Background: The Public Works —Engineering Unit #2393 was damaged as it was parked on the side of the street during an inspection. A contractor driving a dump truck, pulling a trailer sideswiped the parked unit. The operator's actions will constitute her accident being reviewed by the Accident Review Board (ARB). She is subject to points on her driving record with the City of Port Arthur. Points range from one (1) point to twelve (12) points depending on the severity of the accident. If, and once, an employee reaches twelve (12) points, they are subject to termination from the City. The review board meets every third Thursday of each month. Amerisure Mutual Insurance Company evaluated the damage offering an estimate for repairs in the amount of $6,621.51. If additional damage is discovered, the insurance company will be notified of such. Budgetary/Fiscal Effect: The funds will be deposited into the City's General Fund, HINGF. Staffing/Employee Effect: None Summary: It is recommended the City Council of the City of Port Arthur adopt Proposed Resolution No. 23331 which authorizes the City Manager to accept the settlement in the amount of $6,621.51 from Amerisure Mutual Insurance Company for damages to Police Unit#2478. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $6,621.51 MADE AGAINST AMERISURE MUTUAL INSURANCE COMPANY AS A RESULT OF PROPERTY DAMAGE TO PUBLIC WORKS UNIT #2393 WHEREAS, on July 10, 2023, Public Works Unit#2393 (2021 Ford F 150) was damaged as it was sideswiped by a contractor when parked on the street during an inspection; and, WHEREAS, as a result of the damages, a claim was filed with Amerisure Mutual Insurance Company, and, WHEREAS, Amerisure Mutual Insurance Company has offered to settle the claim for $6,621.51 which is considered a fair and reasonable settlement. If additional damage is discovered, the insurance company will be notified. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount $6,621.51, for the claim against Amerisure Mutual Insurance Company in substantially the same form as delineated in Exhibit"A". Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
