McMahen, P.E., Director of Public Works P.A. #12234 .lune 16, 2003 RECOMMENDATION It is recommended that the City Council approve Proposed Resolution No. 12234, authorizing the Mayor and City Manager to execute a contract in the amount of $9,000 between the City of Port Arthur and Bob Shaw Consulting Engineers of Port Arthur, Texas for design phase and construction phase services for drainage improvements on Avalon Avenue. Funding is available in FY 2003 BUdget, Account No. 301-1601-591.84- 00, CIP 804. BACKGROUND Avalon Avenue between 32nd Street and 36m Street has been subject to flooding due to lack of capacity in DD No. 7's Pear Ridge Main #1, Lateral #3. This will soon be upgraded but will leave a small City storm sewer line in place between Avalon and the ditch. Since Bob Shaw Consulting Engineers designed the ditch improvement, it is a logical choice to hire them at this time to design the storm sewer replacement. BUDGETARY/FISCAL EFFECT Funds are available in Account No. FY 2003 Account No. 301-1601-591.84-00, CIP 804, which has a current unencumbered balance of $173,365.25. STAFFING/EMPLOYEE EFFECT None. A RESOLU'r~ON AUTHOI~Z~[NG THE MAYOR AND CtTY MANAGER TO EXECUTE A CONTRACT tN THE AMOUNT OF $9~000 BETWEEN THE C~TY OF PORT ARTHUR, TEXAS AND BOB SHAW CONSUL'n:NG ENGI'NEERS OF PORT ARTHUR, TEXAS FOR DESIGN PHASE AND CONSTRUCTI'ON PHASE SERVTCES FOR DRAIINAGE 1'MPROVEMENTS ON AVALON AVENUE~ W1~TH FUNDI'NG AVAI~LABLE TN FY 2003 BUDGET ACCOUNT NO. 301-1601-S91.84- 00~ Cl'P 804, WHEREAS, the City of Port Arthur desires to hire Bob Shaw Consulting Engineers to provide design phase and construction phase services for certain drainage improvements on Avalon Avenue; and, WHEREAS, Bob Shaw Consulting Engineers has previously designed for Drainage District No. 7 a major outfall ditch into which the Avalon Avenue drainage improvements will connect; now, therefore, BE iT RESOLVED BY THE CITY COUNC]~L OF THE CiTY OF PORT ARTHUR, TEXAS: THAT the Mayor and City Manager be and they are hereby authorized to execute on behalf of the City, a contract with Bob Shaw Consulting Engineers, of Port Arthur, Texas for design phase and construction phase services for the Avalon Avenue Outfall Drainage Line in the amount of $9,000, said contract being Exhibit "A" attached hereto and made a part hereof, a complete copy of which is available for review in the office of the City Secretary; and, THAT the amount of said contract is not to exceed $9,000 without further authorization from the City; and, No. 12234 Page 2 THAT funding for is available in FY 2003 Budget Account No. 301-1601- 591.84-00, CIP 804; and, THAT, said Contract is an exact duplicate of a City Standard Form Contract except for the changes described in the Certificate of Standard Form Contract, a copy of which is attached hereto as Exhibit "B'; and said changes are hereby approved; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
