Langford, Assistant City Manager— Operations/Director of Development Services Py RE: P.R. NO. 23062 — A resolution appointing/reappointing member(s) to the Historical Landmark Commission. Introduction: This agenda item intends to seek the City Council's approval of P.R. NO. 23062 appointing or reappointing member(s) to the Historical Landmark Commission, pursuant to Article XI, Section 14-351(c), of the City of Port Arthur Code of Ordinances. Each appointee shall serve for a term of two (2) years, with a new term expiration date of August 29, 2025. Background: On March 17, 2020, City Council approved Ordinance No. 20-26 amending Chapter 14, Article XI (Historical Landmark Commission), Sections 14-351 and 14-353, to comply with the Texas Certified Local Government (CLG) program guidelines. The CLG program requires that at least sixty percent (60%) of the commission membership shall be drawn from the preservation-related profession defined by the National Park Service. To keep in compliance with CLG program requirements, the ordinance was amended to include additional functions of the commission, as well as the following changes in the composition of the board: "...the Historical Landmark Commission of the City, which shall consist of seven (7) members and two (2) alternates, all of whom shall be resident "Remember, we are here to serve the Citizens of Port Arthur" P.O. Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 citizens and qualified votes of this City, with the exception of the licensed architect, in the event an architect cannot be located within the City...The Commission shall be composed of a least the following: • City Planning Commissioner • Licensed Architect • Licensed Attorney • Port Arthur Historical Society • Jefferson County Historical Society • Licensed Real Estate Agent • Owner of a Landmark or of a property in a historic district of the City All commission members, regardless of background, shall have a known and demonstrated interest, competence, or knowledge of the architectural, archaeological, cultural, social, economic, ethnic, and political history of the City of Port Arthur..." The city council shall appoint commission members for a term of two (2) years. No person who has served for six (6) consecutive years on the Commission shall be reappointed to the Commission unless two (2) years have elapsed. City Council is being requested to appoint or reappoint a member to the Historical Landmark Commission to fulfill the following composition requirements: City Council District! A RESOLUTION APPOINTING AND/OR REAPPOINTING MEMBER(S) TO THE HISTORICAL LANDMARK COMMISSION. WHEREAS, the Historical Landmark Commission was originally created by Ordinance No. 90-63; and, WHEREAS, per Ordinance No. 98-67, the City Council changed the composition of the board by removing the alternate positions and clearly delineating the manner of appointment as denoted in Article XI of Chapter 12 of the Code of Ordinances; and, WHEREAS, per Ordinance No. 14-15, the City Council amended Ordinance No. 98-67 as it pertained to its composition and the manner in which board members are appointed; and, WHEREAS, on March 17, 2020, City Council approved Ordinance No. 20-26, amending Chapter 14, Article XI, Sections 14-351 and 14-353, to comply with the revised Texas Historical Commission Certified Local Government (CLG) program guidelines; and, WHEREAS, the terms of office of the current members who were appointed by the Mayor and Councilmembers from District 1 , 2, 3, 4, Position 5 & 6, expired on August 1 , 2023, as delineated in Exhibit "A"; and, WHEREAS, pursuant to Article XI (Historical Landmark Commission), Section 14- 351(c) of the Code of Ordinance of the City of Port Arthur, the commission shall be composed of (1) One Member of the City Planning and Zoning Commission; (2) One Licensed Architect; (3) One Licensed Attorney; (4) One Member of the Port Arthur Historical Society; (5) One Member of Jefferson County Historical Society; (6) One P.R. NO. 23062 08/17/2023 PDL PAGE 2 OF 7 member shall be a licensed real estate agent; (7) One member shall be an owner of a landmark or of a property in a historic district of the City, and all members shall have knowledge and experience of the architectural, archaeological, cultural, social, economic, ethnic and political history of the city; and, WHEREAS, the Mayor and Councilmembers wish to appoint the following members to the Commission as delineated in Exhibit "B". NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby appoints the following members, as delineated in Exhibit "B," for a two (2) year term expiring on August 29, 2025. Section 3. That in accordance with Resolution No. 98-157, the appointee shall immediately contact the City Secretary to be sworn in, receive a copy of the Charter and documentation setting up the committee, commission, or board, and attend an orientation seminar from the City Attorney's Office. Section 4. That appointees, upon taking the required oath of office and doing all things necessary to qualify for such office, shall have all rights and powers provided by the Statutes and Ordinances pertaining thereto appertaining. Section 5. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
