RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
THE MEMORANDUM OF UNDERSTANDING WITH THE PORT ARTHUR
INDEPENDENT SCHOOL DISTRICT AS IT PERTAINS TO THE USE OF
BOB BOWERS CIVIC CENTER AS AN EMERGENCY STAGING AREA
WHEREAS, the Port Arthur Independent School District (PAISD) has determined
that there is a need to identify an emergency staging area for unforeseeable emergencies,
incidents and/or evacuations; and
WHEREAS, due to the number of students at its high school, PAISD has requested
the assistance of the City of Port Arthur to allow PAISD the daily use of the Bob Bowers
Civic Center located at 3401 Cultural Center Drive; and
WHEREAS, the City and PAISD have reached an understanding that will result in
making the facility available to PAISD for a limited period of time in the event an
evacuation of school facilities is needed for the 2023-2024 school year, subject to existing
uses scheduled for the facility at such time; and
WHEREAS, it is deemed in the best interests of the citizens and considered a valid
public purpose to authorize a Memorandum of Understanding with the Port Arthur
Independent School District as it pertains to the use of the Bob Bowers Civic Center as an
emergency staging area for the students of the City of Port Arthur.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.

Section 2. That the City Manager is herein authorized to execute the
Memorandum of Understanding, in substantially the same form as attached hereto as
Exhibit"A".
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.

MEMORANDUM OF UNDERSTANDING
FOR USE OF BOB BOWERS CIVIC CENTER
AS AN EMERGENCY STAGING AREA
This Memorandum of Understanding is made and entered into between the Port Arthur
Independent School District of Jefferson County, Texas (hereinafter"PAISD"), and the City of
Port Arthur, Jefferson County, Texas (hereinafter"City").
PAISD has determined that there is a need to identify an emergency staging area for
unforeseeable emergencies, incidents and/or evacuations.
Due to the number of students at its high school, PAISD has requested the assistance of
the City to allow PAISD the use of the Bob Bowers Civic Center and its facilities ("Facility")
located at 3401 Cultural Center Drive, Port Arthur, Texas. Such use will be on an as needed
basis, not to exceed 24 hours.
The City will allow for the temporary use of the Civic Center and its facilities to PAISD
in the event of an emergency which primarily promotes a public purpose as defined in the Texas
Local Government Code ยง253.
The City and PAISD have reached an understanding that will result in making the facility
available to PAISD for a limited period of time in the event an evacuation of school facilities is
needed for the 2023-2024 school year, subject to existing uses scheduled for the facility at such
time.
The Civic Center will be used by PAISD on an as needed basis, until the emergency event
has been concluded. It is not expected that any emergency event will exceed a period of 24
hours.
PAISD agrees to vacate the premises and all persons from the property within 4 hours of
receiving notice that the facilities will be needed to prepare for a previously scheduled event.
PAISD will reimburse the city for any event cancellation fees incurred due to the use of
the facilities by the district which conflicts with a previously contracted event.

The City executes the agreement with the Port Arthur Independent School District
(PAISD) for use of the Bob Bowers Civic Center facility as an emergency evacuation staging
area, to be staffed and operated by PAISD.
PAISD will be allowed the use of the Wi-Fi and phone systems at the civic center. PAISD
will be allowed to use the parking facilities to administer bus and private transportation of
students to their residences.
PAISD, through its district staff, will provide services, supplies, accommodations,
medical services, and other essentials to the students until they can be transported home.
PAISD will reimburse the city for any staff hours, overtime hours, equipment use
necessary for PAISD's use of the facility. PAISD shall be given the estimate of costs prior to use.
PAISD will provide security and traffic control at the facility during the time the facility
is being used to provide a staging area to students in case of an evacuation of a school.
PAISD will pay the City a reasonable and necessary fee for the cleaning and any damage
restoration of the civic center or other city owned property as a result of its use of the facilities.
