthur Police Department in providing communication services with
regards to Motorola portable communications.
Budget Impact:
None

It is recommended that the City Council authorize the City Manager to execute a
Memorandum of Understanding between LSCPA and the City of Port Arthur Police
Department to provide communication services with regards to Motorola portable
communication radios.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN
LAMAR STATE COLLEGE PORT ARTHUR (LSCPA) AND THE
PORT ARTHUR POLICE DEPARTMENT TO PROVIDE
COMMUNICATION SERVICES WITH REGARDS TO MOTOROLA
PORTABLE COMMUNICATION.
WHEREAS, the City of Port Arthur Police Department
desires to enter into a Memorandum of Understanding with Lamar
State College Port Arthur (LSCPA) to provide communication
services with regards to Motorola portable communication
radios; and
WHEREAS, the mission of this MOU is to provide for the
utilization of resources as well as communication and
coordination of efforts within the boundaries of Lamar State
College Port Arthur (LSCPA) and the City of Port Arthur; and
WHEREAS, the Port Arthur Police Department request that
the City Manager, execute the Memorandum of Understanding
in substantially the same form as Exhibit "A" .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct .
Section 2 . That the City Council authorizes the City
Manager to execute a Memorandum of Understanding (MOU)
between Lamar State College Port Arthur and the Port Arthur
Police Department in substantially the same form as attached
hereto as Exhibit "A" .
Section 3 . That a copy of the caption of this resolution
shall be spread upon the Minutes of the City Council .

EXHIBIT "A"
MEMORANDUM OF UNDERSTANDING
BETWEEN
PORT ARTHUR POLICE DEPARTMENT
AND
LAMAR STATE COLLEGE PORT ARTHUR
The Port Arthur Police Department(P.A.P.D.)is executing this Memorandum of
Understanding(MOU) in conjunction with the Lamar State College Port Arthur(L.S.C.P.A.).
The parties agree to abide by the terms and provisions of this MOU throughout the duration of
this agreement.
PURPOSE
The purpose of this MOU is to set forth the operational procedures and responsibilities of
L.S.C.P.A. and the P.A.P.D. in providing communication services with regards to Motorola
portable communications radios and Emergency Phones.
MISSION
The mission of the MOU is to provide for the utilization of resources as well as
communication and coordination of efforts within the boundaries of L.S.C.P.A. and the City of
Port Arthur.
I
During the terms of this agreement the P.A.P.D. agrees to dedicate,within the Regional
Radio System, one radio channel to L.S.C.P.A. under the P.A.P.D.talk group.
The P.A.P.D. agrees to allow this access at no charge to L.S.C.P.A. unless there is a
substantial increase in the yearly Subscriber Unit fee. In the event a substantial increase in the
yearly Subscriber Unit fee occurs, L.S.C.P.A. assumes financial responsibility for the increase.

During the terms of this agreement the P.A.P.D. agrees to allow for the utilization of
seven(7)Motorola portable communication radios owned by L.S.C.P.A.
Each of the Motorola portable communication radios must be programmed to comply
with Department of Homeland Security, Project 25 (P-25),allowing for each radio to be
interoperable.
The P.A.P.D. Radio Manager,currently Det. Brian Cater,will maintain a record of each
radio.
L.S.C.P.A agrees at any time a Motorola portable communication radio is either added,or
removed,the P.A.P.D. Radio Manager,currently Det. Brian Cater,will be notified immediately.

Upon the removal of any Motorola portable communication radio from the system;the
frequency,related to the public safety system(Talk Group and ID Numbers) shall be wiped
clean.
III
L.S.C.P.A. agrees the utility of the seven(7)Motorola portable communication radios is
to provide for communications between L.S.C.P.A. Safety and Security Personnel and
Officers/Dispatchers of the P.A.P.D.
The template set up on the seven(7)Motorola portable communication radios will
consist of four channels.
The first channel will be labeled"LUPA 1". Use of the"LUPA 1"channel is for
L.S.C.P.A. Security personnel to communicate amongst themselves as well as Port Arthur Police
Officers on duty at L.S.C.P.A. The second channel labeled LUPA 2 is a dead channel.
The third channel is PAPD"F"and fourth channel PAFD"1". These two channels,
PAPD"F"and PAFD"1"are strictly included for emergency purposes and direction of
emergency services during an emergency only. Emergencies would include active shooter,or
any other in progress violent felony, as well as any State declared emergency or natural disaster.
PAPD"F"and PAFD "1"are monitored by P.A.P.D. Dispatchers at all times.
Use of Channel PAPD"F"or Channel PAFD "1" in a non-emergency manner can be
grounds for termination of this agreement.
IV
During the terms of this agreement the P.A.P.D. agrees to allow for regularly scheduled
Motorola portable communication radio and Emergency Phone testing conducted by the
L.S.C.P.A. Safety and Security Department.
L.S.C.P.A. currently maintains seven(7)emergency phones consisting of three (3)
exterior phone towers and four(4)interior phones.
The P.A.P.D. agrees to allow the L.S.C.P.A. Security and Safety Department to conduct
two(2) Motorola portable communication radio checks each Monday morning at approximately
8:00am.
The P.A.P.D. agrees to allow the L.S.C.P.A. Safety and Security Department to conduct
two(2)Emergency Phone tests on the first Monday of each month at approximately 8:00am.
The L.S.C.P.A. Safety and Security Department will rotate the Motorola portable
communication radios and the Emergency Phones for each test to ensure proper operability.
The L.S.C.P.A. shall maintain a detailed log(See Attachment)of each test for each
Motorola portable communication radio and each Emergency phone. The L.S.C.P.A. agrees to
make this detailed log available upon request to the P.A.P.D. Radio Manager,currently Det.
Brian Cater, for inspection.
DURATION
This MOU shall become effective immediately upon signature of each;the Chief of
Police of the P.A.P.D.,the Executive Vice President for Finance and Operations of L.S.C.P.A.
and the Executive Director of Campus Safety of L.S.C.P.A.

This MOU shall remain in affect until such time as an assessment of and/or any
modification becomes required.
