No. 15490 Date: September 18, 2009 RECOMMENDATION: It is recommended that the City Council approve P.R. No. 15490. This resolution will authorize the use/disposition of equipment obtained via the Port Arthur Weed and Seed Initiative. This Resolution authorizes the equipment to be utilized by the following non- profit organizations: Seventh Street Baptist Church, Stephen Jackson Academy, Trinity Lutheran Church, Jr. Bee's Football Team, and the Golden Triangle Minority Business Council. These nonprofits will carry out the public purpose of sustaining the programs and services that were developed via the Port Arthur Weed and Seed Initiative. BACKGROUND: The City of Port Arthur received Official Recognition as a Weed and Seed site in 2002. The City serves as fiscal agent of federal grant funds received for the support of Port Arthur's Weed and Seed Initiative. To date, the City has been awarded a total of $350,000 from the United States Department of Justice for Port Arthur Weed and Seed. Utilizing grant funds, the City has purchased equipment for use in implementing Port Arthur Weed and Seed programs and activities. The Port Arthur Weed and Seed steering committee desires to dispose of the equipment to the listed non- profit agencies. The equipment will be used for the continuation of efforts developed by the Port Arthur Weed and Seed Initiative to improve the quality of life among Port Arthur residents. Each entity will sign a letter of commitment indicating that it will utilize the equipment for the public benefit. BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT None SUMMARY It is recommended that the City Council approve P.R. No. 15490 authorizing the disposition of property to Seventh Street Baptist Church, Eastern Star Baptist Church, Stephen Jackson Academy, Trinity Lutheran Church, Jr. Bee's Football Team, and the Golden Triangle Minority Business Council, for the public purpose of sustaining Weed and Seed neighborhood programs and services. P.R. No. 15490 RESOLUTION NO. A RESOLUTION AS IT PERTAINS TO THE DISPOSITION OF EQUIPMENT OBTAINED VIA THE PORT ARTHUR WEED AND SEED INITIATIVE. WHEREAS, the City of Port Arthur received official recognition as a Weed and Seed site in 2002; and WHEREAS, the City serves as fiscal agent of federal grant funds received for the support of the Port Arthur Weed and Seed Initiative; and WHEREAS, a variety of equipment was purchased for the implementation of Port Arthur Weed and Seed programs and activities; and WHEREAS, the existing gant is nearing completion and the U.S. Department of Justice has provided guidance on the disposition of equipment as delineated in Exhibit "A"; and WHEREAS, the steering committee of the Port Arthur Weed and Initiative desires to dispose of equipment for the public purpose of sustaining the efforts developed by Port Arthur Weed and Seed, such as a Safe Haven, computer training center, arts and crafts, and youth sports camp activities; and WHEREAS, the Port Arthur Weed Seed's steering committee has determined that the equipment can be disposed of by distribution to the following non-profit organizations and/or sub-recipients: Seventh Street Baptist Church, Stephen Jackson Academy, Trinity Lutheran Church, Jr. Bee's Football, and the Golden Triangle Minority Business Council, as delineated in Exhibit "B". Use. A State shall use equipment acquired under an award in accordance with State laws and procedures. The awarding agency encourages the States to follow the procedures set forth in this Guide. O[her recipients and subrecipients shall use equipment in accordance with the following requirements: 2. Equipment must be used by the recipient or subrecipient in the program or project for which it was acquired as long as needed, whether or not the projector program continues to be supported by Federal funds. When no longer needed for the original program or project, the equipment may be used in other activities currently or previously supported by a Federal agency. 3. The recipient or subrecipient shall also make equipment available for use on other projects or programs currently or previously supported by the Federal Government, provided such use does not interfere with the work on the projects or programs for which it was originally acquired. First preference for other use shall be given to other programs or projects supported by the awarding agency. User fees should be considered and treated as program income to the project, if appropriate. 4. Notwithstanding program income, the recipient or subrecipient shall not use equipment acquired with funds to provide services for a fee to compete unfairly with private companies that provide equivalent services, unless specifically permitted, or contemplated by Federal statute. 5. When acquiring replacement equipment, recipients or subrecipients may use the equipment to be replaced as a trade-in or may sell the equipment and use the proceeds to offset the cost of the replacement equipment, subject to the written approval of the awarding agency. With the grant having ended, if Port Arthur intends to dispose of the equipment it would need to adhere to the following: 1. Disposition. 2. In cases where a recipient or subrecipient fails to take appropriate disposition actions, the awarding agency may direct the recipient or subrecipient to take other disposition actions.
