ZONE CHANGE REQUESTZ23-10 MK Constructors Department of Development ServicesDivision of Planning REQUEST… City Council is being asked to consider a ZoningChangeforapproximately21.308 acres (928,176SF)of land out of and a part of the W.Kyle Survey,Abstract No.414,and consisting of all of Lots 10-25,Block 27,unimproved portions of Oleander,Violet,Gardenia,Camellia,Cox,Daisy,&WillowStreetsright-of-way,a portion of Blocks 25 &26,and All of Blocks 14,15,&16 of the unrecordedPalomarAddition,Section 1 Subdivision Plat,intheCityofPortArthur,Jefferson County,Texas. The property is located south of Texas-93 Spur[A.K.A West Port Arthur Road]between ShirleyStreetand58thStreet,Port Arthur,JeffersonCounty,Texas. PURPOSE… The purpose of this request is to change the zoningfrom“HDR”High-Density Residential (Formerlyreferredtoas“MF”Multi-Family)to “CR”Commercial Retail (Formerly referred to as “LC”Light Commercial)for the development of a park &ride facility. BACKGROUND… November 09, 2023 –The application for the zoning request was submitted to the Planning Division. November 17, 2023 -notification sent to adjacent property owners within 200 ft. November 18, 2023 –Public Notice published in Port Arthur Newspaper. The Planning and Zoning Commission (P&Z) met in a Regular Session to conduct a public hearing on December 4, 2023, at 5:30 p.m. The Planning Commission voted 3:1 recommending to deny said request. On November 28, 2023, -City Council approved Res. No. 23-513, calling for a public hearing. December 30, 2023 -Notification was published in the Port Arthur Newspaper and mailed to adjacent property owners on January 9, 2024. CURRENT/PROPOSED ZONING Current Zoning : High Density Residential (HDR) – Is to establish areas appropriated formultiple-family dwellings. Proposed Zoning: Commercial Retail (CR)- The purpose of the Commercial Retail District is to provide a location for light commercial and retail activities. These locations are typically along major thoroughfares and highways. ZONING DESIGNATION CONCEPTUAL RENDERING 1 AERIAL VIEW VIEW OF PROPERTY SOUTH OF TEXAS-93 SPUR[A.K.A WEST PORT ARTHUR ROAD] VIEW OF PROPERTIES ACROSS THE STREET PUBLIC COMMENT… In accordance with Texas Local Government Code Sections 211.006 and 211.007, a public hearing was scheduled on the following dates/times to receive public comment: •P&Z Commission: December 4, 2023, at 5:30 p.m. •Written Opposition: 0 •Verbal Opposition: 1 •Letter Returned:0 •City Council: January 16, 2024, at 06:00 p.m. •Written Opposition: 0 •Verbal Opposition: N/A •Letter Returned:1 A City Council may approve or deny the proposed matter by a simple majority vote. In the event, however, that a proposed change to a regulation or boundary is denied by the Planning & Zoning Commission, then the proposed change must be approved by at least three fourths (3/4) of all members of the City Council who are qualified to vote.
