R. #23562 Introduction: The intent of this Agenda Item is to seek the City Council's approval of P. R. #23562 to rescind the sub- recipient agreement with IBN Sina Foundation and reallocate the $11,258.00 in funding to the City's Housing and Neighborhood Revitalization Division-Demolition/Reconstruction projects to accommodate families that are participating in the demolition and reconstruction program construction. Background: The Department of Housing and Urban Development allocated $1,042,808 in Community Development Block funds to Port Arthur for Program Year 2023. The Grant funds were allocated to projects that benefit low or moderate-income neighborhoods or households. Resolution 23-389 allocated $11,258.00 to the non-profit organization IBN Sina Foundation. However, IBN Sina Foundation has notified the City that its board has decided to close the Port Arthur clinic effective December 1, 2023. Staff Recommendation: The staff recommends the city manager to rescind the 2023 Community Development Block Grant(CDBG) nonprofit sub-recipient agreement with IBN Sina Foundation for the funding amount of$11,258.00 and further authorize an amendment to the Interdepartmental Agreement with the City's Housing and Neighborhood Revitalization Division to reallocate said funds to demolition and reconstruction projects. Budget Impact: Community Development Block Grant is the funding source. Account number 105-13-033-5470-00-40-000; Project CD23104.GRE.00S (IBN Sina Foundation), account number 105-13-033-5420-00-40-000; CD23115 (Demolition and Reconstruction Program). Essex Page 1 RESOLUTION NUMBER A RESOLUTION AUTHORIZING THE CITY MANAGER TO RESCIND THE 2023 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) NON-PROFIT SUBRECIPIENT AGREEMENT WITH IBN SINA FOUNDATION FOR THE FUNDING AMOUNT OF $11,258.00 AND FURTHER AUTHORIZE AN AMENDMENT TO THE INTERDEPARTMENTAL AGREEMENT WITH THE CITY'S HOUSING AND NEIGHBORHOOD REVITALIZATION DIVISION TO REALLOCATE SAM FUNDS TO DEMOLITION AND RECONSTRUCTION PROJECTS. WHEREAS, pursuant to Resolution 23-389, the City approved a non-profit subrecipient agreement with IBN Sina Foundation allocating$11,258.00 of 2023 CDBG funding for healthcare services to low and moderate-low-income residents; and, WHEREAS,Resolution 23-389 also authorized an interdepartmental agreement with the Housing and Neighborhood Revitalization Division which allocated CDBG funding to Demolition/Reconstruction Projects, Infrastructure Activities and Housing and Neighborhood Revitalization Programs; and, WHEREAS, the IBN Sina Foundation Board has notified the City of their decision to close the Port Arthur clinic effective December 1, 2023 (see Attachment"A"); and, WHEREAS, city staff recommends rescinding the subrecipient agreement with IBN Sina Foundation and reallocate the $11,258.00 in funding to the City's Housing and Neighborhood Revitalization Division - Demolition/Reconstruction projects to accommodate families that are participating in the demolition and reconstruction program; and, WHEREAS, it is now deemed necessary to amend the interdepartmental agreement(Attachment "B")with the City's Housing and Neighborhood Revitalization Division to reflect the additional allocation of$11,258.00 to Demolition/Reconstruction projects. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: THAT,the 2023 CDBG non-profit sub-recipient agreement with IBN Sina Foundation is hereby rescinded,and the funding in the amount of$11,258.00 will be reallocated to assist clients in the Demolition and Reconstruction Housing Assistance Program. THAT, the City Manager is hereby authorized to rescind and amend the contracts to reflect the reallocation of the 2023 CDBG Funds. THAT,a copy of the caption of this Resolution be spread upon the minutes of the City Council. READ,ADOPTED,AND APPROVED this_ day of A. Essex Page 4 ATTACHMENT "B" INTERDEPARTMENTAL AGREEMENT (AMENDMENT NO. 1) This is the first amendment to the Interdepartmental Agreement between the City of Port Arthur and the Housing and Neighborhood Revitalization Division.The parties entered into the original agreement via Resolution 23-389. PURPOSE This Interdepartmental Agreement provides 2023 Community Development Block (CDBG) funds to the Housing Assistance Division for administering the Housing Assistance Programs. II. TIME OF PERFORMANCE The Time of Performance under this Agreement shall begin September 27,2023, and end on September 26, 2024. III. SERVICES PROVIDED The Housing Assistance Division shall provide housing services to low and moderate-income families of Port Arthur,Texas. IV. BUDGET A. Two Hundred Eighteen Thousand and No/100 Dollars($220,000)will assist with administrative/activity delivery costs for four(4) staff to administer the Housing Assistance Programs for Port Arthur,Texas's low and moderate-income persons/families.The Programs provide emergency/minor repairs and rehabilitation, demolition and reconstruction of owner-occupied housing units, and down payment and closing costs assistance for eligible homebuyers to purchase existing or new construction homes. B. The budget of Five Hundred Fifty-Six Thousand Two Hundred Fifty-Eight ($556,258)-will provide for the demolition and reconstruction of four(4) owner-occupied housing units for low and moderate-income families in Port Arthur,Texas. C. The budget amount of Thirty Thousand and No/100 Dollars($30,000)will assist an eligible Sub-recipient and Community Housing Development Organization (CHDO) with infrastructure-related activities (installation of sidewalks, driveways,water/sewer lines, 60/40 dirt mix, Etc.) relating to the new construction of single-family houses for the low and moderate-income families of Port Arthur,Texas. V. PROGRAM STANDARDS Projects undertaken must directly benefit low and moderate-income persons/families, or the project must benefit a low and moderate-income area of the City of Port Arthur. VI. PROGRAM REQUIREMENTS The Program receiving funds under this Agreement must comply with the City of Port Arthur Procurement Procedures and 24 CFR 570 and 2 CFR Part 200. VII. PERFORMANCE STANDARDS The Housing Assistance Division shall perform the work specified in this Agreement reasonably and prudently. VIII. REPORTS Monthly reports are due by the 28th day of each month and include the number of persons served by race and income. IX. AMENDMENTS Any amendments to this Agreement must be made in writing and approved by both parties.
