RE: P.R. 23533 —Executing change order No. i to the contract between the City of
Port Arthur and Kraftsman Commercial Playgrounds and Water Parks,
decreasing the contract amount by$20,992.74 to a new contract total of
$728,965.01 for the construction of a playground at 1520 West TB Ellison
Pkwy(Lakefront Park)on Pleasure Island
Introduction:
The intent of this Agenda Item is to request the City Council's approval of P. R. No. 23533
authorizing the City Manager to execute change order No. 1 to the contract between the City
of Port Arthur and Kraftsman Commercial Playgrounds and Water Parks of Spring, Texas,
decreasing the contract amount by $20,992.74 to a new contract total of$728,965.01 for the
construction of a playground at 1520 West TB Ellison Pkwy (Lakefront Park) on Pleasure
Island.
Background:
Pursuant to Resolution No. 22-574,the City of Port Arthur awarded a contract to Kraftsman
Commercial Playgrounds and Water Parks to construct a playground at Lakefront Park on
Pleasure Island. Initially,the contractors planned to use a concrete base, however, they
realized that the ground was in better condition than they thought, so they used base materials
instead. The construction of the playground is complete, a comprehensive safety inspection of
equipment, under the Consumer Product Safety Commission's guidelines has been completed
and certification of compliance was completed by a National Playground Safety Inspector.
Budget Impact:
None
Recommendation:
It is recommended that the City Council approve P.R.No.23533 authorizing the City Manager
to execute change order No. 1 to the contract between the City of Port Arthur and Kraftsman
Commercial Playgrounds and Water Parks of Spring, Texas, decreasing the contract amount
by $20,992.74 to a new contract total of$728,965.01 for the construction of a playground at
1520 West TB Ellison Pkwy(Lakefront Park) on Pleasure Island.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN
THE CITY OF PORT ARTHUR AND KRAFTSMAN COMMERCIAL
PLAYGROUNDS AND WATER PARKS OF SPRING, TEXAS,
DECREASING THE CONTRACT AMOUNT BY $20,992.74 TO A
NEW CONTRACT TOTAL OF $728,965.01 FOR THE
CONSTRUCTION OF A PLAYGROUND AT 1520 WEST TB
ELLISON PKWY (LAKEFRONT PARK) ON PLEASURE ISLAND
WHEREAS, per Resolution No. 22-574, the City Council awarded a contract to
Kraftsman Commercial Playgrounds and Water Parks through BuyBoard Cooperative
Purchasing Program Contract Number 679-22, for the construction of a playground at 1520 West
T.B. Ellison Pkwy (Lakefront Park) in the total amount not to exceed $749,957.75; and,
WHEREAS, during the construction, Kraftsman Commercial Playgrounds and
Water Parks did not use concrete as a base for the playground and used base materials instead
which resulted in a decreased amount of$20,992.74; and
WHEREAS, Change Order No. 1 (attached hereto as Exhibit "A") has been
submitted to reflect the decreased amount which resulted in the new total contract amount of
$728,965.00; and,
WHEREAS, the construction of the playground at Lakefront Park on Pleasure
Island has been completed and a comprehensive safety inspection of equipment under the
(CPSC) Consumer Product Safety Commission's guidelines and certification of compliance with
(NPSI)National Playground Safety Inspector as delineated in Exhibit"B"; and,
WHEREAS, staff recommends that the City Council authorize the City Manager to
execute Change Order No. 1 decreasing the contract amount by $20,992.74 to a new total
contract amount of$728,965.00; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS:

Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager of the City of Port Arthur is hereby
authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 1, to
delete the using of concrete as a base for the playground at 1520 West TB Ellison Pkwy, thereby
decreasing the contract amount by $20,992.74, for a new total contract amount of$728,965.01
and authorize the remaining final payment to Kraftsman Commercial Playgrounds and Water
Parks of Sping, Texas.
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.

Installation of Playground Structure
Dear Mr. George Davis,
I conducted a complete safety inspection of equipment under CPSC (Consumer Product Safety
Commission Guidelines) and certification of compliance with NPSI (National Playground Safety
Inspector Criteria). The review was conducted for components, structural integrity, functional
integrity, and general safety criteria.
The unit was found to be installed in compliance per the manufacturers' instructions.
