BACKGROUND:
The Planning and Zoning Commission will hear this case, requesting
specific use permit for a metal recycling plant on September 21, 2009.
A specific use permit (SUP) is required by Ordinance 06-33, of the City
Codes even if the zoning is "I" (Industrial).
Applicant -Min Transcontinental, Inc:.
Property Owner(s) -Seafood Enterprises Incorporation
RECOMMENDATION:
This case will be recommended to the Planning and Zoning Commission
for approval, based on the location, feedback from Public Works, Utility
Operations, Police and Community Sc°rvices. The approval shall be in line
with the criteria set forth in Resolution 09- 405 (aka P.R. 15459). In
addition to the ordinances and codes;, applicants shall adhere to all other
federal and state regulations related to the implementation of this
business.

STAFFING/EMPLOYEE EFFECT: None

Planning is requesting a public hearing by City Council for case Z09-07-
SUP#210 on October 6, 2009 via the ]proposed resolution 15503

RESOLUTION NO.
A RESOLUTION CALLING FOR A PUBLIC
HEARING TO CONSIDER GRANTING A SPECIFC
USE PERMIT TO MIN TRANSCONTINENTAL, INC.,
FOR THE OPERATION OF A METAL RECYCLING
FACILITY, LOCATED AT 8660 SOUTH 1sT AVENUE,
AKA TRACT 7, BLK 159 WM KING (2.765 ACRES)
AND TRACT 8 ,BLK 159 WM KING (0.544 ACRES).
WHEREAS, in keeping with Ordinance 06-33 of the City of Port Arthur Code of Ordinances
Min Transcontinental Inc., is requesting a specific use permit (SUP) in order to operate a metal
recycling business; and,
WHEREAS, the proposed facility will be located at 8660 South 1sT Avenue, Sabine Pass,
(AKA 3.310 acres composed of of Tracts 7 and 8, Block 159 of the WM KING Addition) as outlined
in Exhibit "A"; and,
WHEREAS, pursuant to Chapter 211 of the Texas Local Government Code and Section 21-
100 of the Zoning Ordinance, a public hearing must precede any zoning change or issuance of a
specific use permit.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. THAT the facts and opinions in the preamble are true and correct.
Section 2. THAT the Planning & Zoning; Commission reviewed this case on September
21, 2009.
Section 3. THAT a public hearing to consider whether to grant this applicant a Specific
Use permit on 8660 South 1sT Avenue, Sabine Pass, (.AKA 3.310 acres composed of of Tracts 7 and
8, Block 159 of the WM KING Addition) Jefferson County, Texas, shall be

held on October 6, 2009 at 9:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth
Street.
Section 4. THAT notice of the public hearing shall be published at least ten (10) days in
the official newspaper of the City.
Section 5. THAT a copy of the caption of'this Resolution be spread upon the Minutes of
the City Council.
