Roberts, EIT, MEng, MBA, CPM, Public Works Directo RE: P.R.23477—Purchase of two(2)Elgin Whirlwind 1 Pure Vacuum Street Sweeper Trucks for the Public Works Drainage Division for $843,010.00 from Kinloch Equipment and Supply, Inc. of Pasadena, Texas, through the Sourcewell Cooperative Purchasing Contract Introduction: This agenda item requests Council's approval for the purchase of two (2) Elgin Whirlwind 1 Pure Vacuum Street Sweeper trucks for the Drainage Division. Background: The Public Works Drainage Division(Drainage)uses street sweepers to clean over 160 miles of curb and gutter throughout the City. Equipment such as Elgin Whirlwind 1 Pure Vacuum Street Sweeper trucks with front bumper chain suspended magnet will allow crews to effectively remove leaves, debris, and metallic construction material for the TCEQ required maintenance of our storm sewer system. Council approved purchasing this replacement equipment in the fiscal year ending 2024 budget's capital equipment schedule for the reasons listed in the following table. Recommendation: The City of Port Arthur City Council is recommended to approve PR 23477 authorizing the City Manager to purchase two (2) Elgin Whirlwind 1 Pure Vacuum Street Sweeper trucks with front bumper chain suspended magnet for the Public Works Drainage Division from Kinloch Equipment and Supply,Inc.of Pasadena,Texas,through the Sourcewell Cooperative Purchasing Contract. A RESOLUTION AUTHORIZING THE PURCHASE OF TWO (2) ELGIN WHIRLWIND 1 PURE VACUUM STREET SWEEPERS WITH FRONT BUMPER CHAIN SUSPENDED MAGNET FOR THE DRAINAGE DIVISION FROM KINLOCH EQUIPMENT AND SUPPLY OF PASADENA, TEXAS, THROUGH THE SOURCEWELL COOPERATIVE PURCHASING CONTRACT NUMBER 093021-ELG FOR THE NOT-TO-EXCEED AMOUNT OF $843,010.00. FUNDS ARE AVAILABLE IN THE CAPITAL RESERVE FUND ACCOUNT, ACCOUNT NUMBER 625-21-000- 8522-00-00-000. WHEREAS, the Public Works - Drainage Division routinely uses street sweeper trucks to remove trapped debris in the maintenance of the City's stormwater system for the prevention of flooding; and, WHEREAS,the Elgin Whirlwind 1 Pure Vacuum Street Sweeper shall be primarily used to remove organic and/or light debris material from street gutters and other pavement surfaces by a broom-vacuum operation as part of the drainage maintenance; and, WHEREAS, the City Council approved the replacement of two (2) street sweepers in its 2023-2024 fiscal year budget; and, WHEREAS, per Resolution Number 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with JCB Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; and, WHEREAS,Kinloch Equiptment and Supply, Inc. of Pasadena,Texas,is a dealer and part of the Sourcewell Cooperative Purchasing Program under JCB Sourcewell Contract Number 093021-ELG, and submitted a quote for two street sweepers in the amount of $843,010.00 (attached hereto as Exhibit A); now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: PR 23477 11/17/2023 LLJ Page 2 of 3 THAT,the facts and opinions in the preamble are true and correct; and, THAT,the City Manager of the City of Port Arthur is hereby authorized to purchase two (2) 2025 Whirlwind 1 Pure Vacuum Street Sweepers with front bumper chain suspended magnet from Kinloch Equipment and Supply, Inc. of Pasadena, Texas, through the Sourcewell Cooperative Purchasing Contract for $843,010.00; and, THAT,funding for this purchase is available in the Capital Reserve Fund Account,account number 625-21-000-8522-00-00-000; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This warranty is extended only to the original user-purchaser for a period of twelve (12)months from the date of delivery to the original user-purchaser. ELGIN SWEEPER COMPANY will cause to be repaired or replaced,as the Company,may elect,any part or part of such machine which the Company's examination discloses to be defective in material or workmanship. Repairs or replacements are to be made at the selling Elgin distributor's location or at other locations approved by ELGIN SWEEPER COMPANY. The ELGIN SWEEPER COMPANY warranty shall not apply to: 1. Major components or trade accessories such as but not limited to,trucks,engines,tires or batteries that have a separate warranty by the original manufacturer. 2. Normal adjustments and maintenance services. 3. Normal wear parts such as but not limited to,broom filters,broom wire,shoe runners and rubber deflectors. 4. Failures resulting from the machine being operated in a manner or for a purpose not recommended by ELGIN SWEEPER COMPANY. 5. Repairs,modifications or alterations without the consent of ELGIN SWEEPER COMPANY which,in the Company's sole judgment, have adversely affected the machine's stability or reliability. 6. Items subjected to misuse,negligence,accident or improper maintenance. The use in the product of any part other than parts approved by ELGIN SWEEPER COMPANY may invalidate this warranty. ELGIN SWEEPER COMPANY reserves the right to determine,in its sole discretion,if the use of non-approved parts operates to invalidate the warranty. Nothing contained in this warranty shall make ELGIN SWEEPER COMPANY liable for loss,injury,or damage of any kind to any person or entity resulting from any defect or failure in the machine. TO THE EXTENT LIMITED BY LAW,THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES,EXPRESS OR IMPLIED,INCLUDING WITHOUT LIMITATION,ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This warranty is also in lieu of all other obligations or liabilities on the part of ELGIN SWEEPER COMPANY,including but not limited to,liability for incidental and consequential damages on the part of the Company or the seller. ELGIN SWEEPER COMPANY makes no representation that the machine has the capacity to perform any functions other than as contained in the Company's written literature,catalogs or specifications accompanying delivery of the machine.
