Meeting
Norris Simon began the meeting at 5:30 p.m.
The 1st Abandonment was heard;
■ Ms. Queen made a statement about parking. She indicated that she was concerned
that there were no parking areas for the general public.
• Ryan Miller of Motiva stated that they did have a parking plan the could be discussed
at a later time, but this was not apart to the abandonment before the commission
today.
• Mr. Wagner had concerns about properties being taken from the citizens. He
indicated that Mr. Kelly, who was not in attendance at this meeting, stated at the last
meeting that he would lose business. But he thought that Mr. Kelly's business would
be enhanced due to the fact that 250 people moving into the area would benefit his
business.
• Ms. Queen stated that Mr. Kelly said that his business would only be reduced to
catering.
Mr. Simon closed the meeting and a vote was called and the Commission voted 3:1 in favor
of the abandonment.
The 2nd abandonment was heard:
• Ms. Queen stated that it was indicated at the last meeting that citizens stated that
there are children playing on the pipes and was using it as a playgroun
• Mr. Ryan Miller of Motiva stated that there would be fencing placed around the area,
to help protect the area.
• Mr. Wagner asked about the fencing type.
Mr. Simon closed the meeting and a vote was called and the Commission voted 4:0 for
approval of the abandonment.
The Re -Plat was heard:
• Larry Badon explained what the re -plat was all about.
• The applicant, Mr. Jose Zuniga, (2131 Lavender Street) spoke in favor of the re -plat
and said that he was trying to build a residence and some accessory building on the
property.
• Mr. Badon stated the property had several buildings on the property that was located
across property lines, and applicant was trying to clean it up.
• Ms. Carol Broussard, 6683 Garnet Street, spoke against the re -plat and stated that
there were Mexicans living on the property and that a 16-wheeler had come on the
property with lumber and left the next day.
• Mr. Zuniga stated that there were no people staying on the property.
• Mr. Badon stated the this was a Low -Density Residential district and that only single-
family structures could be built on the property. He also indicated that there were
other issues associated with the property and these would be looked at a later date,
and that the zoning officer had already contacted Mr. Zuniga to take care of other
issues. He also stated that this was only a simple re -plat and that was what the
Commission is supposed to vote on.
Mr. Simon closed the discussion and the commission voted 4:0 to approve the re -plat.

BACKGROUND INFORMATION:

2023.
THE PURPOSE OF THIS REPLAT IS TO COMBINE MULTIPLE LOTS INTO 1 LOT FOR REMODEL & LEASE OF
EXISTING BUILDING.
In accordance with Chapter 98, Article III, Section 98-153, the Commission shall render a decision
within 30 days of receipt of the plat from the director of Planning, together with a
recommendation and in compliance with the applicable requirements of V.T.C.A., Local
Government Code, Sections 212.014 thru 212.016. Such decision shall consist of approval or
denial.
PUBLIC NOTICE:
On Friday, October 13, 2023, three (3) notices were mailed to adjacent property owners within a
200 ft. Radius and published in the Port Arthur Newspaper a minimum of fifteen (15) days before
the P & Z public hearing scheduled for October 30, 2023

An application was filed with the Planning and Zoning Commission on or around September 18, 2023,
requesting a zoning map amendment to INCLUDE the zoning use type "Automobile repair, major," for
the development of a collision repair shop.
The pre -development meeting was conducted on August 9, 2023. Participants included the
Representatives from the City's Planning and Zoning Division, Chief Building Official, Sanitarian, Solid
Waste Division, Regulatory Services, Engineering Division, and the Fire Marshal's Office.
A Representative from Drainage District No. 7 was in attendance, as well as client representation from
Goree Architects.
Information regarding the development was provided to the developer and or their representative,
along with contact information if additional guidance is needed.
Any person or corporation having a proprietary interest in any property may petition the City Council
for a change or amendment to the provisions of this ordinance. The Planning and Zoning Commission
may, on its own motion or on request from the City Council, institute a study and proposal for changes
and amendments in the public interest.
A Zoning Map Amendment (Rezoning) is a change or modification to the boundaries of any zoning
district within the Zoning District Map.
ANALYSIS:
Section 203(A) of the Zoning Ordinance provides district regulations for development in said district.
ACCESS:
The project entrance(s) are located on Medical Center Boulevard.
PUBLIC NOTICE:
On Friday, September 15, 2023, six (6) notices were mailed to adjacent property owners within a 200
ft. Radius and published in the Port Arthur Newspaper a minimum of fifteen (15) days before the P&Z
public hearing scheduled for October 2, 2023. As of September 29, 2023, the office of Planning &
Zoning has not received any letters of opposition.

RECOMMENDED ACTION:
Per Local Government Code Section 211.007, the Planning and Zoning Commission shall make a
preliminary report and hold a public hearing before submitting a final report to the City Council with
a recommended action.
