RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 15486, authorizing
the release of the final retainage in the amount of $149,554.40 for the contract with
The Trevino Group (Trevino), and authorizing the City Manager to sign the Certificate of
Substantial Completion for construction of Fire Station #6.
BACKGROUND:
A design-build contract was awarded to Trevino for the construction of the new Fire
Station #6 on 29 July 2009. Trevino completed the project satisfactorily, and has
submitted a "Certificate of Substantial Completion" and a request for payment for the
remaining 10% retainage in the amount of $149,554.40.
BUDGETARY/FISCAL EFFECT:
Funds are available in Project GO-804, 301-1601-591.82-00.
EMPLOYEE/STAFF EFFECT:
None
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 15486, authorizing

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
THE CERTIFICATE OF SUBSTANTIAL COMPLETION AND RELEASE
THE RETAINAGE IN THE AMOUNT OF $149,554.40 FOR THE
CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND THE
TREVINO GROUP OF HOUSTON, TEXAS FOR CONSTRUCTION OF
THE NEW FIRE STATION #6 AT 4448 9T" AVENUE. FUNDING
BEING AVAILABLE IN ACCOUNT NO. Project GO-804, 301-1601-
591.82-00.
WHEREAS, the design-build contract for the construction of the new Fire
Station #6, 4448 9"' Avenue, was awarded to The Trevino Group of Houston, Texas
(AEQ) on 29 July 2008; and,
WHEREAS, Trevino has completed the construction satisfactorily; and,
WHEREAS, Trevino has submitted a "Certificate of Substantial Completion"
{attached as Exhibit "A'~ and all other necessary documentation for this project; and,
WHEREAS, Trevino has submitted a request for payment for the 10% retainage
in the amount of $149,554.40; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, The Trevino Group has completed its contrail satisfactorily, and
the City Manager is authorized to execute the "Certificate of Substantial Completion"
(attached as Exhibit "A'~ and release the retainage in the amount of $149,554.40; and,

THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.
