The caption of Ordinance No. 23-38 reads as follows:
ORDINANCE NO. 23-38
An Ordinance Of The City Of Port Arthur, Texas,
Closing, Vacating, Abandoning, And Conveying
A 2.042-Acre Portion Of An Improved
Dedicated Public Right-Of-Way, Known As
Terminal Road, Port Arthur, Jefferson County,
Texas; Authorizing The City Manager To
Execute A Deed Without Warranty; Providing
That This Ordinance Shall Be Cumulative;
Repealing All Ordinances To The Extent They
Are In Conflict; Providing For Severability; And
Declaring An Effective Date
(3) P.O. No. 7166 — An Ordinance Amending The Zoning
Ordinance Of The City Of Port Arthur By Changing The
Zoning From Agricultural To High-Density .Residential On
Approximately 7.404-Acres Of Land Consisting Of Lot 16
And Part Of Lot 17, Block 7, Hillcrest 2 Addition, Port Arthur,
Jefferson County, Texas (Violation Of Any Provision Of This
Ordinance Shall Be Guilty Of A Misdemeanor And Shall Be
Punished By A Fine Not Exceeding $2,000.00, As Provided
In Chapter 1, Section 1-13 Of The Code Of Ordinances, And
Each Day Which Violation Is Permitted To Exist Shall
Constitute A Separate And Distinct Offense.); And Providing
For Publication In The Official Newspaper Of The City Of
Port Arthur And Effective Immediately After Publication

The Mayor introduced the above-mentioned Proposed Ordinance.
The motion was made by Councilmember Kinlaw and seconded by Councilmember
Franki that Proposed Ordinance No. 7166 be adopted.
The following roll call vote was taken on the motion to adopt Proposed Ordinance No.
7166:
Councilmember Beckcom "No"
Councilmember Doucet "No"
Councilmember Frank "No"
Mayor Pro Tem Hamilton "Yes"
Councilmember Kinlaw "No"
Councilmember Lewis "No"
Mayor Bartie "Yes"
The motion to adopt Proposed Ordinance No. 7166 failed.

33 In Its Entirety As It Pertains To Amending Chapter 110
(Utilities), Article II (Water), Division 3 (Service Charges
And Billing), Sections 110-91 (Rate Schedule) And 110-92
(Consumers Outside City Not Having Special Contracts) Of
The Code Of Ordinances Of The City Of Port Arthur, As It
Pertains To Rates For Residential, Commercial And
Industrial Customers (Requested By Councilmember Lewis)
The Mayor introduced the above-mentioned Proposed Ordinance.
Upon the motion of Councilmember Doucet, seconded by Councilmember Lewis and
carried, Proposed Ordinance No. 7168 was removed from the agenda.
Voting Yes: Mayor Bartle; Mayor Pro Tem Hamilton, Lewis, Beckcom, Doucet, Kinlaw
and Frank.
Voting No: None.
IX. ADJOURNMENT OF MEETING
Upon the motion by Councilmember Doucet, seconded by Councilmember Kinlaw and
carried unanimously, the City Council adjourned their meeting at 10:18 p.m.
An audio-tape of this meeting is on file in the office of the City Secretary and is made a
part of the official minutes of this meeting.
