RE: P.R. No. 23542 — Resolution authorizing the City Manager to enter into an
agreement with Construction Zone of Southeast Texas, LLC of Nederland,
Texas for the construction of the City of Port Arthur Animal Services Building,
to be located at 3615 Gates Boulevard
Introduction:
The intent of this Agenda Item is to seek approval from City Council for P.R. No. 23542,
authorizing the City Manager to enter into an agreement with Construction Zone of Southeast
Texas, LLC of Nederland, Texas, for construction of the City of Port Arthur Animal Services
Building, to be located at 3615 Gates Boulevard, Port Arthur, Texas. The contract is in the
amount of$7,365,000.00, which includes a$300,000 contingency fund.
Background:
Pursuant to Resolution No. 22-564, the City Council authorized the City Manager to enter into
a contract with PGAL, Inc. of Houston, Texas to provide professional architectural project
design and construction administration phase services for the City Animal Shelter being
relocated to the former Christus St. Mary Hospital Campus, 3600 Gates Boulevard,Port Arthur,
Texas in an amount not to exceed $783,800.00.
Certificates of Obligation were approved for the construction project through the following
actions: (1) Ordinance Number 21-38: On May 19, 2021, City Council authorized the issuance
and sale of Certificates of Obligation,Series 21,in a principal amount not to exceed$32,900,000,
which includes $6.65 Mil for the construction of a new animal shelter (presentation September
28, 2021). (2) Ordinance Number 23-30: On August 15, 2023, City Council authorized the
issuance and sale of Certificates of Obligation, Series 23, in a principal amount not to exceed
$25,500,000, which includes an additional $3 Mil for the construction of a new animal shelter
due to inflation. (3) Ordinance Number 23-50: On October 24, 2023, City Council approved an
. ordinance declaring an intent of the City of Port Arthur to reimburse itself from proceeds of
Certificates of Obligation expected to be issued by the City to cover expenditures paid in
connection with City Projects, including Animal Control.

Budget:
Funding is available in Account No. 307-21-049-8512-00-10-000, Project No. BU0008.
Recommendation:
It is recommended that City Council approve P.R. No. 23542, authorizing the City Manager to
enter into an agreement with Construction Zone of Southeast Texas of Nederland, Texas, for
construction of the City of Port Arthur Animal Services Building, to be located at 3615 Gates
Boulevard, Port Arthur, Texas. The contract is in the amount of$7,365,000.00, which includes
a$300,000 contingency fund.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH CONSTRUCTION ZONE OF
SOUTHEAST TEXAS, LLC OF NEDERLAND, TEXAS, FOR THE
CONSTRUCTION OF THE CITY OF PORT ARTHUR ANIMAL
SERVICES CENTER BUILDING,TO BE LOCATED AT 3615 GATES
BOULEVARD, PORT ARTHUR, TEXAS, IN THE AMOUNT OF
$7,365,000.00; FUNDING AVAILABLE IN CAPITAL
PROJECTSBUILDINGS ACCOUNT NO. 307-21-049-8512-00-10-000;
PROJECT NO.BU0008.
WHEREAS, the City of Port Arthur desires to construct an Animal Services Center
building,to be located at 3615 Gates Boulevard,Port Arthur, Texas; and,
WHEREAS, pursuant to Resolution No. 22-564, the City Council authorized the City
Manager to enter into a contract with PGAL of Houston, Texas, in an amount not to exceed
$783,800.00, to provide professional architectural project design and construction phase services
for the construction of the Animal Services Center building to be relocated to the former Christus
St. Mary Hospital Campus at 3615 Gates Boulevard, Port Arthur, Texas; and,
WHEREAS, Certificates of Obligation were approved for the construction project; and
WHEREAS, the City's Purchasing Department advertised in the Port Arthur News on
October 28, 2023, and November 4, 2024, for the construction of the Animal Services Center
building; and,
WHEREAS,competitive sealed bids were opened from companies submitting bids for the
construction of the Animal Services Center Building on December 6, 2023; and,

WHEREAS, PGAL of Houston, Texas, examined the bids and determined that
Construction Zone of Southeast Texas, LLC of Nederland, Texas, is a certified contractor and
is the lowest and most responsive bidder in the amount of$7,365,000.00, as delineated in the bid
tabulation dated December 18, 2023, attached as Exhibit "A", and their recommendation letter is
attached as Exhibit"B"; and,
WHEREAS, the City of Port Arthur desires to enter into a contract with Construction
Zone of Southeast Texas, LLC of Nederland, Texas, a certified contractor, in substantially the
same form as attached hereto as Exhibit "C", for the construction of the Animal Services Center
Building,to be located at 3615 Gates Boulevard, Port Arthur, Texas.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct.
THAT, the City Manager is hereby authorized to enter into an agreement with
Construction Zone of Southeast Texas,LLC of Nederland, Texas, for the construction of the
Animal Services Center building in the amount of$7,365,000.00, in substantially the same form
as attached as Exhibit"C".
THAT, funding is available from Capital Projects/Buildings Account No. 307-21-049-
8512-00-10-000.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

AUSTIN On Wednesday, December 6th, 2023, sealed bids were opened for the above-
BOCA RATON referenced project. There were a total of six(6) bidders.
CHICAGO
DALLAS/FORT WORTH
DENVER Based on the bids received, the bidders were evaluated based on the price and
HOBOKEN qualifications. Based on the evaluations, it is our recommendation that the project be
HOUSTON awarded to Construction Zone of Southeast Texas, as they were both the apparent low
LAS VEGAS bidder and had all the corresponding documents. PGAL does not have recent
LOS ANGELES experience working with Construction Zone of Southeast Texas. We were able to check
SALT LAKE CITY
SAN DIEGO some of their references and overall, those that we spoke to had a positive experience
working with them. It appears that they are an established company and have adequate
resources to complete the work.
Please feel free to give me a call to discuss this recommendation. We appreciate the
opportunity to provide continued service to the City of Port Arthur.
