RESOLUTION NO.
A RESOLUTION AUTHORIZING PROCEEDING WITH THE
DISANNEXATION OF 17.97 ACRE TRACT OF LAND ALONG
VITERBO ROAD AND WEST PORT ARTHUR ROAD AT THE
REQUEST OF THE LANDOWNER
WHEREAS, the City received official notice from landowner requesting to
disannex a 17.97 acre tract of land located within the corporate limits of Port Arthur,
Texas, as denoted in Exhibit "A" attached hereto; and
WHEREAS, the City may disannex land in accordance with the procedure
denoted in Section 43.142 of the Texas Local Government Code, and Article I, Section
6, of the City Charter; and
WHEREAS, it is deemed in the best interest of the citizens to authorize
proceeding with the disannexation of the property as described, as requested by
landowner.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council hereby authorize proceeding with the
disannexation of the property as set forth in Section 43.142 of the Texas Local
Government Code, and per Article I, Section 6, of the City Charter.
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.

In April of 2022 the city of Port Arthur de-annexed portions of property we own located in the far
north boundaries of the city due to the lack of adequate utilities and the cost to provide them.
We are under contract to purchase property that is contiguous and immediately to the south of
the de-annexed tracts. As we discussed we are requesting de-annexation of the 17ac.
contiguous tract. (see attached) I am also copying Judge Branick so we can keep Jefferson
county informed on the progress. We are under a contractual obligation to complete due
diligence in 45 days, please advise on any additional information we can provide. thanks for
