McMahen, P.E., Director of Public Works P.R. #12233 3une 16, 2003 RECOI4MENDATZON It is recommended that the City Council approve Proposed Resolution No. 12233, authorizing the Mayor and City Manager to execute a contract in the amount of $87,615 between the City of Port Arthur and T&N Laboratories, 1;nc. of Nederland, Texas, for design and construction phase services for Cell No. 46 at the City's Sanitary Landfill. Funds are available in Account No 403-1274-533.54-00 in the Public Works-Solid Waste Division. BACKGROUND: The Public Works-Solid Waste Division constructed cells 44A, 44B and 45 in FY2001, and it was expected that no additional cell construction would be needed for 3-4 years. However, with Eastex Waste Systems now hauling a significant waste volume under contract to the site, the space in these cells is being used rapidly. We will need to be in the new Cell 46 by May, 2004 so design must be done quickly to get the work out for bids for construction. T&N has done our previous cell designs and performed construction phase services for them. BUDGETARY/FiSCAL EFFECT Funds are available in the Public Works-Solid Waste Division FY 2003 Budget, Account No. 403-1274-533.54-00, which has an unencumbered balance of $45,028.64. This will be sufficient to fund the design services and a portion of the construction phase services. Additional funds will be requested in the FY 2004 budget. STAFFlrNG/EMPLOYEE EFFECT Acceptance of this recommendation will have no effect on staffing levels at this time. WHEREAS~ the City of Port Arthur finds is necessary to construct an additional Sub-Title D cell at it's sanitary landfill; and, WHEREAS~ this effort must be pursued at the earliest possible date; and, WHEREAS~ the design phase and construction phase services for this effort requires the use of a specialized professional firm that can provide such services; now, therefore, BE 11' RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR~ TEXAS: THAT the Mayor and City Manager be and they are hereby authorized to execute on behalf of the City, a contract with T&N Laboratories, Inc. of Nederland, Texas, acting through .lack C. Lind, P.E., for design phase and construction phase services for the construction of Cell No. 46 for the City's Sanitary Landfill in the amount of $ 87,615, said contract being attached hereto and made a part hereof as Exhibit a complete copy of which is available for review in the office of the City Secretary; and, THAT the amount of said contract is not to exceed $87,615 without further authorization from the City; and, P.R. No. 12233 Page #2 THAT funds for the services are available in the Public Works-Solid Waste Division FY 2003 Budget, Account No. 403-1274-533.54-00, and additional funds will be requested in the FY 2004 Budget for the Public Works-Solid Waste Division; and THAT, said Contract is an exact duplicate of a City Standard Form Contract except of the changes described in the Certificate of Standard Form Contract, a copy of which is attached hereto as Exhibit "B'; and said changes are hereby approved; and THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
