Background: Increasing the number of PAFD members levels of EMS training will be beneficial to the level of services provided. EMS training requires demonstration and evaluation of clinical skills as part of the training process. The agreement will allow the use of Lamar State College Orange clinical facilities and faculty for PAFD members to increase their EMS license levels. The agreement also establishes that PAFD students will be required to meet learning and skill standards without any discrimination or harassment. Budget Impact: The affiliation agreement does not have a budgetary impact. Recommendation: The Fire Department recommends approval of this resolution. A RESOLUTION AUTHORIZING AN AFFILIATION AGREEMENT WITH LAMAR STATE COLLEGE ORANGE FOR THE USE OF CLINICAL FACILITIES DURING PORT ARTHUR FIRE DEPARTMENT (PAFD)MEMBER EMERGENCY MEDICAL SERVICES TRAINING AND EDUCATION. NO BUDGETARY IMPACT EXISTS WITH THE AGREEMENT. WHEREAS, demonstration of Emergency Medical Service (EMS) clinical skills and evaluation are required during the EMS training and education process. The use of an approved clinical facility during the training process will enhance the depth and consistency of skills PAFD members will add to the service level provided to the Port Arthur community; and, WHEREAS, Lamar State College Orange manages a facility that is used for the professional development and evaluation of clinical skills; and, WHEREAS, approximately 75% of the annual emergency incidents PAFD responds to are EMS in nature enhancing the essential service levels provided by PAFD members to the community; and, WHEREAS, the proposed agreement has no budgetary impact and can be terminated with or without cause no less than a 30-day written notice. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute the affiliation agreement with Lamar State College Orange, in substantially the same form as attached hereto as Exhibit"A". Section 3. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council. TERMS OF AGREEMENT 2ILSCO JUNE 2023 AFFILIATION AGREEMENT Between THE DEPARTMENT OF EMERGENCY MEDICAL SERVICES LAMAR STATE COLLEGE ORANGE And PORT ARTHUR FIRE DEPARTMENT The following Affiliation Agreement is entered into between LAMAR STATE COLLEGE ORANGE, Orange, Texas, for and on behalf of the Department of Emergency Medical Services, hereinafter referred to as the "College," and PORT ARTHUR FIRE DEPARTMENT , hereinafter referred to as the "Clinical Affiliate,"for the mutual benefit of both parties, to accept the responsibilities and duties stated herein. 1. It is mutually agreed by the Clinical Affiliate and the College that the educational program and curricula of the Department of Emergency Medical Services is and shall be the responsibility of, and shall be carried out under the direction of personnel of the Department of Emergency Medical Services at LAMAR STATE COLLEGE ORANGE. 2. It is mutually agreed that the provision and supervision of patient/client care is the responsibility of, and shall be carried out under the direction of, personnel of Emergency Medical Services at the Clinical Affiliate. 3. It is mutually agreed that clinical learning experiences for students enrolled in the College will be provided at the Clinical Affiliate. 4. It is mutually agreed that the College faculty will select and assign learning experiences for students, and will further provide teaching, evaluation, overall supervision, and record keeping of students. Faculty members will adhere to policies as agreed upon by the two parties and will assume responsibility for student's adherence to policies mutually agreed upon. Faculty will cooperate with Clinical Affiliate Emergency Medical Services personnel in determining needs of patients/clients who are assigned to students. 5. It is mutually agreed that the College does not, and will not, discriminate against any student, employee, or applicant for registration or employment because of race, religion, sex, color, creed, marital status, age, or national origin. 6. It is mutually agreed that the period of assignment, and the number and distribution of students among divisions of the Clinical Affiliate will be determined by representatives of the College and the Clinical Affiliate. 3ILSCO JUNE 2023 7. It is mutually agreed that the Clinical Affiliate can request the withdrawal of a student or faculty by stating in writing the specific reasons for the request. The written statement should be given to the College representative for review and referral to appropriate administrators. Only the College can dismiss a student from an educational program. 8. It is mutually agreed that representatives of the College and the Clinical Affiliate shall meet regularly to discuss issues of mutual concern, and to make such suggestions and changes as are needed. Both parties will share information pertinent to the Affiliation Agreement. 4ILSCO JUNE 2023 II COLLEGE RESPONSIBITIY To carry out these general areas of agreement, the College is responsible for, and agrees to: 1. Protect the health and safety of all parties by: a. Requiring student liability insurance coverage at no cost to the Clinical Affiliate; b. Requiring students to submit an annual health and physical examination as part of the program's admission; documentation will be on file for Clinical Affiliate review; c. Requiring students and faculty to comply with Center of Disease Control,Texas Department of Health, and Clinical Affiliate rules as regarding health, safety, dress, and conduct; d. Providing, or otherwise arranging for, faculty and student orientation to the Clinical Affiliate, including major policies, rules, and regulations. e. Dismissing students for academic and/or behavioral response according to the College's Student Code of Conduct and program handbook. 2. Arrange with the Clinical Affiliate's representative, and other specified designates, for student clinical learning experiences prior to each semester. The College representative will provide the Clinical Affiliate with: a. Names of students; b. Name(s) of faculty; c. Dates, days, times of clinical learning experiences as previously agreed upon (in I, 6.). 3. Assist with or contribute to Clinical Affiliate educational activities when requested, given that student-related responsibilities allow. 4. Provide for, arrange, and/or encourage Clinical Affiliate Emergency Medical Service personnel participation in selected evaluation programs. 5. Hold the individual student responsible for equipment damaged or broken due to the student's negligence. 5ILSCO JUNE 2023 III CLINICAL AFFILIATE RESPONSIBILITY The Clinical Affiliate is responsible for, and agrees to: 1. Permit the use of clinical facilities by students enrolled in the College's Department of Emergency Medical Services for the purpose of clinical education. 2. Maintain approval by the appropriate state and/or properly designated accrediting body, and inform the College of any changes in that approval. 3. Inform the College, and participate in joint planning, prior to accepting LSCO clinical students from any other institutions, or other College programs. 4. Provide, to the extent possible, conference rooms for student education, office space for faculty, and locker rooms or other secure space for faculty and students to store coats, books, etc., while on duty. 5. Allow students and faculty access to, and use of, facilities maintained by the Clinical Affiliate following their specific policies, fees or charges, such as Library and Cafeteria. 6. Provide initial emergency care in case of accidents including needle sticks to students or faculty participating in regularly scheduled clinical learning experiences. 7. Charge no fees for clinical learning experiences or use of facilities. 6I IV TERMS OF AGREEMENT: Only insofar as it is authorized by law to do so, the College agrees to hold the Clinical Affiliate harmless from and against any and all liability for personal injury, including injury resulting in death, or damage to property, or both, resulting directly or indirectly from the use by the College of the Clinical Affiliate. Nothing in this Affiliation Agreement is to be constructed as transferring financial responsibility from one party to another. The terms of this Agreement may be modified upon mutual consent of the parties. Plans to initiate termination of the Agreement may be instituted by either party with or without cause upon no less than 30 days written notice by mail. The plans for termination must include specific procedures to assure that there will be no adverse effect to the rights and privileges of students actually enrolled in the program, as long as they are making normal progress toward completion. The term of the agreement is five years, aae2023-June 2028. An annual review of the agreement will be completed by the College and discussed with the Affiliate liaison as part of the maintenance and planning process of the relationship.
