A RESOLUTION SETTING PUBLIC HEARING DATES AS IT PERTAINS TO THE DISANNEXATION OF FOUR PARCELS OF LAND BEING APPROXIMATELY 11.59 ACRES LOCATED ALONG STATE HIGHWAY 87 NEAR TAYLOR'S BAYOU AND TO PROVIDE NOTICE OF THE PUBLIC HEARINGS TO PROPERTY OWNERS,AGENCIES, UTILITIES, AND RAILROADS PURSUANT TO SECTION 43.062 OF THE TEXAS LOCAL GOVERNMENT CODE. WHEREAS, on February 9, 2024, the City of Port Arthur received an official letter requesting to disannex property located within the corporate limits of Port Arthur,Texas, as described in the attached Exhibit "A"; and WHEREAS, pursuant to the Texas Local Government Code Section 43.142 and City of Port Arthur Charter Article I, Section 6(B), the City may disannex the property; and WHEREAS, two public hearings are required with due notice as in the same manner as provided by law for the annexation of territory before disannexing the territory; and WHEREAS, Section 43.062 of the Texas Local Government Code, the City must also provide notice of the public hearings to property owners, agencies, utilities, railroads at least thirty (30) days prior to the first public hearing. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the dates of the publication of the Notice in the newspaper will be March 16, 2024 and March 23, 2024, and as otherwise required by law. Section 3. That public hearings for the disannexation will be held on April 9, 2024 at 6:00 p.m. and on April 23, 2024 at 10:00 a.m. Section 4. That the City has sent notice to all property owners, including railroad companies, agencies, and utilities that may own land in the area by certified mail, return receipt requested. This includes, but is not limited to, sending notice to the Kansas City Southern Railroad Company, the Southern Pacific Railroad Company (now known as Union Pacific Railroad), Entergy Services, Inc., Southwestern Bell (now known as AT&T Southwest) and Texas Gas Service, a division of ONEOK, Inc. (formerly Southern Union Gas), Port Arthur Independent School District, and Sabine Pass Independent School District. Section 5. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Tizeno City Attorney CITY OF PORT ARTHUR 444 4°i Street Port Arthur,Texas 77640 RE: Request for de-annexation by GT Logistics, LLC; Our File No.: 12420.0002 Dear Val: On behalf of GT Logistics, LLC, and further to our recent discussions with Mr. Burton, Mr. Tran, Mr. Thigpen and Ms. Langford, we hereby formally request de-annexation of the following parcels of property that are located in the limits of the City of Port Arthur, and upon which a portion of GT Logistics' proposed Blue Ammonia Terminal Project will be located in the event that project goes forward: Property ID 140857 Property ID 245643 Property ID 245644 Property ID 420193 GT Logistics is requesting de-annexation for the purpose of entering into a limited-term Industrial Agreement with the City of Port Arthur in connection with that portion of the proposed Blue Ammonia Terminal Project that will be situated on the above parcels. We are enclosing a parcel map that outlines the area contained in the above parcels,along with details of the above parcels we obtained from the Jefferson Central Appraisal District.
