No. 7165 —Abandonment of a portion of the Terminal Road street right-of-way Introduction: This Agenda Item intends to seek approval from the City Council for P.O. NO. 7165, abandoning an approximate 2.042-acre portion of the following improved dedicated public right-of-way in Port Arthur, Jefferson County, Texas: • Portion of Terminal Road (bounded between Matthews Street (City Water Tower) and State Highway 82 [A.K.A. MLK]) Motiva Enterprises, LLC submitted a request to the city to abandon the referenced portion of the right-of-way for the following purpose: "In consensus with the City of Port Arthur, Motiva seeks to enhance our partnership and long-term commitment to the success of Port Arthur and its residents through the assumption of ownership, care, custody, and control of the remaining sections of Terminal Road as described. In partnership with the City of Port Arthur, Motiva will assume the street in its current state, alleviating the City from undertaking significant needed repairs. Public safety will be improved through the elimination of public traffic that has historically burdened City resources as a consequence of private citizen interfaces with the Motiva Refinery property. Additionally, acquisition of this roadway will enable Motiva to improve security hardening of its perimeter as Motiva continues to responsibly meet dynamic and evolving security challenges. The City's partnership in abandoning of Terminal Road to Motiva will also allow Motiva to secure more of its property in a contiguous manner, which directionally allows consideration for future growth opportunities that would be beneficial to the City of Port Arthur, surrounding communities, and Motiva." —Motiva Enterprises L.L.C. To Summarize, the request aims to enable Motiva to improve the security hardening of its perimeter as it continues to meet dynamic and evolving security challenges responsibly. This proposed abandonment will also allow Motiva to secure more of its property contiguously. Background: In November 2019, Planning Staff received an application from Motiva Enterprises, L.L.C., requesting the abandonment of the 2.042-acre portion of the public right-of-way. This section of Terminal Road is located south of West 17th Street and east of State Highway 82 [A.K.A. Dr. Martin Luther King, Jr. Drive]. As part of the abandonment process, the application was accompanied by signed and written consent of all utility entities and adjacent property owner(s), with Motiva Enterprises, L.L.C. being the registered owner of the adjoining properties. Utility entities include the City of Port Arthur Water/Sanitary Sewer, Public Works — Drainage, Charter/Spectrum Cable, Texas Gas Service, Entergy, AT&T — Texas, and Drainage District No. 7. An appraisal report was ordered from Cook & Associates, Inc. of Beaumont, Texas, on November 18, 2019, and an investigation and analysis of the property were performed on December 11, 2019. Based on fair and reasonable consideration, the fair market value of the portion of the public right-of-way is appraised at $80,100.00. The City's Planning and Zoning Commission held a public hearing on Monday, March 16, 2020. Public Notices were published in the Port Arthur Newspaper on March 7, 2020, and notices were sent to property owners within a 200 ft. radius of the proposed site. On March 17, 2020, City Council approved Resolution No. 20-083, calling for a public hearing to consider the proposed abandonment. However, further discussion with Council in Executive Session yielded a decision to request that Motiva Enterprises, L.L.C. withdraw its request for abandonment due to traffic and safety concerns posed by the Council. Moving forward, Representatives from Motiva Enterprises submitted a new application for the said abandonment on September 9, 2022, with the request remaining the same as previous. "Remember, we are here to serve the Citizens of Port Arthur" P.O. Public Notices were published in the Port Arthur Newspaper on September 9, 2022, and notices were sent to property owners within a 200 ft. radius of the proposed site on September 7, 2022. At this public hearing, there was no written or verbal opposition from the public. The Commission voted 3:0, recommending approval of this request. On September 27, 2022, City Council approved Resolution No. 22-440, calling a public hearing. Notification of this proposed abandonment was submitted to all utility entities servicing the City of Port Arthur for comment and acceptance. The Planning Staff did not receive any objections to this request. Based on the discussion with the City's Public Safety, Public Works, and Engineering Officials, there is no opposition to the request to abandon the said right-of-way. City Council conducted its public hearing on October 25, 2022, at 6:00 p.m., in City Council Chambers at a regularly scheduled meeting. Members of the public were invited to speak regarding the said request; Willie Bae Lewis asked for clarification on the precise section of Terminal Road being requested for abandonment and the future desire to construct berms at this location. Claire Jackson, Motiva Representative, informed Mr. Lewis that Motiva had no desire to develop the area and that it would be used strictly for parking and traffic control. There were no members of the public to oppose the said request. An updated appraisal was conducted by Cooks &Associates, Inc. of Beaumont, Texas, on October 10, 2022. Based on fair and reasonable consideration, the fair market value of the portion of public right-of-way appraised the same at $80,100.00. Upon approval of this proposed ordinance, Motiva will be required to establish utility and access easements requested by the City. Budget Impact: Motiva Enterprises, LLC, requestor, will provide the city with a payment of $80,100.00 to convey the 2.042-acre portion of the improved dedicated public right-of-way, known as a portion of Terminal Road. Recommendation: It is recommended that City Council approve P.O. NO. 7165, abandoning an approximate 2.042-acre portion of the following improved dedicated public right-of-way in Port Arthur, Jefferson County, Texas: • Portion of Terminal Road (bounded between Matthews Street (City Water Tower) and State Highway 82 [A.K.A. AN ORDINANCE OF THE CITY OF PORT ARTHUR, TEXAS, CLOSING, VACATING, ABANDONING, AND CONVEYING A 2.042-ACRE PORTION OF AN IMPROVED DEDICATED PUBLIC RIGHT-OF-WAY, KNOWN AS TERMINAL ROAD, PORT ARTHUR, JEFFERSON COUNTY, TEXAS; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED WITHOUT WARRANTY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; REPEALING ALL ORDINANCES TO THE EXTENT THEY ARE IN CONFLICT; PROVIDING FOR SEVERABILITY; AND DECLARING AN EFFECTIVE DATE. A22-02 (MOTIVA ENTERPRISES, LLC) WHEREAS, the City of Port Arthur desires to continue to protect and ensure the public health, safety, and welfare of its residents and businesses by effectively managing the City's real property interests that are held in trust for the public; and WHEREAS, Section 311.007 of the Texas Transportation Code authorizes home- rule cities to vacate, abandon, or close a street or alley; and WHEREAS, the City of Port Arthur has received a request from Motiva Enterprises, LLC (the "Requestor") that the City close, vacate, abandon and convey a 2.042-acre portion of an improved dedicated public right-of-way, known as Terminal Road, as more specifically described in Exhibit "A" (the "Property"), which is attached hereto and incorporated herein for all purposes; and WHEREAS, in accordance with Chapter 94, Article VI, Section 94-383(b)(1) of the Code of Ordinances, a recommendation for approval was received from the Planning and Zoning Commission; and WHEREAS, in accordance with Chapter 94, Article VI, Section 94-383(b)(2) of the Code of Ordinances, the City Council held a public hearing on October 25, 2022, at 6:00 P.O. NO.7165 08/17/2023 PDL PAGE 2 OF 13 p.m., after giving notice to all property owners within 200 feet and publishing notice in the official newspaper of the City; and WHEREAS the City, after vetting the request and confirming with all franchised public utility providers and appropriate City departments, has determined that the Property is no longer needed as public rights-of-way and that it is in the public interest to close, vacate, abandon, and convey the Property to the Requestor in accordance with Chapter 94, Article VI, Section 94-383 of the Code of Ordinances; and, WHEREAS, upon the abandoning and vacating of any street, alley, or easement, the City shall have the right, if it so desires, to retain a utility easement within the street, alley, or easement abandoned with an appropriate reduction in fair market value, as delineated in Chapter 94, Article VI, Section 94-384 of the Code of Ordinances; and WHEREAS, the City Council has determined that the proposed abandonment and vacation is for a public purpose and is in the public interest; and that all requirements of Chapter 94, Article VI, and all other applicable ordinances and laws have been satisfied. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That all of the Property described in Exhibit "A" is hereby closed, abandoned, and vacated as rights-of-way or passage by the City of Port Arthur, Texas, as the Property has been found to no longer be necessary for public purposes and it found to be in the public interest by the City of Port Arthur to close, vacate and abandon the same to the extent of the public right, title, and interest in and to the Property that the City may lawfully abandon. That the City possesses the Property and shall be conveyed to the abutting property owner Motiva Enterprises, LLC, in accordance with Section 272.001(b)(2) of the Texas Local Government Code, and that the City Manager of the City of Port Arthur, Texas is hereby authorized, empowered and directed to convey said Property to the Requestor, its successors, heirs, and assigns, by virtue of a Deed without Warranty in substantially the form provided as Exhibit "B", which is attached hereto and incorporated herein for all purposes. SECTION 4. That prior ordinances of the City dealing with or applicable to this Ordinance are hereby amended to the extent of any conflict herewith, and all ordinances or parts thereof conflicting or inconsistent with the provisions of this Ordinance as adopted and amended herein are hereby amended to the extent of such conflict. In the event of a conflict or inconsistency between this Ordinance and any other ordinance of the City, the terms and provisions of this Ordinance shall govern. SECTION 5. That, should any section or part of this Ordinance be held unconstitutional, illegal, or invalid, or the application to any person or circumstance thereof ineffective or inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, impair or invalidate the remaining portion or portions thereof; but as to such remaining portion or portions, the same shall be and remain in full force and effect, and to this end, the provisions of this Ordinance are declared to be severable. In the event that changes are made to Texas Local Government Code, Chapter 26, the provisions of state law will govern in the event of a conflict. P.O. NO.7165 08/17/2023 PDL PAGE 4 OF 13 SECTION 6.
