REQUEST:
The Civic Center needs to replace HVAC Rooftop Units (RTU) #3 and#12. It is determined the
current units, which cool and heat Halls B and C, needs replacement. Industrial and Commercial
Mechanical (ICM) of Beaumont, TX can do this work for $113,236.00 out of account number
307-21-049-8512-00-10-000-.
ANALYSIS/CONSIDERATION:
The current HVAC RTU #3 and #12 need replacement. It will take about 22 weeks for the units
to be delivered, then installation will follow. Because of this, the total cost of this work will
come out of the Civic Center budget for Fiscal `23/'24. ICM of Beaumont, TX has provided a
price for this work under the Buyboard cooperative contract # 638-21 in the amount of
$113,236.00 out of account number 307-21-049-8512-00-10-000-.
RECOMMENDATION
A resolution authorizing the City Manager to enter into an agreement with Industrial and
Commercial Mechanical of Beaumont, TX to replace the current HVAC RTU#3 and#12 of the
Civic Center in the amount of$113,236.00. Funds available in account number 307-21-049-
8512-00-10-000-.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO AN AGREEMENT WITH INDUSTRIAL AND COMMERCIAL
MECHANICAL OF BEAUMONT, TEXAS THROUGH BUYBOARD
CONTRACT NO. 638-21 TO REPLACE THE CURRENT HVAC
ROOFTOP UNITS #3 AND #12 OF THE CIVIC CENTER IN THE
AMOUNT OF $113,236.00. FUNDS AVAILABLE IN ACCOUNT
NUMBER 307-21-049-8512-00-10-000-.
WHEREAS,the Civic Center is in need of new HVAC Rooftop Units#3 and #12 to
replace the current units for the cooling and heating of Halls B and C; and
WHEREAS, Industrial and Commercial Mechanical of Beaumont, TX can do this work
for$113,236.00; and
WHEREAS,Industrial and Commercial Mechanical of Beaumont, TX has a cooperative
contract with Buyboard 638-21; and,
WHEREAS, Chapter 271 of the Local Government Code allows a city, by resolution of
its governing body,to participate in cooperative purchasing programs, such as Buyboard, a
purchasing cooperative, as an alternative to a formal bid process; and
WHEREAS,per Resolution No. 02-341,the City entered into an interlocal agreement
for cooperative purchasing with the Buyboard Cooperative Purchasing Program("Buyboard");
now,therefore,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct.
THAT,the City Manager is hereby authorized to execute an agreement with Industrial
and Commercial Mechanical of Beaumont, Texas through BuyBoard Contract No. 638-21 to
replace the current HVAC Rooftop Units#3 and#12 at the Civic Center in the amount of
$113,236.00, in substantially the same form as attached hereto as Exhibit"A"; and.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
