RE: Authorization to approve P.R. No. 23446, in executing aprofessional service
contract between the City of Port Arthur and Dr. Darioush Kavouspour,
M.D., P.A., to act as Port Arthur Fire Department Medical Director.
Introduction:
The intent of this Agenda Item is to seek the City Council's approval for the City Manager
to execute a one year professional services contract between the City of Port Arthur and
Dr. Darioush Kavouspour, M.D., P.A., to serve as the Port Arthur Fire Department
Medical Director in the annual amount of$24,000. The contract can be annually renewed
in continuation of meeting medical supervision requirements.
Background: Dr. Darioush Kavouspour, M.D., P.A., has extensive experience as a trauma
doctor. Dr. Darioush Kavouspour, M.D., P.A is a licensed physician to practice medicine in
the State of Texas; is familiar with the operation of EMS systems; has experienced in pre-
hospital emergency care of acutely ill or injured patients; and is actively involved in the
training and/or continuing education of the EMS personnel. Dr. Darioush Kavouspour,
M.D., P.A. serves as a Medical Director for several other area fire departments, including
Lumberton, Beaumont and Winnie.
Budget Impact: Funds are available on Port Arthur Fire Department Professional Services
account 001-19-047-5420-00-3 0-000.
Recommendation:
It is recommended that the City Council approve P.R.No. 23446, for the City Manager to execute
a one year professional service comtnict between the City of Port Arthur and Dr. Darioush
Kavouspour, M.D., P.A., to serve as Port Arthur Fire Department Medical Director.

RESOLUTION NO.
A RESOLUTION APPROVING THE CONTRACT BETWEEN THE
CITY OF PORT ARTHUR AND DR. DARIOUSH KAVOUSPOUR,
M.D., P.A., TO SERVE AS THE PORT ARTHUR FIRE
DEPARTMENT MEDICAL DIRECTOR TO OVERSEE EMERGENCY
MEDICAL SERVICES, IN THE ANNUAL AMOUNT OF $24,000.00.
FUNDS ARE BUDGETED IN THE FY 2023/2024 PROFESSIONAL
SERVICE FUND ACCOUNT 001-23-061-5470-00-50-000
WHEREAS, in accordance with Sections Title 22, Part 9, Chapter 197 of
the Texas Administrative Code fire departments that provide First Responder
Services must have a medical director. Fire department medical directors must be
licesned physicians in the State of Texas and serve to oversee the First Responder
Organization (FRO) emergency medical program implemented by the fire
department.
WHEREAS, Dr. Darioush Kavouspour, M.D., P.A., is a licensed physician
in the State of Texas and has extensive experience and experise in working with
fire department First Responder Organizations the Port Arthur Fire Department is
desiring to execute a contract for medical director services; and,
WHEREAS, approval is needed to appoint Dr. Darioush Kavouspour, M.D.,
P.A., as the Port Arthur Fire Department Medical Director from December 1, 2023
to November 30, 2024 with approved annual renewal; and,
WHEREAS, compensation will be $24,000 annually from the Port Arthur
Fire Department.

BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR:
SECTION 1. That, the facts and preamble are true and correct.
SECTION 2. That, the City Council of the City of Port Arthur hereby authorizes the
City Manager and Fire Chief to execute said Contract, in substantially the same form as
attached hereto as Exhibit "A."
SECTION 3. That, a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.

EXHIBIT "A
CONTRACT FOR INDEPENDENT PROFESSIONAL
SERVICES
This Agreement is made between the City of Port Arthur, Texas hereinafter referred to as
"City" and Dr. Darioush Kavouspour, M.D., P.A., herein referred to as "Contractor."
I. TERM OF CONTRACT
This Contract shall be for a period beginning December 1, 2023, and shall remain in force
through November 30, 2023. Thereafter, this Agreement shall be renewed annually at the
discretion of the parties.
II. PROFESSIONAL SERVICES
This Contract will allow Dr. Darioush Kavouspour, M.D., P.A to serve as the Port Arthur
Fire Department Medical Director. As the Port Arthur Fire Department Medical Director, Dr.
Darioush Kavouspour, M.D., P.A shall:
1) Administer state and local laws relating to Emergency Medical; Services provided
within the City's jurisdiction in accordance with Section 121.021 Texas Health and Safety Code,
as amended.
2) Do all things necessary to implement and enforce the law to protect public health and
safety.
3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas
Department of State Health Services (DSHS).
4) Establish, maintain, and enforce quarantine in the City's jurisdiction.
5) Perform all acts for the Port Arthur Fire Department which are required by law to be
performed by a licensed physician or which if provided by a person other than a licensed physician
would constitute the unlicensed or unlawful practice of medicine.
6) Provide consultant services in policy, planning, procedure, administrative and other
matters to the Fire Chief as requested by said Chief.
7) Meet with the City's Fire Department representatives monthly to review emergency
medical incidents, exposures and debriefings, establish and review medical protocols, review and
make recommendations concerning DSHS certifications and continuing education.
8) Provide professional assistance to the City's Fire Department in administrative
matters before boards, DSHS, and the City Council on an as needed basis.
1. Is a physician licensed to practice medicine in the State of Texas.
2. Currently resides full-time within the State of Texas.
3. Is Board Certified in Emergency Medicine (ABEM or AOBEM certification is
preferred) or has the equivalent combination of board certification and training (e.g.: Family
Practice Certification with ACLS, ATLS, PALS, etc.);
4. Has substantial knowledge of clinical emergency medicine.
5. Has substantial knowledge of, and experience in the specialized area of EMS Medical
Direction.
6. The Medical Director, or his authorized designee, will take part in meetings or other
EMS System administrative tasks at least one day each month, on a schedule approved by
the Fire Chief, and
Maintain a current awareness of EMS developments at the local, state, and national levels,
representing the Port Arthur Fire Department First Responder responsibilities at professional
meetings and participation in research for improved services and patient care.
7. Agrees to work within the EMS infrastructure and foundation currently in place,
including continuation of implementation and improvement of the District's EMS System
Patient Care Protocols and service delivery.
As the Supervising Physician of the Port Arthur Fire Department Medical Director, Dr.
Darioush Kavouspour, M.D., P.A shall:
1) Function as the supervising physician of the Port Arthur Fire Department First
Responder Organization responsibilities.
2) Review incident reports as needed and required.
3) Review and approve all protocols and standing delegation orders/guidelines for the
effective operation of the Port Arthur Fire Department First Responder operations.
4) Provide consultation as needed to the Port Arthur Fire Department Medical Division
or administrative staff.
III. COMPENSATION
The Contractor shall be paid Twenty-Four Thousand Dollars ($24,000.00) annually for
professional services provided for the Port Arthur Fire Department as Medical Director.
Compensation will be made on a monthly basis. The hours of work shall be mutually agreed
upon by the City of Port Arthur Fire Department Fire Chief.
IV. LICENSURE/LIABILITY INSURANCE
1) The Contractor shall provide proof of licensure for Dr. Darioush Kavouspour, M.D.,
P.A., to practice medicine in the State of Texas.
2) The Contractor shall be covered under the City's liability insurance for services
performed as the Health Authority.
V. TERMINATION
This Agreement can be terminated with sixty (60) days prior written notice by either.
