NO. 23470 —A resolution calling for a public hearing to consider a zoning change Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 23470, calling for a public hearing to consider granting a zoning change for an approximately 21.308-acre Tract of Parcel of Land being out of and part of the W. Kyle Survey A-414, Unrecorded Plat of the Palomar Addition, Section 1, Port Arthur, Jefferson County, Texas. The property is located south of Texas 93-Spur [A.K.A. West Port Arthur Road] between Shirley Street and 58th Street. The request aims to change the zoning from "HDR" High-Density Residential (formerly referred to as "MF" Multiple Family) to "CR" Commercial Retail (formerly referred to as "LC" Light Commercial) to allow for the development of a Park and Ride Facility. Background: On November 9, 2023, Kenneth Stewart, owner of BDS Constructors, LLC d.b.a. MK Constructors, applied for a zoning change from High-Density "HDR" Residential (formerly referred to as Multiple Family zoning) to Commercial Retail "CR" (formerly referred to as Light Commercial "LC" zoning) to allow for the development of a Park and Ride Facility. Per Appendix A, Section 3: Land Uses, providing an effective date of January 1, 2023, a "Parking Lot or Structure for Passenger Motor Vehicles" is prohibited in residentially zoned districts within the City limits. "Remember,we are here to serve the Citizens of Port Arthur" P.O.Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 Per Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the City Council for a change or amendment to the provisions of this ordinance. The Planning and Zoning Commission may, on its own motion or on request from the City Council, institute study and proposal for changes and amendments in the public interest. A public hearing shall be held by the City Council before adopting any proposed amendment, supplement, or change. Before the fifteenth (15th) day before the date of the City Council hearing, notice of the time and place of the hearing for any zoning amendment (i.e., a Rezoning or a Zoning Text Amendment) must be published in an official newspaper or a newspaper of general circulation in the City stating the time and place of such hearing. The City Council hearing may be conducted as a joint hearing with the Planning and Zoning Commission in accordance with the provisions of Local Government Code Section 211.007. The Planning &Zoning Commission will conduct a public hearing on December 4, 2023. Budget Impact: None Recommendation: It is recommended that the City Council approve P.R. KYLE SURVEY, A-414, AND CONSISTING OF ALL OF LOTS 10-25, BLOCK 27, A PORTION OF OLEANDER, VIOLET, GARDENIA, CAMELLIA, COX, & DAISY STREETS, AND A PORTION OF WILLOW DRIVE, A PORTION OF BLOCKS 25 & 26, AND ALL OF BLOCKS 14, 15, & 16 OF THE PALOMAR ADDITION, SECTION 1, AN UNRECORDED SUBDIVISION PLAT, PORT ARTHUR, JEFFERSON COUNTY, TEXAS. Z23-10 — BDS CONSTRUCTORS, LLC D.B.A. MK CONSTRUCTORS WHEREAS, it is being requested that the City Council consider a zoning map amendment for a 21.308-acre Tract of Parcel of Land being out of and part of the W. Kyle Survey A-414 as delineated in Exhibit "A"; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission will hold a public hearing for this case on December 4, 2023. THAT a public hearing to consider a Zoning Map amendment for a 21.308-acre Tract or Parcel of Land being out of any part of the W. Kyle Survey A-414, and consisting of all of Lots 10-25, Block 27, unimproved portions of Oleander, Violet, Gardenia, Camellia, Cox, and Daisy Street Rights-of-way, and an unimproved portion of Willow Drive, a portion of Blocks 25 & 26, and all of Blocks 14, 15, & 16 of the Palomar Addition, Section 1, an unrecorded subdivision plat, Port Arthur, Jefferson County, Texas, P.R.NO.23470 11/15/2023-pdl PAGE 2 OF 6 delineated in Exhibit "A" shall be held on December 19, 2023, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
