Background: The City of Port Arthur's Landfill is required, by permit from the Texas Commission on Environmental Quality(TCEQ),to maintain at least one working compactor on site at all times to ensure proper compaction and compliance with state regulations. During the compactor's motor rebuild, Mustang Cat of Beaumont, Texas, found debris and residue in the transmission and transmission filter, requiring the transmission rebuild. Non-removal of the debris and residue may render the compactor inoperable and potentially jeopardize the Landfill's permit. The Landfill recently purchased a new compactor, and the 826K compactor is and will remain a backup machine. Budget Impact: Funds are available in the Public Works Landfill's Equipment Maintenance Account Number 403-50- 320-5318-00-00-000. Recommendation: It is recommended that the City of Port Arthur's City Council approve PR Number 23314 authorizing the 826K compactor's transmission rebuild with Mustang Cat of Beaumont,Texas,for$90,412.11. A RESOLUTION AUTHORIZING THE LANDFILL'S 826K COMPACTOR'S TRANSMISSION REBUILD BY MUSTANG CAT OF BEAUMONT, TEXAS, THROUGH SOURCEWELL COOPERATIVE CONTRACT NO. 032119-CAT FOR THE NOT-TO-EXCEED AMOUNT OF $90,412.11. FUNDS ARE AVAILABLE IN THE PUBLIC WORKS LANDFILL'S EQUIPMENT MAINTENANCE ACCOUNT NUMBER 403-50-320-5318-00-00-000- WHEREAS, the Landfill is required, by permit from the Texas Commission on Environmental Quality (TCEQ), to employ at least one working compactor for operations and permit compliance; and, WHEREAS, during the compactor's motor rebuild, Mustang Cat of Beaumont, Texas, found debris and residue in the transmission and transmission filter, rendering the compactor inoperable and prompting the transmission repair; and, WHEREAS, the 826K compactor is a backup that is used for major daily operations, rendering the repairs necessary and immediate; and, WHEREAS, Mustang CAT of Beaumont, Texas, can repair the 826K compactor for the not-to-exceed cost of $90,412.11 through the Sourcewell Cooperative Purchasing Program as delineated in Exhibit A; and, WHEREAS, pursuant to Chapter 271.102 of the Texas Government Code, a city is allowed, by resolution of its governing body, to participate in cooperative purchasing programs such as the Sourcewell Cooperative Purchasing Program as alternative to a formal bid process; and, PR 23314 8/29/2023 jam Page 2 of 3 WHEREAS, pursuant to Resolution 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, funding is available in Public Works Landfill Equipment Maintenance Account 403-50-320-5318-00-00-000; and, THAT, the City Council of the City of Port Arthur hereby authorizes the 826K compactor's transmission rebuild by Mustang Cat of Beaumont, Texas, for the not-to- exceed amount of $90,412.11; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
