Attached is P. R. No. 15526 approving a contract
between the City of Port Arthur and the Texas Artists
Museum (TAMS) for the purpose of funding the museum located
at 3501 Cultural Center Drive for the 2009-2010 Fiscal Year
in the amount of $5,000. Funding will be provided in the
2009-2010 budget under the Hotel Occupancy Tax Fund,
Account # 140-1405-551.59-00, M10101. I am attaching a
copy of the September 4, 2009 correspondence received from
Sandy Trevino-Wigley, Executive Director, Texas Artists
Museum.

the Texas-Artists Museum (TAM) of Port tlrthur is requesting financial assistance that
wrll allow us to continue operating as the only community arts museum in the city. The
cuaent economic downfall has negatively affected our grants and membership fees so
that we find ourselves in an unfavorable financial situation.

Our museum rs,utilized by young and old to Team, study and enjoy the arts. Through art
gurlds, mazket days, ArtSmart classes/workshops, music and Spanish lessons, and more,
TAM serves as,a hub for the fine and liberal arts for the citizens of Port Arthur. After 28
yeazS of sernce to,the community, we find ourselves in need o£assistance from the City
of Port Arthurto continue operating.

RESOLUTION NO.
A RESOLUTION APPROVING A CONTRACT
BETWEEN THE CITY OF PORT ARTHUR AND THE
TEXAS ARTISTS MUSEUM (TAMS) FOR THE
PURPOSE OF FUNDING THE MUSEUM LOCATED AT
3501 CULTURAL CENTER DRIVE FOR THE 2009-2010
FISCAL YEAR IN THE AMOUNT OF $5,000, Account #

WHEREAS, the City Council recognizes that the Texas Artists Museum (TAMS), is a non-
profit organization dedicated to the arts and the cultural enhancement of the City; and
WHEREAS, the community arts museum is located at 3501 Cultural Center Drive, and is a
vital asset to the citizens of Port Arthur; now therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, said agreement is contingent on the availability of funds in the 2009-2010 fiscal
year budget, to be approved by the City Council.
THAT, the City Manager is authorized to execute the contract attached hereto as Exhibit "A"
on behalf of the City of Port Arthur with Texas Artists Museum (TAMS), to help provide funding for
operating costs.
THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the City
Council.
READ, ADOPTED, AND APPROVED, this day of September, 2009, AD, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas by the following vote:

THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS;
COUNTY OF JEFFERSON
AGREEMENT
THIS AGREEMENT, made and entered into between the TEXAS ARTISTS
MUSEUM ("TAMS"), anon-profit corporation, and the CITY OF PORT ARTHUR, TEXAS
(the "City"), a municipal corporation.
WITNESSETH:
WHEREAS, TAMS, and the CITY OF PORT ARTHUR, in recognizing the importance
of the operation of its facility as a benefit to the City as a hub for fine and liberal arts for the
citizens of Port Arthur, and the benefits derived therefrom by citizens and visitors to the CITY,
have jointly resolved to enter into an agreement to provide operating funds for said facility; and
WHEREAS, the CITY OF PORT ARTHUR has agreed to provide operating funds for
the TAMS for the 2009-2010 fiscal year (October 1, 2009 -September 30, 2010) in a sum not to
exceed $5,000, said appropriation having been included in the City budget for the 2009-2010
fiscal year;
NOW, THEREFORE, in consideration of the mutual promises, covenants and
agreements herein set forth, it is agreed between the parties as follows;
THAT, TAMS agrees to operate its facility for the benefit of the public and the City with
the operating funds for fiscal year 2009-2010 being provided jointly by TAMS, and the CITY
OF PORT ARTHUR and any other entities or persons that agree to provide a portion of said
funds.
THAT, the CITY OF PORT ARTHUR agrees to fund to TAMS a sum not to exceed
$5,000 for the 2009-2010 fiscal year (October 1, 2009 through September 30, 2010).
THAT, the TAMS hereby agrees to use the funds payable hereunder from the CITY in
the amount of $5,000 to assist with the continuation of various classes and workshops for the
benefit of the community.
THAT, TAMS will be responsible for facilitating said classes and workshops.
THAT, TAMS shall keep books of account of all of the facilitates expenses and
revenues and shall submit a financial report to the CITY reflecting all receipts and disbursements
by it to operate the facility.
THAT, the City Manager or his designated representative shall have, upon reasonable
notice, the right to inspect all books and records of the TAMS facility.
THAT, upon termination of the operation of the TAMS facility or dissolution of the
TAMS shall deliver to the City all funds paid under this contract that have not been expended in
accordance with this contract.
