On February 13, 2024, staff from the Water Utilities Department notified the Finance Department that the force main that conveys wastewater from the Main Outfall Lift Station to the Main Wastewater Treatment Plant needs emergency replacement. Background: The FY 23-24 budget was approved on August 29, 2023 by Ordinance No. 23-34. Budget Amendment 1 passed on October 24, 2023 as Ordinance No. 23-47. Budget Amendment 2 passed on January 30, 2024 as Ordinance No. 24-05. Budget Amendment 3 passed on February 13, 2024 as Ordinance No. 24-06. This is the fourth budget amendment requested for this budget year. Budget Impact: The above request will increase the appropriation, by decreasing the fund balance in the Capital Budget by $5,650,000.00. Recommendation: It is recommended that City Council approve this proposed ordinance as presented, amending the budget as discussed/outlined above. AN APPROPRIATION ORDINANCE AMENDING THE CITY OF PORT ARTHUR BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1,2023 AND ENDING SEPTEMBER 30, 2024, BY INCREASING THE APPROPRIATION FOR THE CAPITAL BUDGET BY$5,650,000.00. WHEREAS,in accordance with Article XII, Section 9, of the City Charter,the City Council may make emergency appropriations from time to time; and, WHEREAS, the City Council may make budget amendments for emergencies under Section 102.009 Local Government Code; and, WHEREAS,on August 29,2023,the City Council approved and adopted Ordinance 23-34,which appropriated the 2023-2024 budget; and, WHEREAS, on October 24, 2023, the City Council approved and adopted Ordinance 23-47, which amended the appropriation of the 2023-2024 budget; and, WHEREAS, on January 30, 2024, the City Council approved and adopted Ordinance 24-05, which amended the appropriation of the 2023-2024 budget; and, WHEREAS, on February 13, 2024, the City Council approved and adopted Ordinance 24-06, which amended the appropriation of the 2023-2024 budget; and, WHEREAS, on February 13, 2024, Water Utilities staff advised the Finance Department of the need for emergency replacement of the 42" force main that conveys sewer from the Main Outfall Lift Station to the Main Wastewater Treatment Plant. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. P. O. That the following Budget be increased as shown: Capital Budget $5,650,000 Original Third Amended Amended Budget Fourth Amended Budget Appropriation No. 4 Appropriation Capital Budget 40,460,000 55,874,500 5,650,000 61,524,500 Total 5,650,000 61,524,500 Section 3. That Section 14 of Ordinance 23-34 is amended to read: That there be, and is hereby appropriated, the sum of Sixty-One Million, Five Hundred Twenty- Four Thousand, Five Hundred Dollars ($61,524,500) to the Capital Budget for the payment of improvements to City infrastructure,roads and other capital outlay. Section 4. That a copy of the caption of this Ordinance be spread upon the minutes of the City Council. Section 5. That this Ordinance shall be effective immediately.
