Mr. Ramirez stated for "point of clarity" that the report regarding Z09-03 (PD-26) read that the zoning will be
changed from "SF" single-family to "PD-NS" Planned Development. He stated that that information is unknown
until after the Planning & Zoning Commissions recommendation for approval by City Council.
Mr. Burton requested that the report regarding Z09-03 (PD-26) be amended to read "If recommended by the
Planning and Zoning Commission and approved by City Council, the zoning will be changed from "SF" Single-
Family to "PD-NS" Planned Development -Neighborhood Services.

V. R09-22 AND R09-23
Mr. Burton stated that the Planning Staff recommends approval of both replat cases.
Fernando Ramirez moved to accept staff recommendation of approval of R09-22 and R09-23; Alma LeBlanc
seconded the motion.

VI. Z09-03 PD-26j
Mr. Burton stated that the Planning Staff recommends approval of Z09-23 (PD-26), however the Fire Department
and Building Inspections will require that proper fire equipment is installed prior to an occupancy permit being
issued. Public Facilities and existing utilities shall match occupancy capacity for compliance operations; off-street
parking shall be sufficient to all activities.
Mr. Ramirez stated concerns regarding the property being labeled as a "bed and breakfast" instead of commercial.
The commission is requesting specific information regarding the land use for the facility.
Fernando Ramirez moved to table staff recommendation of approval of Z09-03 (PD-26); Alma LeBlanc seconded
the motion.

VII. MINUTES -July 20, 2009
Mr. Ramirez made a motion to correct minutes from July 20, 2009 regarding case R09-20, where Ms. LeBlanc
abstained from voting; Ms. LeBlanc seconded the motion.

Mr. Ramirez asked if there have been any new developments with the West Side Development; Mr. Burton
informed the commission that there has not been any new information submitted to Planning.

investment partner and enough qualified people before he begins construction "to ensure that it's not only a
feasible plan, but a reasonable plan."

Ms. Russell informed the commission that the original preliminary plat request was approved by P& Z in October,
2008 and that the developer is requesting more time to complete the infrastructure of Phase I -Angel
Trace and to meet all the requirements of the City and the City Code.
Mr. Cox asked "what is the difference between the public hearing that was just held and this one requiring a
Bond?"
Ms. Russell responded, "His infrastructure is not complete. The other gentleman has not begun construction yet.
He has the funds for infrastructure. He isn't asking for any additional time for that. He is only requesting an
extension of time to start developing. This developer would need to bond just in case the infrastructure is not
completed. The funds will be available for the City to complete."

Ms. Russell reminded the commission of the information requested by Chairman Cox and Commissioner Ramirez
on August 3~d specifying what number of people will be allowed to attend events and about the circulation of
traffic entering the neighborhood and the property. Ms. Bellard limited the number of guests attending special
events on the property to 100, and not more than 40 guests to attend daily luncheons from 11-2 p.m. and dinner
from 5-8 p.m., including individuals staying in the guest house, limited to six guests. Building inspections stated
that 133 people could be accommodated in the dining area and the guest rooms, which would require 144 off
street parking places.
Mr. Ramirez stated that the commission would like to be presented with plans on how the establishment will look,
how parking will be arranged, fencing, and any other pertinent details regarding the property.
Ms. Moore requested a floor plan.
Ms. Bellard stated to the commission that she would be willing to supply all information required, however she
needs confirmation from the commission of what is specifically expected from her, so "everyone can be on the
same page."
Mr. Ramirez requested a site plan from Anthony Leger of Soutex Surveyors, Inc.
Mr. Ramirez moved to close public hearing; Ms. Moore seconded the motion.

Ms. Russell stated that the minutes were not included in the case packets that were submitted to the P& Z
Commissioners prior to the public hearing/regular meeting scheduled for Monday, August 17, 2009.
Mr. Ramirez made a motion to review the minutes for August 3, 2009 for the next meeting; Inell Moore seconded
the motion.

X. REPORT FROM DIRECTOR
Ms. Russell informed the commissioners that future P&Z packets will be delivered by mail or in person, instead of
electronically.
Mr. Cox informed Ms. Russell that the commissioners are willing to postpone any meetings to ensure accuracy of
information being presented to the commission for review and approval.

BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request to
create a 0.517 acre tract consisting of Lots 4 - 6, Block 13, Range 4, to produce one
tract to become Tract 4-A, Block 13, Range 4, of the Townsite of Sabine Pass,
Jefferson County, Texas. The property is located south of State Highway 87 (a.k.a.
Gulfway Drive) and west of 12t"Avenue. The zoning is "MF"for multi family or duplex

The Texas Point National Wildlife Refuge is seeking approval for construction of a
100-foot-tall free standing radio communication tower (FAA approved) and
associated buildings. The proposed site is about 5 acres of the 61.50 acre tract
called Tract 178, John McGaffey Survey, Abstract 167, Sabine Pass, Texas. The
property is located south of Highway 87 (A.K.A. S. Gulfway Drive) and approximately
two-miles west of a 4-way stop. The property is owned by the United States
Government. This office site will include a 3600 square foot office building (7 offices
for up to 9 people) and radio tower with maintenance facility.
