BackMround: Resolution No. 22-147 awarded the Main Wastewater Plant(WWTP) Improvement Project to ALLCO, LLC of Beaumont, Texas for the total amount of$73,643,227.00. The construction phase is managed by Freese&Nichols, Inc. On August 2, 2022, Resolution No. 22-329, approved Change Order No. 1 for value engineering performed by Freese &Nichols, Inc., ALLCO, LLC, Golden Triangle Consulting Engineers, and the City of Port Arthur staff in the deduction amount of$6,234,049.00. On December 20, 2022, Resolution No. 22- 586, approved Change Order No. 2 including, Primary Clarifiers subgrade stabilization, Drying Beds demo, Demo and Remove CSS, Helical Piles, and Brentwood PVC TF Media price increase and reduction for the removal of VE Lighting Package, use of bank sand for pipe bedding, and remove Admin Building improvements in the deduction amount of$73,564.57 and 75-day time extension. Freese & Nichols, Inc. recommend Change Order No. 3 for an increased amount of $114,851.00 to replace 4 Trickling Filter Effluent Butterfly Valves with Slide Gates and add an expansion joint to Aeration Basin Buttress Wall. Budget Considerations: The original contract price is $73,643,227.00 Change Order No. 1 decreased the contract amount by $6,234,049.00 Change Order No. 2 decreased the contract amount by $73,564.57 Proposed Change Order No. 3 will increase the contract amount by $114,851.00 to the new total contract amount of$67,450,464.43. The extra funding was approved for FY24 and is available in Account No. 405-40-000-8516- 00-00-000, Project No. WS0023 Recommendation: Recommend City Council approve PR No. 23518 to execute Change Order No. 3 with ALLCO, LLC of Beaumont, Texas, as described/outlined above. WS0023. WHEREAS, the City Council approved Resolution No. 22-147, awarding the Main Wastewater Treatment Plant Rehabilitation project to ALLCO, LLC of Beaumont, Texas; and, WHEREAS, on August 2, 2022, Resolution No. 22-329, approving Change Order No. 1 to reduce the contract amount by $6,234,049.00 for Value Engineering performed by Freese & Nichols, Inc., ALLCO, LLC, Golden Triangle Consulting Engineers and the City of Port Arthur staff for a new contract amount of$67,409,178.00; and, WHEREAS, on December 20, 2022, Resolution No. 22-586, approved Change Order No. 2 including, Primary Clarifiers subgrade stabilization. Drying Beds demo, Demo and Remove CSS, Helical Piles, and Brentwood PVC TF Media price increase and reduction for the removal of VE Lighting Package, use of bank sand for pipe bedding, and remove Admin Building improvements in the deduction amount of$73,564.57 and 75-day time extension with a final project end date of December 17, 2026; and, WHEREAS, Freese & Nichols, Inc. has recommended Change Order No. 3 for an increased amount of $114,851.00 to replace four (4) Trickling Filter Effluent Butterfly Valves with Slide Gates and add an expansion joint to the Aeration Basin Buttress Wall. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, PR No. 23518 12/2/23 JL Page 2 of 3 THAT,the City Manager of the City of Port Arthur is hereby authorized and directed to execute Change Order No. 3 (Attachment "A") for an increase of $114,851.00 with ALLCO, LLC of Beaumont, Texas for the Main WWTP Improvements project, to a new projected budgetary amount of$67,450,464.43; and, THAT, funding is available in Account No. 405-40-000-8516-00-00-000, Project No. WS0023; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Item No. 1: Replace 4 Trickling Filter Effluent Butterfly Valves with Slide Gates After Allco completed the demolition of the items identified on Sheet TF-M1: Trickling Filter Demolition Plans at Trickling Filter"A",they attempted to close off the 30"Effluent Butterfly Valve to assist with isolating and cleaning out Trickling Filter"A". It was discovered that all four of the existing Butterfly Valves for the Trickling Filters were inoperable. This was brought up during a Monthly Progress Meeting where it was requested of Allco to submit proposals for several different options to replace the Butterfly Valves. All proposals were evaluated, and the decision was made to proceed with replacing all four(4) Butterfly Valves with Slide Gates.Allco submitted CP-010.1 for this unforeseen condition with a total cost of $104,340.00. Freese & Nichols, Inc. agrees with their cost. Total Cost: $104,340.00 Additional Days: 0 Calendar Days Item No. 2:Add Expansion Joint to Aeration Basin Buttress Wall Note 1 on Sheet AB-S1:Buttress Wall Plan and Sections states that the "basin shall be dewatered during buttress wall and footing construction". Dewatering the basins is required to relieve the pressure from the water in the Aeration Basin against the basin's wall that is cracking and bowing outwards. After Allco had completed installing the rebar and formwork for the Buttress Wall, it was discovered that one of the gates for the basin is not sealing making it not possible to dewater the basin. Freese & Nichols, Inc. structural engineers revaluated the design and decided that it would be acceptable to install the Buttress Wall without dewatering the Aeration Basin if an expansion joint was added to the Buttress Wall. To add the expansion joint Allco will need to remove a majority of the formwork that has already been installed, make modifications to the rebar, reinstall the formwork, and then place the concrete for the Buttress Wall in two separate placements. Allco submitted CP-011 with a total cost of $10,511.00 for all the labor and effort required to add the expansion joint to the Buttress Wall. Freese & Nichols, Inc. agrees with their cost. Total Cost:$10,511.00 Additional Days:0 Calendar Days PTR22379 T:\4.0 CONSTRUCTION\4.40 Contract Mod\4.43 Chg Orders\Change Order No.3 Item No. 3:Abnormal Weather Days from December 2022 through March 2023: 0 Days. The contract documents designate a fixed amount of "Anticipated Bad Weather Delays" per a given month and when the number of"Bad Weather Days", where rain "equals or exceeds 0.25 inches", go over the "Anticipated Bad Weather" days, that is defined as an "Abnormal Weather Condition" and "the contractor is entitled to an equitable adjustment in the Contract Times". From the month of December 2022, up through the end of March 2023, the project has experienced 0 Abnormal Weather Days. Total Cost: $0.00 Additional Days: 0 Calendar Days To summarize, this Change Order No. 003 has an overall cost increase of$114,851.00 and 0 additional calendar days to the contract time.
