He stated that that information is unknown until after the Planning & Zoning Commissions recommendation for approval by City Council. Mr. Burton requested that the report regarding Z09-03 (PD-26) be amended to read "If recommended by the Planning and Zoning Commission and approved by City Council, the zoning will be changed from "SF" Single- Family to "PD-NS" Planned Development -Neighborhood Services. Public hearing closed. REGULAR MEETING V. R09-22 AND R09-23 Mr. Burton stated that the Planning Staff recommends approval of both replat cases. Fernando Ramirez moved to accept staff recommendation of approval of R09-22 and R09-23; Alma LeBlanc seconded the motion. Vote: All Yeas -Motion passed. VI. Z09-03 PD-26j Mr. Burton stated that the Planning Staff recommends approval of Z09-23 (PD-26), however the Fire Department and Building Inspections will require that proper fire equipment is installed prior to an occupancy permit being issued. Public Facilities and existing utilities shall match occupancy capacity for compliance operations; off-street parking shall be sufficient to all activities. Mr. Ramirez stated concerns regarding the property being labeled as a "bed and breakfast" instead of commercial. The commission is requesting specific information regarding the land use for the facility. Fernando Ramirez moved to table staff recommendation of approval of Z09-03 (PD-26); Alma LeBlanc seconded the motion. Vote: All Yeas -Motion passed. VII. MINUTES -July 20, 2009 Mr. Ramirez made a motion to correct minutes from July 20, 2009 regarding case R09-20, where Ms. LeBlanc abstained from voting; Ms. LeBlanc seconded the motion. Mr. Cox asked "what is the difference between the public hearing that was just held and this one requiring a Bond?" Ms. Russell responded, "His infrastructure is not complete. The other gentleman has not begun construction yet. He has the funds for infrastructure. He isn't asking for any additional time for that. He is only requesting an extension of time to start developing. This developer would need to bond just in case the infrastructure is not completed. TEXAS SPEAKING FOR: Rebecca Bellard, 4400 Atlantic Road, Port Arthur, TX 77642 SPEAKING AGAINST: NONE Ms. Russell reminded the commission of the information requested by Chairman Cox and Commissioner Ramirez on August 3~d specifying what number of people will be allowed to attend events and about the circulation of traffic entering the neighborhood and the property. Ms. Bellard limited the number of guests attending special events on the property to 100, and not more than 40 guests to attend daily luncheons from 11-2 p.m. and dinner from 5-8 p.m., including individuals staying in the guest house, limited to six guests. Building inspections stated that 133 people could be accommodated in the dining area and the guest rooms, which would require 144 off street parking places. Mr. Ramirez stated that the commission would like to be presented with plans on how the establishment will look, how parking will be arranged, fencing, and any other pertinent details regarding the property. Ms. Moore requested a floor plan. Ms. Bellard stated to the commission that she would be willing to supply all information required, however she needs confirmation from the commission of what is specifically expected from her, so "everyone can be on the same page." Mr. Ramirez requested a site plan from Anthony Leger of Soutex Surveyors, Inc. Mr. Ramirez moved to close public hearing; Ms. Moore seconded the motion. Vote: All Yeas -public hearing closed. REPORT FROM DIRECTOR Ms. Russell informed the commissioners that future P&Z packets will be delivered by mail or in person, instead of electronically. Mr. Cox informed Ms. Russell that the commissioners are willing to postpone any meetings to ensure accuracy of information being presented to the commission for review and approval. XI.
