Williams, Director of Human Res. . ill RE: A Resolution Approving a Property Damage Settlement in the Amount of$6,515.00 for Damages to Transit Unit#1965) :Nature of the request: On April 25, 2023, the operator of transit unit #1965 (2012 Dodge 3500 Crew Cab) was traveling on Waco Avenue, made a turn and hit a fire hydrant. Staff Analysis, Considerations: The City has Auto Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP) with a $2,500 deductible. TMLIRP has offered the City a settlement of$6,515.00, less the $2,500 deductible, making the final settlement offer$4,015.00. Recommendation: I recommend approval of Proposed Resolution No. 23291 authorizing the auto property damage settlement against TMLIRP for damage sustained to Unit #1965 (2012 Dodge 3500 Crew Cab). TMLIRP has offered to settle the claim for $6,515.00, less the $2,500 deductible, making the final settlement offer $4,015.00. This is considered a fair and reasonable settlement. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $6,515.00 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF PROPERTY DAMAGE TO TRANSIT UNIT #1965 WHEREAS, on June 2, 2023, while the operator of transit unit #1965 was traveling in the 300 block of Waco Avenue, made a turn and hit a fire hydrant; and, WHEREAS, as a result of the damage, a claim was filed with the Texas Municipal League Intergovernmental Risk Pool (TMLIRP); and, WHEREAS, TMLIRP has offered to settle the claim for $6,515.00 less the Auto Physical Damage deductible amount of $2,500, making the final settlement $4,015.00, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That, the facts and opinion in the preamble of this Resolution are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $6,515.00, less the Auto Physical Damage deductible amount of $2,500, making the final settlement $4,015.00 for the claim against TMLIRP. Section 3. That a copy of this Resolution be spread upon the minutes of the City Council.
