Alexander, MBA-HCM, Health Director DATE: September 14, 2009 SUBJECT: Proposed Resolution No. 15485 Approval of Contract and Reappointment of Dr. William D. George as the Health Authority for the City of Port Arthur RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No: 15485, approving an Independent Professional Services Agreement and re-appointing Dr. William D. George as the Health Authority for the City of Port Arthur for a period of two (2) years. BACKGROUND: Since 1995, Dr. George has been the Health Authority for the City of Port Arthur. In accordance with Sections 121.021-121.029 of the Texas Health and Safety Code, a City, County, or Health District may appoint a licensed physician to serve as Local Health Authority to advise City Officials about public health issues and serves as a consultant on issues which impact public health in its jurisdiction. The term of office is two (2) years and may be renewed by recertification or a different Local Health Authority may be appointed for each term thereafter. The City of Port Arthur wishes to renew the independent professional services agreement and maintain Dr. George as its Health Authority. STAFFING/EMPLOYEE EFFECT: None. BUDGETARY EFFECT: Dr. George's current contract is $39,600 annually which includes $34,100 paid by the health department and $5,500 by the Fire Department. SUMMARY: It is recommended that the City Council approve Proposed Resolution No. 15485, approving an Independent Professional Services Agreement and re-appointing Dr. William D. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES BETWEEN THE CITY OF PORT ARTHUR AND WILLIAM D GEORGE, MD AND RE-APPOINTMENT AS THE CITY'S HEALTH AUTHORITY FOR THE HEALTH AND FIRE DEPARTMENTS PURSUANT TO SECTION 121.023 OF THE TEXAS HEALTH AND SAFETY CODE WHEREAS, Dr. William D. George has been acting as the Health Authority for the City of Port Arthur since August 1, 1995; and, WHEREAS, Dr. George has agreed to renew the contract with the City of Port Arthur to remain as the Health Authority for the Health and Fire Departments; and, WHEREAS, the City Council desires to reappoint Dr. William D. George as the Health Authority for a period of two (2) years as provided by Section 121.023 of the Texas Health and Safety Code; and, WHEREAS, the city will compensate Dr. George at $3,300 per month; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: SECTION 1. That, the facts and preamble are true and correct. SECTION 2. That, the City Council of the City of Port Arthur hereby authorizes the City Manager and Director of Health to execute said Agreement, a copy of which is attached hereto as Exhibit "A." SECTION 3. That the City Manager is herein authorized to sign the attached Certificate of Appointment attached hereto as Exhibit "B". SECTION 4. Deborah Echols, CPA, Finance Director EXHIBIT "A" .AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES This Agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City" and William D. George, M.D., a person licensed to perform the duties of Health Authority, herein referred to as "Contractor." I. TERM OF AGREEMENT This renewal Agreement shall be for a period beginning October 1, 2009, and shall remain in force through September 30, 2011. Thereafter, this Agreement shall be renewed annually at the discretion of the parties. II. PROFESSIONAL SERVICES As the Health Authority, the Contractor shall: 1) Administer state and local laws relating to public health within the City's jurisdiction in accordance with Section 121.021 Texas Health and Safety Code, as amended. 2) Do all things necessary to implement and enforce the law to protect the public health. 3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas Department of State Health Services (DSHS). 4) Establish, maintain, and enforce quarantine in the City's jurisdiction. 5) Aid the Texas Board of Health and other public health officials in relation to local quarantine, inspection, disease prevention and suppression, birth and death statistics, and general sanitation in the City's jurisdiction. 6) Report as necessary the presence of contagious, infectious and dangerous epidemic diseases to the Texas Board of Health in the manner and at the times prescribed by said board. 7) Perform all acts for the Port Arthur City Health Department which are required by law to be performed by a licensed physician or which if provided by a person other than a licensed physician would constitute the unlicensed or unlawful practice of medicine. 8) Provide consultant services in policy, planning, procedure, administrative and other matters to the Director of the Health Department as requested by said Director. 9) Provide Medical Director advisory services to the City's Fire Department First Responders Program registered with the Department of State Health Services. 10) Meet with the City's Fire Department representatives on a monthly basis to review emergency medical incidents, exposures and debriefings, establish and review medical protocols, review and make recommendations concerning DSHS certifications and continuing education. 11) Provide professional assistance to the City's Fire Department in administrative matters before boards, DSHS, and the City Council on an as needed basis. III. COMPENSATION The Contractor shall be paid Three Thousand, three hundred Dollars ($3,300.00) per month for professional services performed as the Health Authority. The hours of work shall be mutually agreed upon by the Director of Health of the City of Port Arthur and the City's Fire Chief. IV. LICENSURE/LIABILITY INSURANCE 1) The Contractor shall provide proof of licensure to practice medicine in the State of Texas. 2) The Contractor shall be covered under the City's liability insurance for services performed as the Health Authority.
