RE: PR No. 23593 —Authorizing the City Manager to accept grant funds in the amount of
$1,931,696.00 from the United States Department of Transportation (USDOT) for the
FY 2023 Safe Streets and Roads for All(SS4A)Funding Appropriations.
Introduction:
The intent of this agenda item is to seek the City Council's approval to authorize the City Manager to
accept federal grant funds in the amount of $1,931,696.00 from the United States Department of
Transportation (USDOT) for the FY 2023 Safe Streets and Roads for All (SS4A) Funding
Appropriations.
Background:
The USDOT has a Safe Streets grant funding program available for planning,design,feasibility studies,
infrastructure modifications, safety initiatives, collaboration incentives with local community and
industry groups, and development of systems that reduces crash severity and save lives. Its purpose is
to prevent death and serious injury on roads and streets involving all roadway users, including
pedestrians, bicyclists, public transportation, personal conveyance, motorists, and commercial vehicle
operators. Additionally, the program provides funding for tools and resources that strengthen a city's
approach to roadway safety that addresses the needs of diverse communities that are disadvantaged or
historically underserved. The City of Port Arthur's Public Works Department—Engineering Division
successfully pursued this funding and the City was awarded the amount of$1,931.696.00.
Pursuant to Resolution No. 23-233,the City of Port Arthur's City Council approved participation in the
USDOT SS4A Grant Funding Program and the local match of 20%. Additionally, the Engineering
Division has drafted a Comprehensive Action Plan for safe streets that outlines how the grant monies
will be utilized.

The total estimated project cost in the grant application is$2,414,620.00 where 80%of the cost is funded
by SS4A grant i.e., $1,931,696.00 and the remaining 20%i.e., $482,924.00 will be the local City share
needs to be funded by the City of Port Arthur.
Budget Impact:
Funds available in Account No. 001-00-000-4510-00-00-000. The City of Port Arthur's local match
of$482,924.00 will be contingent upon the approval of a budget amendment via adoption of Proposed
Ordinance No. 7230.
Recommendation:
It is recommended that the City Council approve PR No.23593 authorizing the City Manager to accept
grant funds in the amount of $1,931,696.00 from the United States Department of Transportation
(USDOT)for the FY 2023 Safe Streets and Roads for All (SS4A)Funding Appropriations.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT GRANT
FUNDS IN THE AMOUNT OF $1,931,696.00 FROM THE UNITED STATES
DEPARTMENT OF TRANSPORTATION (USDOT) FOR FY 2023 SAFE STREETS
AND ROADS FOR ALL (SS4A) FUNDING APPROPRIATIONS. LOCAL MATCH
OF $482,924.00 IN ACCOUNT NO. 001-00-000-4510-00-00-000 CONTINGENT
UPON APPROVAL OF A BUDGET AMENDMENT VIA ADOPTION OF
PROPOSED ORDINANCE NO. 7230.
WHEREAS, the City of Port Arthur applied for grant funds from the United States
Department of Transportation (USDOT) FY 2023 Safe Streets and Roads for All (SS4A) Funding
appropriations; and,
WHEREAS, the City of Port Arthur was successful in meeting all eligibility requirements and
was awarded federal grant funds in the amount of $1,931,696.00 from the USDOT under the
SS4A grant opportunity, see Exhibit A; and,
WHEREAS, pursuant to Resolution No. 23-233, the City of Port Arthur's City Council
approved participation in the grant funding program and its local match of 20%; and,
WHEREAS, the Public Works Department — Engineering Division has prepared a
Comprehensive Action Plan for the safe streets planning efforts that outlines how grant funds will
be utilized; Currently, the engineer's estimate for the total project cost is$2,414,620.00 where 80%
of the cost is funded by SS4A grant i.e., $1,931,696.00 and the remaining 20% i.e., $482,924.00
needs to be appropriated in Fiscal Year 2025 after the contract with US DOT is executed; and,
WHEREAS, this Notice of Funding Opportunity (NOFO) Assistance Listing No. is 20.939
under the Office of the Secretary of Transportation Action Item DOT-OST-2023-0048; and,
WHEREAS, the City was given the Notice of Award from the offices of the Department of
Transportation and United States Senator John Cornyn; and,

WHEREAS, the authorization of the City Manager to accept grant funding and execute all
necessary contracts and agreements from the USDOT SS4A Grant Program is herein deemed an
appropriate action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Council of the City of Port Arthur hereby authorizes and directs the City
Manager to accept federal funding in the amount of$1,931,696.00 from the USDOT Safe Streets
for All Funding Appropriations (SS4A); and,
THAT, the local match of $482,924.00 will be contingent upon approval of a Budget
Amendment via adoption of Proposed Ordinance No. 7230; and,
THAT, a copy of the caption of this resolution be spread upon the minutes of the City
Council.

What to Expect in the Next Few Weeks: My colleagues at the Federal Highway Administration(FHWA)
are responsible for establishing and executing a SS4A grant agreement with City of Port Arthur. You can
expect to hear from a FHWA representative with your State's FHWA Division Office in the near future. In
the weeks ahead you will receive more information about next steps, including an invitation to a FHWA-
sponsored webinar for grant recipients to describe the process leading to an executed grant agreement. The
webinar will be recorded for those who are unable to attend and will be posted to the SS4A website. In the
meantime, if you have questions about next steps,please direct them to FHWA using the email
SS4A.FHWA(u)dot.gov.
Finally, we ask for your patience as we work diligently toward executing grant agreements so your important
safety work may begin. FHWA staff will be working with hundreds of new grant recipients to expeditiously
process new grant agreements, and this will take time.

Preparing to Establish a Grant Agreement
The terms of the grant agreement will be in accordance with the FY 2023 SS4A NOFO and applicable
Federal requirements. Below highlights key information to start becoming familiar with as the grant
agreement development process begins.
• Scope of Activities: Your award is to develop an Action Plan.
o Action Plan: The funding awarded to develop a comprehensive safety action plan must result in
a final product that includes all Action Plan components outlined in Table 1 of the NOFO. See
https://www.transportation.gov/grants/ss4a/action-plan-components.
• 2 CFR part 200: All SS4A awards will be administered pursuant to the Uniform Administrative
Requirements, Cost Principles and Audit Requirements for Federal Awards found in 2 CFR part 200
(NOFO p. 36). We encourage awardees to take the free FHWA training on these requirements
(https://www.nhi.fhwa.dot.gov/course-search?tab=1&key=231034&sf=0&course no=231034).
• Pre-Agreement Costs: No costs incurred before USDOT signs and executes the grant agreement will
be reimbursed or counted toward the 20%match or cost-share requirement.
• Allowable Costs: To be considered allowable, costs incurred must be reasonable,necessary, and
allocable, as described in 2 CFR Part 200 Subpart E—Cost Principles.
• Match and Cost-Sharing: Grant recipients are required to contribute no less than a 20%non-
Federal match. Please review: https://www.transportation.gov/grants/ss4a/match-and-cost-share-
examples.
• Maintenance Activities: Maintenance activities for an existing roadway primarily to maintain a state of
good repair are not an eligible activity.
• Enforcement Activities: Any activities related to compliance or enforcement efforts to make our roads
safer should affirmatively improve equity outcomes as part of a comprehensive approach to achieve zero
roadway fatalities and serious injuries. (NOFO p. 15)
• Educational and Outreach Materials: Any educational or outreach materials charged to the grant must
align with the project goals and roadway safety. Costs of promotional items and memorabilia, including
models, gifts, and souvenirs are not allowable expenses. Costs of advertising and public relations
designed solely to promote the non-Federal entity are unallowable (2 CFR § 200.421). USDOT's Use of
