Home My WebLink AboutPR 23225: ELECTRICAL CONTRACT FOR PARKS City of _ —ort rthu Tetas INTEROFFICE MEMORANDUM Date: June 22, 2023 To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Clifton Williams, Purchasing Manager RE: PR 23225—Electrical Contract for Parks Introduction: The intent of this Agenda Item is to seek City Council's approval for PR 23225 authorizing the second and final renewal of the contracts for electrical work with Bennet Electric and Gulf Coast Electric. Background: The City would like to renew the contract with an electrical contractor to provide electrical repairs for various departments. Examples are Ball Park Lighting, Street Lighting, high voltage industrial repairs for Utility Operations, etc. The repairs will be on an as needed basis. City Council approved the contract on Resolution 21-263. City Council approved the first renewal with Resolution 22-314. The City would like to renew Bennett Electric as the primary contractor and Gulf Coast as the secondary contractor. The cost for these contracts was based on the labor rates, rental rates for equipment, materials cost stated in the contract. Budget Impact: The R&M Budget Account numbers for the various departments will be used. Recommendation: The intent of this Agenda Item is to seek City Council's approval for PR 23225 authorizing the second and final renewal of the contracts for electrical work with Bennet Electric and Gulf Coast Electric. A RESOLUTION AUTHORIZING THE THIRD YEAR (FINAL RENEWAL) OF THE CONTRACT WITH BENNET ELECTRIC OF BEAUMONT, TEXAS AND GULF COAST ELECTRIC CO. INC, OF BEAUMONT, TEXAS, FOR ELECTRICAL REPAIRS AND MAINTENANCE AT VARIOUS LOCATIONS, WITH A PROJECTED BUDGETARY IMPACT OF $115,000.00; FUNDS AVAILABLE IN R & M ACCOUNT NUMBERS FOR VARIOUS DEPARTMENTS. WHEREAS, pursuant to Resolution 21-263, the City of Port Arthur entered into an electrical contract for electrical repairs and maintenance at various city parks and facilities with an option to renew for two (2) additional one-year period; and, WHEREAS,pursuant to Resolution 22-314, the City of Port Arthur renewed the electrical contract for electrical repairs and maintenance at various city parks and facilities with an option to renew for one (1) additional one-year periods; and, WHEREAS,this contract will used by various departments when necessary; and, WHEREAS, the City desires to renew the contracts with Bennett Electric and Gulf Coast Electric for electrical and maintenance at various city parks and facilities for the second year(final renewal); now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager of the City of Port Arthur is hereby authorized to renew the contracts between the City of Port Arthur and Bennett Electric, in substantially the same form as attached hereto as Exhibit"A", and Gulf Coast Electric Co. Inc., in substantially the same form as attached hereto as Exhibit"B". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. P. WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution No. 22-314, the City entered into a one (1) year contract renewal with the option to renew for one (1) additional year. The parties hereby agree to exercise said option for the third and final year. 2. The term of this Contract shall be from July 21, 2023 to July 20, 2024. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle within thirty (30) days written notice. 3. The Contractor will supply electrical repair service at various parks as stated in the Contract 21-263. 4. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 5. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms in the amounts stated in bid documents. 6. The term "Contract Documents" means and includes the following: 1) Agreement 2) General Information * 3) Specification * /1) Bid * 5) Notice of Award * 6) Notice to Proceed * * These items were attached to the original letting contract. This agreement is only included in this renewal. 7. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns.
