NO. 23475—A resolution calling for a public hearing to consider a zoning change Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 23475, calling for a public hearing to consider granting a zoning change for an approximately 4.000-acre Tract or Parcel of Land, Tr 2, Lot 8, Block 12, Port Acres, Jefferson County, Texas. The property is located at 2689 65th Street. The request aims to change the zoning from "LDR" Low-Density Residential (formerly referred to as "SF" Single Family) to "CR" Commercial Retail (formerly referred to as "LC" Light Commercial) to allow for the development of an Extended Stay Hotel. Background: On November 13, 2023, Farhan Khokar, owner of E-Advantage, Inc, applied for a zoning change from Low-Density "LDR" Residential (formerly referred to as Single Family zoning) to Commercial Retail "CR" (formerly referred to as Light Commercial "LC" zoning) to allow for the development of an Extended Stay Hotel. Per Appendix A, Section 3: Land Uses, providing an effective date of January 1, 2023, a "Hotel" is not prohibited in residentially zoned districts within the City limits. A pre-development meeting as conducted on September 13, 2023. Participants included the Representatives from the City's Planning & Zoning Division, Regulatory Services, Chief Building Official, Solid Waste Division, Regulatory Services, "Remember, vve are here to serve the Citizens of Port Arthur" P.O.Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 Engineering Division, and the Fire Marshal's Office. Drainage District No. 7 was also in attendance, as well as client representation from E-Advantage Inc. The Planning &Zoning Commission will conduct a public hearing on December 4, 2023. A final report will be prepared and provided to City Council in accordance with Chapter 211.007 of the Texas Local Government Code, and Appendix A, Section 6.03 of the City's Zoning Ordinance. Per Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the City Council for a change or amendment to the provisions of this ordinance. The Planning and Zoning Commission may, on its own motion or on request from the City Council, institute study and proposal for changes and amendments in the public interest. A public hearing shall be held by the City Council before adopting any proposed amendment, supplement, or change. Before the fifteenth (15th) day before the date of the City Council hearing, notice of the time and place of the hearing for any zoning amendment (i.e., a Rezoning or a Zoning Text Amendment) must be published in an official newspaper or a newspaper of general circulation in the City stating the time and place of such hearing. The City Council hearing may be conducted as a joint hearing with the Planning and Zoning Commission in accordance with the provisions of Local Government Code Section 211.007. Budget Impact: None Recommendation: It is recommended that the City Council approve P.R. No. 23475, calling for a public hearing to consider granting a zoning change for an approximately 4.000-acre Tract or Parcel of Land, Tr 2, Lot 8, Block 12, Port Acres, Jefferson County, Texas. The property is located at 2689 65th Street. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A ZONING MAP AMENDMENT FOR 4.000-ACRE TRACT OR PARCEL OF LAND, CONSISTING OF TR 2, LOT 8, BLOCK 12, PORT ACRES, JEFFERSON COUNTY, TEXAS. Z23-09 — E-ADVANTAGE INC. WHEREAS, it is being requested that the City Council consider a zoning map amendment for a 4.000-acre Tract of Parcel of Land being out of Port Acres as delineated in Exhibit "A"; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission will hold a public hearing for this case on December 4, 2023. THAT a public hearing to consider a Zoning Map amendment for a 4.000-acre Tract or Parcel of Land being out of Port Acres, and consisting of Tr 2, Lot 8, Block 12, Port Acres, Jefferson County, Texas, delineated in Exhibit "A" shall be held on December 19, 2023, at 6:00 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
