BACKGROUND:
Notification of this proposed abandonment was submitted to all utility entities servicing the City
of Port Arthur for comment and acceptance. The Planning Staff has yet to receive any objections
to this request; however, the institution has been informed of the financial responsibility of
relocating utility lines, as instructed by the various entities.
PUBLIC NOTICE:
The public notification was published in the weekend edition of the Port Arthur Newspaper on
Friday, September 13, 2023, more than ten (10) days prior to the September 25, 2023, public
hearing. On September 7, 2023, a notification was mailed to adjacent property owners within
200 feet of the subject properties.
FISCAL IMPACT BU❑ ET IMPLICATIONS:
Cook & Associates, Inc. of Beaumont, Texas, has appraised the street and alley rights -
of -way.
RECOMMENDED ACTION:
In accordance with Chapter 94, Section 94-383(b) - Requirements and effect of
abandonment and vacation, of the City of Port Arthur Code of Ordinances the
following must occur before an ordinance can be considered by the city council for an
abandonment:
• A recommendation shall be requested and received from the planning and zoning
commission.
• A public hearing shall be held with notice furnished to all property owners within 200
feet and published in the city's official newspaper.

EXCHANGING CITY LAND
ARTICLE Vt. ABANDONING AND VACATING STREETS, ALLEYS AND EASEMENTS;
CONVEYING, SELLING OR EXCHANGING CITY LAND'
Sec. 94-381. Abandoning and vacating city streets, alleys or easements; administrative
charges assessed.
There is assessed a minimum administrative fee of $200.00 for the abandoning and vacating of city streets,
alleys or easements. If the director of planning determines that such minimum fee is not adequate to cover the
actual administrative time and expense required for a particular abandonment and vacation, the director of
planning shall calculate a reasonable administrative fee which is adequate to cover such time and expense.
(Code 1961, § 18-124)
Sec. 94-382. Application; procedure.
Any person desiring to have a city street, alley or easement abandoned and vacated shall make application
for the same to the director of planning. The application shall be accompanied by the following:
(1) The signed and acknowledged written consent and release of all owners (including lessees) of all
property which abuts on either side of the street, alley or easement proposed to be abandoned.
(2) The signed and acknowledged written consent and release of all owners (including lessees) of all
property to which access would be materially and substantially impaired if the proposed abandonment
is granted.
(3) Administrative fee as provided in section 94-381.
(4) Title report issued by a title insurance company acceptable to the city identifying abutting ownership.
(Code 1961, § 18-125)
Sec. 94-383. Requirements and effect of abandonment and vacation.
(a) No street, alley or easement shall be abandoned and vacated unless the city council determines in the
abandoning ordinance that abandonment and vacation is for a public purpose and is in the public interest,
and all requirements of this article and all other applicable ordinances and laws are satisfied. Whenever a
street, alley or easement is to be abandoned, the abandoning ordinance shall provide that the property to be
abandoned shall be sold or revert to the abutting property owners in proportion to their abutting ownership.
(b) Before such ordinance shall be considered by the city council, the following must occur:

municipalities, authority, V.T.C.A., Transportation Code § 311.007.

(c) Such ordinance shall further provide that in consideration of the foregoing and upon receipt from the
applicant of the fair market value of such property, unless a donation is allowed by V.T.C.A., Local
Government Code § 272.001, such property shall revert to the abutting property owners in proportion to
their abutting ownership as shown by a title report of the current date paid for by the applicant and issued
by a title company acceptable to the city. Such ordinance shall provide for an equitable manner of

authorized to execute a special warranty deed conveying such abandoned property to such abutting owners
in proportion to their abutting ownership as shown in such report and with division between owners in the
equitable manner specified in such ordinance. Such deed shall provide that all reservations and exceptions
shown in such report, and the following shall be reservations from and exceptions to conveyance and
warranty in such deed: All restrictions, covenants, conditions, easements, rights -of -way and prescriptive
rights, whether recorded or not, and all recorded reservations, if any, and zoning and other laws affecting
this property.

Sec. 94-384. Retention of utility easement upon abandoning and vacating street, alley or
easement.
Upon the abandoning and vacating of any street, alley or easement, the city shall have the right, if it so
desires, to retain a utility easement within the street, alley or easement abandoned with an appropriate reduction
in fair market value.

Sec. 94-385. Conveying, selling or exchanging land or interest in land owned by the city.
(a) If the city council elects to not grant the request for abandonment and vacation of a street, alley or
easement interest in land as provided in section 93-382, the money deposited to cover the cost of the
administrative fee, appraisal, unless it is a donation and title report shall not be refunded to the applicant,
but the money deposited to cover the dollar value of the street, alley or easement interest shall be refunded
to the applicant.
(b) Any conveyance, sale or exchange of any land or interest in land owned by the city which is not made under
the exemptions in V.T.C.A., Local Government Code § 272.001 shall be subject to the bid procedures and
publication requirements setforth in V.T.C.A., Local Government Code § 272.001(a). Any sale of any right,
title or interest in city property must comply with Section 7 of Article XIV of the City Charter.
(c) If the city council elects to grant the request, then as required by V.T.C.A., Local Government Code §
272.001, the street or alley, whether owned in fee or used by easement, or other easement interest may be

municipal building shall be used only for the acquisition and improvement of property for the same uses as
that so sold.

the exemptions in V.T.C.A., Local Government Code § 272.001(b) shall be subject to the bid procedures and

BACKGROUND:
In November 2019, Planning Staff received an application from Motiva Enterprises, L.L.C.,
requesting the abandonment of the 2.042-acre portion of the public right-of-way. This section
of Terminal Road is located south of West 17th Street and east of State Highway 82 [A.K.A. Dr.
Martin Luther King, Jr. Drive].

As part of the abandonment process, the application was accompanied by signed and written
consent of all utility entities and adjacent property owner(s), with Motiva Enterprises, L.L.C.
being the registered owner of the adjoining properties. Utility entities include the City of Port
Arthur Water/Sanitary Sewer, Public Works - Drainage, Charter/Spectrum Cable, Texas Gas
Service, Entergy, AT&T - Texas, and Drainage District No. 7.
The City's Planning and Zoning Commission held a public hearing on Monday, March 16, 2020.
Public Notices were published in the Port Arthur Newspaper on March 7, 2020, and notices were
sent to property owners within a 200 ft. radius of the proposed site.
On March 17, 2020, the City Council approved Resolution No. 20-083, calling for a public hearing
to consider the proposed abandonment. However, further discussion with the Council yielded a
decision to request that Motiva Enterprises, L.L.C. withdraw its request for abandonment due to
traffic and safety concerns posed by the Council.
Moving forward, Representatives from Motiva Enterprises submitted a new application for the
said abandonment on September 9, 2022, with the request remaining the same as previous.
The Planning and Zoning Commission held a public hearing on September 19, 2022. Public
Notices were published in the Port Arthur Newspaper on September 9, 2022, and notices were
sent to property owners within a 200 ft. radius of the proposed site on September 7, 2022. At
this public hearing, there was no written or verbal opposition from the public. The Commission
voted 3:0, recommending approval of this request.
On September 27, 2022, the City Council approved Resolution No. 22-440, calling for a public
hearing. Notification of this proposed abandonment was submitted to all utility entities
servicing the City of Port Arthur for comment and acceptance. The Planning Staff did not receive
any objections to this request.
Based on the discussion with the City's Public Safety, Public Works, and Engineering Officials,
there is no opposition to the request to abandon the said right-of-way.
The City Council conducted its public hearing at a regularly scheduled meeting on October 25,
2022, at 6:00 p.m. in the City Council Chambers. Members of the public were invited to speak
regarding the said request; Willie Bae Lewis asked for clarification on the precise section of
Terminal Road being requested for abandonment and the future desire to construct berms at
this location. Claire Jackson, Motiva Representative, informed Mr. Lewis that Motiva had no
desire to develop the area and would be used strictly for parking and traffic control. There were
no members of the public to oppose the said request.
Following the October 25, 2023, public hearing, Representatives of Motiva Enterprises asked
that the proposed ordinance conveying said portion of Terminal Road be held for a future date.
On August 29, 2023, the proposed ordinance was brought forward for the City Council's
consideration. In a vote of 6:1, the Council voted to approve the request to close, vacate,
abandon, and convey the 2.042-acre portion of Terminal Road to Motiva Enterprises, LLC.

Notification of this proposed abandonment was submitted to all utility entities servicing the City
of Port Arthur for comment and acceptance. The Planning Staff has yet to receive any objections
to this request; however, the institution has been informed of the financial responsibility of
relocating utility lines, as instructed by the various entities.
PUBLIC NOTICE:
The public notification was published in the weekend edition of the Port Arthur Newspaper on
Friday, September 13, 2023, more than ten (10) days prior to the September 25, 2023, public
hearing. On September 7, 2023, a notification was mailed to adjacent property owners within
200 feet of the subject properties.
FISCAL IMPACT BUDGET IMPLICATIONS:
Cook & Associates, Inc. of Beaumont, Texas, has appraised the street and alley rights -of -way.
RECOMMENDED ACTION:
In accordance with Chapter 94, Section 94-383(b) - Requirements and effect of abandonment
and vacation, of the City of Port Arthur Code of Ordinances the following must occur before an
ordinance can be considered by the city council for an abandonment:
A recommendation shall be requested and received from the planning and zoning
commission.
■ A public hearing shall be held with notice furnished to all property owners within 200
feet and published in the city's official newspaper.

CONVEYING, SELLING OR EXCHANGING CITY LAND-'
Sec. 94-381. Abandoning and vacating city streets, alleys or easements; administrative
charges assessed.
There is assessed a minimum administrative fee of $200.00 for the abandoning and vacating of city streets,
alleys or easements. If the director of planning determines that such minimum fee is not adequate to cover the
actual administrative time and expense required for a particular abandonment and vacation, the director of
planning shall calculate a reasonable administrative fee which is adequate to cover such time and expense.

Sec. 94-382. Application; procedure.
Any person desiring to have a city street, alley or easement abandoned and vacated shall make application
for the same to the director of planning. The application shall be accompanied by the following:
(1) The signed and acknowledged written consent and release of all owners (Including lessees) of all
property which abuts on either side of the street, alley or easement proposed to be abandoned.
(2) The signed and acknowledged written consent and release of all owners (including lessees) of all
property to which access would be materially and substantially impaired if the proposed abandonment
is granted.
(3) Administrative fee as provided in section 94-381.
(4) Title report issued by a title insurance company acceptable to the city identifying abutting ownership.

Sec. 94-383. Requirements and effect of abandonment and vacation.
(a) No street, alley or easement shall be abandoned and vacated unless the city council determines in the
abandoning ordinance that abandonment and vacation is for a public purpose and is in the public interest,
and all requirements of this article and all other applicable ordinances and laws are satisfied. Whenever a
street, alley or easement is to be abandoned, the abandoning ordinance shall provide that the property to be
abandoned shall be sold or revert to the abutting property owners in proportion to their abutting ownership.
(b) Before such ordinance shall be considered by the city council, the following must occur:

by a title company acceptable to the city. Such ordinance shall provide for an equitable manner of
determining the division between owners. Such ordinance shall further provide that the mayor shall be

in proportion to their abutting ownership as shown in such report and with division between owners in the

made in an equitable manner. As required by V.T.C.A., Local Government Code § 253.001, the proceeds of
any sale of abandoned parts of streets or alleys or of a public square, park or site for city hall or other
municipal building shall be used only for the acquisition and improvement of property for the same uses as
that so sold.
(d) Any conveyance, sale or exchange of any land or interest in land owned by the city which is not made under
the exemptions in V.T.C.A., Local Government Code § 272.001(b) shall be subject to the bid procedures and
publication requirements set forth in V.T.C.A., Local Government Code § 272.001(a). Any sale of any right,
title or interest in city property must comply with section 7 of article XIV of the City Charter.
