Nature of the Request: The City of Port Arthur Health Department has utilized the Texas Artists Museum as a COVID vaccination site since April 2021. The Texas Artists Museum has agreed to allow the use of the building for COVID vaccinations until the health department's relocation at the end of the year. Staff Analysis, Considerations: N/A Recommendations: It is recommended that the City Council approve P.R. No. 23348, the resolution approving the MOU between the City of Port Arthur and the Texas Artists Museum. Budget Considerations: The cost not to exceed $2000.00 for the period October 1, 2023, through January 31, 2024. Funds available in account number COV 102 105-13-033-5470-40- 000. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PORT ARTHUR AND THE TEXAS ARTISTS MUSEUM SOCIETY FOR THE USE OF THE TEXAS ARTISTS MUSEUM SOCIETY (TAMS)BUILDING AS THE CITY OF PORT ARTHUR COVID-19 VACCINATION SITE FROM OCTOBER 01, 2023 THROUGH JANUARY 31, 2024 WITH A COST NOT TO EXCEED $2000 . 00; FUNDING AVAILABLE IN ACCOUNT NUMBER COV 102 105-13-033-5470-00-40-000 WHEREAS, the City of Port Arthur Health Department will continue to administer COVID-19 vaccinations to the public from October 1, 2023 through January 31, 2024; and WHEREAS, the City and the Texas Artists Museum Society entered into a Memorandum of Understanding via Resolution No. 22-490, October 25, 2022, which expires September 30, 2023; and WHEREAS, it is in the best interest of the citizens of Port Arthur for the City to enter into an additional Memorandum of Understanding between the City and the Texas Artists Museum Society, to continue to provide an accessible location for citizens to receive COVID-19 vaccinations; and, WHEREAS, the City of Port Arthur and The Texas Artists Museum Society have agreed to the terms of utilizing the TAMS Building as the City Of Port Arthur Covid-19 Vaccination Site according to Exhibit "A"; and WHEREAS, the City of Port Arthur will pay $500 . 00 per month to The Texas Artists Museum Society to compensate for the loss of revenue during the use of the TAMS Building for public COVID-19 vaccinations . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct . Section 2. That the City Manager is herein authorized to execute on behalf of the City the Memorandum of Understanding For Utilizing The TAMS Building as the City Of Port Arthur Covid-19 Vaccination Site between the City of Port Arthur and the Texas Artists Museum Society in substantially the same form as attached hereto as Exhibit "A" . Section 3. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council. Tizeno, CityAe Y APPROVED FOR ADMINISTRATION: Ronald Burton, City Manager APPROVED AS TO AVAILABILITY OF FUNDS: Kandy Daniel, Finance Director APPROVED: adi Ju•Qth Smith, BSN, RN, Director of Health EXHIBIT "A" MEMORANDUM of UNDERSTANDING BETWEEN The City of Port Arthur and Texas Artists Museum Society CITY OF PORT ARTHUR COVID-19 VACCINATION SITE The City of Port Arthur and the Texas Artists Museum Society (TAMS) agree to use the TAMS Building as the City of Port Arthur Health Department COVID-19 Vaccination Site from October 1, 2023,through January 31, 2024, according to the terms below: 1. The City of Port Arthur Health Department will use the TAMS Building to provide public COVID-19 vaccinations from October 1, 2023, through January 31, 2024, Monday through Friday from 8am-5pm. 2. The City of Port Arthur will provide janitorial services and pay all utilities for the building. 3. TAMS may continue to use the facility on weekends by providing 15-day notice to the City of Port Arthur to enable city staff to reconfigure the site. 4. The City of Port Arthur will pay $500.00 per month during the time the TAMS Building is used as a COVID-19 Vaccination Site as compensation for the loss of revenue to the Texas Artists Museum Society. 5. Upon the expiration of this term on January 31,2024, both parties agree to transition to a monthly basis of collaboration. The terms and conditions previously outlined shall remain in effect during the monthly extension. In the event the site is no longer required by the City of Port Arthur Health Department as a COVID- 19 Vaccination Site, this addendum may be terminated by the City of Port Arthur by providing a 2-week written notice to the Texas Artists Museum Society.
