Roberts,EIT MEng, MBA, Public Works Director 1/ RE: P.R.23182—Gates Building Asbestos Remediation and Demolition Change Order No. 1 —Removal and Disposal of Unforeseen Building Materials Introduction: This agenda item requests the City Council's approval of Change Order Number 1 for additional fees associated with the removal and disposal of unforeseen materials during demolition, abatement, and cleaning of the Gates Building. Background: Resolution 23-307 authorized the execution of a contract with Sitek Omni Services, LLC (Sitek Omni) of Spring, Texas, for the demolition, abatement, and microbial cleaning of the Gates Building. Sitek Omni and the Public Works Department performed a site visit where materials beyond those listed in the contract were found. The materials,consisting of styrofoam insulation panels and sheetrock demising and associated ductwork, showed signs of mold and termite invasion. Therefore, additional funds are needed to remediate the additional findings. Budget Impact: The budgetary impact for the additional work is $20,800.00, and will be funded by the Capital Improvement Fund—City Facility Improvements Account, 307-21-049-8512-00-10-000. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND SITEK OMNI SERVICES, LLC OF SPRING, TEXAS, FOR THE REMOVAL AND DISPOSAL OF UNFORESEEN BUILDING MATERIALS DURING DEMOLITION,ABATEMENT,AND CLEANING OF THE GATES BUILDING WITH A BUDGETARY IMPACT OF $20,800.00.FUNDING IS AVAILABLE IN ACCOUNT NO.307- 21-049-8512-00-10-000 (CAPITAL IMPROVEMENT FUND — CITY FACILITIES IMPROVEMENTS), PROJECT NO. BU0016-CON WHEREAS, Resolution 23-307 authorized the execution of a contract with Sitek Omni Services, LLC of Spring, Texas, through the Region 5 ESC Southeast Texas Cooperative Purchasing Organization to demolish, abate, and clean the Gates Professional Building for the amount of$148,800.00; and, WHEREAS, Sitek Omni has submitted Change Order Number One(1), attached hereto as Exhibit A, requesting additional funds for the removal and disposal of unforeseen building materials encountered during base scope work, which consists of styrofoam insulation panels, sheetrock demising, and ductwork behind the sheetrock demising wall; and, WHEREAS, the budgetary impact for the additional work is $20,800.00, and will be funded by the Capital Improvement Funds—City Facility Improvements Account. Services) Sitek Contract Number for Region 5 ESC: 20230403 (Emergency Response) Flozelle, Sitek Omni Services, LLC (Sitek) submits following proposal, consisting of the selective demolition and associated microbial cleaning of various interior materials encountered beyond those identified in the original bid for work at the former medical building located at 3617 Gates Boulevard in Port Arthur, Texas. 1. SCOPE OF WORK Sitek responsible for: A. Provide generators for electrical power needs and water as needed for work added scope work. B. Provide a Conex box on-site for storage of tools and equipment. C. Selectively remove and dispose of the following building materials encountered during base scope of work: ➢ Styrofoam Insulation Panels with Mold Contamination (panels coating interior of perimeter concrete walls — metal bracketing to be cleaned for mold and remain in-place); ➢ Sheetrock Demising Wall at Main Entry; ➢ Ductwork Behind Sheetrock Demising Wall at Main Entry (over exterior entry canopy). D. Systematically remove demolition debris from the work areas to avoid excessive accumulation of debris on the floor. Load out will be via push-carts, dollies and by hand (as necessary). Leave all work areas in "broom-clean"clean condition, free of any loose debris. City of Port Arthur responsible for: A. Provide access to the work areas and parking for Sitek personnel and parking for Sitek Omni-supplied truck and waste dumpsters. B. Provide the services of an independent third-party Industrial Hygiene firm (Honesty) for the purpose of providing final visual inspections. C. Replacement of materials removed by Sitek during the selective demolition work. IT. PROCEDURES Sitek Omni Services, LLC is a certified asbestos abatement (TDSHS License #80- 1070) and demolition contractor in Texas. All local, state and federal EPA and OSHA codes regarding selective demolition shall be strictly implemented. Prior to commencement of work, the owner and contractor are to mutually agree upon project logistics, phasing and scheduling. III. DISPOSAL All asbestos containing materials will be handled, transported and disposed of as per federal, state and local regulations to an EPA approved landfill. All demolition debris generated will be removed from the site disposed of as trash at a licensed landfill. IV. SCHEDULING Sitek proposes completion of the listed scopes of work within approximately eight (8)working shifts, working Monday through Thursday up to 10 hours per shift(7am —5pm). V. PRICING Lump sum price per listed additive demolition scope of work: S 20,800.00 The pricing provided is valid for 60 calendar days from the date of this proposal. The pricing listed does not include any sales tax applicable to this scope of work. VI. INSURANCE Sitek carries occurrence-type General Liability coverage totaling $3 million per occurrence and $3 million general aggregate with an additional $10 million umbrella. Sitek also carries a $2 million Pollution Liability policy. Sitek's program also includes Auto Liability, Employer's Liability and statutory limits for Worker's Compensation. Liability and workers compensation policies are provided through Starr Indemnity & Liability Company and Federal Insurance Company and are AM Best Rated A+, XIV.
