Background: On November 16, 2022, sewage pump number four (4) was damaged by a large piece of wood which was sucked into the pump from the wet well. The damage caused an overflow from the pump, filling the lift station dry well. The overflowing of the sewage damaged critical components of the lift station including the submerging of the electrical motors, lights, valves, and accessories. Texas Municipal league Intergovernmental Risk Pool senior claims specialist evaluated the damage on April 27, 2023, offering an estimate for restoration, service and remodeling in the amount of $382,729.86, less the property damage deductible of$5,000.00, making final payment$377,729.86. Budgetary/Fiscal Effect: The funds will be deposited into the City's Water Fund Account, HINWS. Staffing/Employee Effect: None Summary: It is recommended the City Council of the City of Port Arthur adopt Proposed Resolution No. 23313 which authorizes the City Manager to accept the settlement in the amount of$382,729.86, less the property damage deductible of$5,000.00, from Texas Municipal League Intergovernmental Risk Pool for damages to the Wastewater Treatment Plant Lift Station(2901 W Hwy 365). A RESOLUTION AMENDING RESOLUTION NO. 23-288 AS IT PERTAINS TO THE ACCEPTANCE OF A TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) FOR DAMAGES SUSTAINED TO WASTEWATER TREATMENT LIFT STATION DUE TO FLOODING (2901 W HWY 365) WHEREAS, on November 16, 2022, sewer pump number four (4) was damaged by a piece of wood that was sucked into the wet well; and, WHEREAS, the damaged caused overflow from the pump and filled the lift station dry well causing damaged to critical components, submerging the electrical motors, lights, valves and accessories; and, WHEREAS, as a result of the damages, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TMLIRP); and, WHEREAS, TMLIRP has offered to settle the claim for $382,729.86, less the property damage deductible amount of$5,000.00, making the final settlement offer $377.729.86, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount $382,729.86, less the property damage deductible amount of $5,000.00, making the final settlement offer$377,729.86, for the claim against TMLIRP in substantially the same form as delineated in Exhibit"A". Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
