Background: Resolution No. 22-147 awarded the Main Wastewater Plant(WWTP) Improvement Project to ALLCO, LLC of Beaumont, Texas for the total amount of$73,643,227.00. The construction phase is managed by Freese&Nichols, Inc. On August 2, 2022, Resolution No. 22-329, approved Change Order No. 1 for value engineering performed by Freese &Nichols, Inc., ALLCO, LLC, Golden Triangle Consulting Engineers, and the City of Port Arthur staff in the deduction amount of$6,234,049.00. On December 20, 2022, Resolution No. 22-586, approved Change Order No. 2 including, Primary Clarifiers subgrade stabilization,Drying Beds demo,Demo and Remove CSS,Helical Piles, and Brentwood PVC TF Media price increase and reduction for the removal of VE Lighting Package, use of bank sand for pipe bedding, and remove Admin Building improvements in the deduction amount of$73,564.57 and 75-day time extension with a final project end date of December 17, 2026. r On December 19,2023,Resolution No.23-556,approved Change Order No. 3 for an increased amount of$114,851.00 to replace 4 Trickling Filter Effluent Butterfly Valves with Slide Gates and add an expansion joint to Aeration Basin Buttress Wall. Water Utilities is providing notice to City Council of a possible potential Change Order No. 4 that will increase the current contract amount by approximately $5,650,000.00 to replace the failed 30"force main from Main Outfall Lift Station(MOLS)to the Main WWTP Headworks with a new 42" ductile iron pipe. Budget Considerations: The original contract price is $73,643,227.00 Change Order No. 1 decreased the contract amount by $6,234,049.00 Change Order No. 2 decreased the contract amount by $73,564.57 Change Order No. 3 increased the contract amount by $114,851.00 Proposed Change Order No. 4 for approximately $5,650,000 will increase the new total contract amount to new projected total amount of$73,100,464.43. The funding is contingent upon the approval of a budget amendment via Proposed Ordinance 7229 for Account No. 405-40-000-8516-00-00-000, Project No. WS0023 Recommendation: Recommend City Council approve PR No. 23642 to authorize the City Manager to proceed with a proposed Change Order No. 4 as specified in the attached Emergency Memo dated February 14, 2024 with ALLCO, LLC of Beaumont, Texas, as described/outlined above. A RESOLUTION REQUESTING AUTHORIZATION FOR THE CITY MANAGER TO PROCEED WITH A POTENTIAL FUTURE CHANGE ORDER NO. 4 TO THE MAIN WASTEWATER TREATMENT PLANT IMPROVEMENT PROJECT WITH ALLCO, LLC OF BEAUMONT, TEXAS, THAT WILL INCREASE THE CONTRACT BY APPROXIMATELY $5,650,000.00 TO A NEW TOTAL PROJECTED BUDGETARY CONTRACT AMOUNT OF $73,100,464.43; FUNDING IN ACCOUNT NO. 405-40-000-8516-00-00-000, PROJECT NO. WS0023 IS CONTINGENT UPON THE APPROVAL OF A BUDGET AMENDMENT VIA ADOPTION OF PROPOSED ORDINANCE 7229 WHEREAS, the City Council approved Resolution No. 22-147, awarding the Main Wastewater Treatment Plant Rehabilitation project to ALLCO, LLC of Beaumont, Texas; and, WHEREAS,on August 2,2022,Resolution No. 22-329, approved Change Order No. 1 to reduce the contract amount by $6,234,049.00 for Value Engineering performed by Freese & Nichols, Inc., ALLCO, LLC, Golden Triangle Consulting Engineers and the City of Port Arthur staff for a new contract amount of$67,409,178.00; and, WHEREAS,on December 20,2022,Resolution No. 22-586, approved Change Order No. 2 for a decreased amount of $73,564.57 including, Primary Clarifiers subgrade stabilization, Drying Beds demo, Demo and Remove CSS, Helical Piles, and Brentwood PVC TF Media price increase and reduction for the removal of VE Lighting Package, use of bank sand for pipe bedding, and remove Admin Building improvements and add 75-day time extension with a final project end date of December 17, 2026; and, WHEREAS,on December 19,2023,Resolution No. 23-556, approved Change Order No. 3 for an increased amount of$114,851.00 to replace 4 Trickling Filter Effluent Butterfly Valves with Slide Gates and add an expansion joint to Aeration Basin Buttress Wall; and, WHEREAS, Water Utilities Department is providing notice of potential future Change Order No. 4 for an approximate contract price increase of$5,650,000.00 to replace the failed 30" P.R. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to proceed with the future Change Order No.4 as delineated in the Emergency Memo dated February 14, 2024 (Attachment "A"), for an approximate cost of $5,650,000.00 with ALLCO, LLC of Beaumont,Texas for the Main WWTP Improvements project,to a new approximate total projected budgetary amount of$73,100,464.43; and, THAT, funding for this project will be contingent upon a budget amendment via adoption of Proposed Ordinance 7229 for Account No. 405-40-000-8516-00-00-000, Project No. WS0023; and, THAT, Change Order No. 4, it its entirety, will be submitted to City Council for final approval; and THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Clifto Williams, ( PPB Water Utilities Director Purchasing Manager ATTACHMENT A (EMERGENCY MEMO DATED FEBRUARY 14,2024) ern.,,, a _ art rthur`�� Ti,rus INTEROFFICE MEMORANDUM Date: February 14,2024 To: Ronald Burton, City Manager 4/1/ From: Calvin Matthews, P.E., Water Utilities Director RE: Emergency Contract for Design and Construction of Replacement Force Main at Main Outfall Lift Station The Main Outfall Lift Station (MOLS) is connected to the Main WWTP through an existing 30" and a 36" force main. The current upgrades to the Main WWTP and MOLS required the MOLS to be bypassed using the 30"force main to allow the 36"line to be removed from service during upgrades. The 30" line failed when the bypass pumps were energized and upon inspection was found to have deteriorated beyond use. The failure of the 30" line leaves the MOLS dependent upon the single 36" force main which does not have enough capacity to handle the permitted peak flow of the Main WWTP and the line is 50 years old and beyond its expected useful life. If the 36" line were to fail the full flow of sewage to the Main WWTP would have to be discharged into the DD7 canal to prevent overflows throughout the City especially in the area around Duff Drive between Lakeside Drive and Lewis Drive. This situation would continue until a replacement line could be procured and installed which could take 4 to 6 months. Due to the health and safety risk associated with a failure of the main in addition to potential fines, we request approval to issue a change order to ALLCO, LLC under the Main WWTP Improvements contract for the engineering and construction of a 42" parallel force main with associated connections. The expenditure for the engineering and pipe replacement is expected to be approximately $5,650,000.00. I Ronald Burton,hereby approve the emergency change order to ALLCO, LLC.
