ORDINANCE NO.
AN ORDINANCE RECONSIDERING ORDINANCE NO. 23-38 AS IT
PERTAINS TO CLOSING, VACATING, ABANDONING, AND
CONVEYING A 2.042-ACRE PORTION OF AN IMPROVED DEDICATED
PUBLIC RIGHT-OF-WAY, KNOWN AS TERMINAL ROAD, PORT
ARTHUR, JEFFERSON COUNTY, TEXAS (REQUESTED BY
COUNCILMEMBER DOUCET)
A22-02 (MOTIVA ENTERPRISES, LLC)
WHEREAS, of August 29, 2023, Ordinance No. 23-38 was approved as to closing,
vacating, abandoning, and conveying a 2.042-acre portion of an improved dedicated
public right-of-way, known as Terminal Road, Port Arthur, Jefferson County, Texas; and
WHEREAS, in accordance with Section 3-31(g) of the Code of Ordinances,
Councilmember Doucet has requested that Ordinance No. 23-38 be brought back for
reconsideration; and
WHEREAS, the City of Port Arthur has received a request from Motiva Enterprises,
LLC (the "Requestor") that the City close, vacate, abandon, and convey a 2.042-acre
portion of an improved dedicated public right-of-way, known as Terminal Road, as more
specifically described in Exhibit "A" (the "Property"), which is attached hereto and
incorporated herein for all purposes; and
WHEREAS, the City Council deems it in the public interest to reconsider
Ordinance No. 23-38.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
SECTION 1. That the facts and opinions in the preamble are true and correct.
SECTION 2. That Ordinance No. 23-38 is hereby rescinded and the closing,
vacating, abandoning, and conveying a 2.042-acre portion of an improved dedicated

public right-of-way, known as Terminal Road, Port Arthur, Jefferson County, Texas, is
hereby rescinded.
SECTION 3. That this being an Ordinance amending an Ordinance which does
not carry a penalty and does not require publication, it shall take effect immediately from
and after its adoption.
SECTION 4. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.

BEING 2.042 acre of land, part of a dedicated public right-of-way in the City of Port Arthur, known
as Terminal Road, an extension of that public road shown on the plat of Port Arthur Heights,
recorded in Volume 2, Page 138, Map Records, Jefferson County, Texas; said 2.042 acre tract
being more fully described by metes and bounds as follows, to wit:
Note: Bearings, coordinates, distances and acreage are based on the Texas Coordinate System of
1983, South Central Zone, US Survey Feet, and are referenced to SmartNet, North America.
BEGINNING at a 5/8 inch steel rod, found on the intersection of the West right-of-way line of
Terminal Road and the Northeast right-of-way line of State Highway 82, also known as Dr. Martin
Luther King Drive, for the Southeast corner of a (Called 44.2161) acre tract of land, known as
Tract III, described in an Industrial District Agreement between Motiva Enterprises LLC and the
City of Port Arthur, recorded in File No. 2019036053, Official Public Records, Jefferson County,
Texas; said capped rod having coordinates of N: 13895478.97, E: 3566505.60;
THENCE, North 06 deg. 46 min. 57 sec. West (Called North 06 deg. 45 min. 55 sec. West), on the
West right-of-way line of Terminal Road and the East line of Tract III, a distance of 1498.06' to a
half-inch steel rod, capped and marked "SOUTEX", set for the Northwest corner of the herein
described tract;from which a concrete highway monument, found on the South right-of-way line
of West Gulfway Drive, also known as State Highway 87, for the Northeast corner of said Tract
III, bears North 06 deg. 46 min. 57 sec. West (Called North 06 deg. 45 min. 55 sec. West), a
distance of 698.82';
THENCE, North 83 deg. 13 min. 03 sec. East, a distance of 56.66' to a half-inch steel rod, capped
and marked "SOUTEX", set on the East right-of-way line of Terminal Road, same being the West
line of a (Called 53.5510) acre tract of land, known as Tract II, described in said Industrial District
Agreement between Motiva Enterprises LLC and the City of Port Arthur, for a southwesterly
corner of a (Called 2.543) acre tract of land described in a deed to the City of Port Arthur,
recorded in File No. 2016003795, Official Public Records, Jefferson County, Texas, and the
Northeast corner of the herein described tract; from which a half-inch steel rod, capped and

marked "AWC",found on the Southeast right-of-way line of West 15th Street,for a northwesterly
corner of the (Called 2.543) acre tract, bears North 06 deg. 54 min. 12 sec. West (Called North 06
deg. 51 min. 53 sec. West), a distance of 231.58':
THENCE, South 06 deg. 54 min. 12 sec. East (Called South 06 deg. 51 min. 53 sec. East), on the
East right-of-way line of Terminal Road and the West line of said Tract II, a distance of 1554.17'
to a bent half-inch steel rod, found on the Northeast right-of-way line of said State Highway 82,
for a southwesterly corner of said Tract II, and the Southeast corner of the herein described tract;
THENCE, North 53 deg. 40 min. 43 sec. West, on the Northeast right-of-way line of State Highway
82, a distance of 82.10' to the POINT OF BEGINNING, containing 2.042 acres of land, more or
less.
This description is based on the Land Survey made under the direct supervision of Randall Alvey
Creel, Registered Professional Land Surveyor No. 6678 on November 1, 2019.
