AN ORDINANCE ADDING SECTION 2-53 TO CHAPTER 2 (ADMINISTRATION), ARTICLE II (CITY COUNCIL), DIVISION 2 (MEETINGS) TO THE CODE OF ORDINANCES AS IT PERTAINS TO WORKING MEETINGS (REQUESTED BY COUNCILMEMBER FRANK) WHEREAS, it has been requested that the City Council add Section 2-53 to Code of Ordinances of the City of Port Arthur as it pertains to providing a procedure to authorize expenditures for the provision of food and beverages during working meetings of the City; and WHEREAS, it is deemed in the best interest of the City to amend Section 2-53 as delineated in Exhibit "A". NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Chapter 2, Article II, Division 2 of the Code of Ordinances is amended by adding a new Section 2-53, as delineated in Exhibit "A" attached hereto. Section 3. That all ordinances or parts thereof in conflict herewith are repealed to the extent of such conflict only. Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. Section 5. That the ordinance shall be effective immediately. READ, ADOPTED AND APPROVED on this day of A.D., 2023, at a Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor: Councilmembers: NOES: Thurman Bill Bartle, Mayor ATTEST: Sherri Bellard, City Secretary APPROVED AS TO FORM: Val Tizeno, City Attorney APPROVED FOR ADMINISTRATION: Ronald Burton, City Manager Exhibit"A" "Section 2-53 — Working Meetings — The following will be provided during working meetings, which includes Regular City Council meetings, Special City Council meetings and Workshops: 1. The following is a list of situations where the reasonable cost of food and beverage items are allowable expenses. The purchasing employee or department must have sufficient budget authority to fund the expense. Purchases are to be processed for approval according to City policy, work rules, or practices: • Working lunches where staff are expected to attend and the meeting is scheduled during a meal period. • Working meals attended by the City Manager and elected officials or executives from other state and local agencies and jurisdictions. • Meals or refreshments provided at City Council meetings, City Council study session meetings, City Council retreats and other meetings for elected officials and/or staff members and other required to attend such meetings that span meal times. • Meals provided during recruitment of key City positions and for interview panels. 4 • Meals provided at staff appreciation and recognition events. • Refreshments for ceremonies, receptions and special events sponsored by the City. • Meals or refreshments provided for working lunch or dinner meetings of commissions, committees, and task forces. 4 • Light refreshments at meetings such as training sessions, committee and commission meetings, regional meetings and staff meetings. • Meals or refreshments provided for City employees and other responding to emergency situations (e.g. weather-related event or other event requiring use of emergency coordination center), • Alcoholic beverages are prohibited at City functions and are not allowed as reimbursable expense.
