Nature of Request:
The Housing Division recommends that the City Council adopt Proposed Resolution No. 23657
authorizing the City Manager to execute Change Order No. 1 to the Contract with DRC Construction,
LLC, extending the contract time by 45 days, to a new total of 120 days to complete the new construction
project at 1942 6th Street, Port Arthur, Texas. This Change Order will have no financial impact to the
construction costs.
Staff Analysis/Considerations:
The City Council, by Resolution No. 23-474, authorized the City Manager to execute a contract between
the City and DRC Construction, LLC for the site preparation and new construction of three (3) homes in
the total amount of$618,125.00 which includes a contingency for $15,000.00. ($603,125.00+$15,000.00
=$618,125.00).
Due to extensive vandalism to the house at 1942 6th Street, which was determined to be arson, the new
construction project will be delayed. DRC Construction, LLC submitted a request for an extension of 45
days to clean the house and complete the new construction project.
Budget Consideration:
No impact.
RECOMMENDATION:
The Housing Division recommends that the City Council adopt Proposed Resolution No. 23657
authorizing the City Manager to execute Change Order No. 1 to the Contract with DRC Construction,
LLC, exatending the contract time by 45 dyas to a new total of 120 days to complete the new construction
project located at 1942 6th Street, Port Arthur, Texas with no additional financial impact on the

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
CHANGE ORDER NO. 1 TO THE CONTRACT WITH DRC CONSTRUCTION
LLC OF BEAUMONT, TEXAS, EXTENDING THE CONTRACT TIME BY 45
DAYS TO A NEW TOTAL CONTRACT TERM OF 120 DAYS FOR THE
COMPLETION OF THE NEW CONSTRUCTION HOME LOCATED AT 1942
6TH STREET, PORT ARTHUR, TEXAS. THIS CHANGE ORDER WILL HAVE
NO ADDITIONAL FINANCIAL IMPACT ON THE CONSTRUCTION COSTS.
WHEREAS, the U.S. Department of Housing and Urban Development annually awards
Community Development Block Grant (CDBG) Program and HOME Investment Partnership (HOME)
Program funds to the City of Port Arthur for the primary benefit of low and moderate-income
persons/families in accordance with 24 Code of Federal Regulations Part 92 and Part 570.; and,
WHEREAS, the City Council, by its adoption of Resolution Number 23-206 (authorizing
submission of the 2023 Action Plan), has obligated itself to provide new construction of houses to assist
low and moderate-income persons/families; and,
WHEREAS, the City Council, by its adoption of Resolution Number 23-474, authorized the City
Manager to execute a contract with DRC Construction, LLC of Beaumont, Texas, for the site preparation
and new construction of three (3) homes in the amount of Six Hundred Eighteen Thousand One Hundred
Twenty-Five Dollars and No/100, ($618,125.00) (which includes a$15,000 Contingency); and,
WHEREAS,the new construction project at 1942 6th Street is delayed due to extensive vandalism
to the house, determined to be arson as identified in the attached Exhibit"A"; and,
WHEREAS, DRC Construction, LLC, submitted a request for a time extension of 45 days, with no
additional cost,to allow for the cleaning of the house as identified in the attached Exhibit "B"; and,
WHEREAS, Change Order No. 1, attached hereto as Exhibit "C", is being submitted to extend
the contract time by 45 days from the original 75 days, to a new total completion time of 120 days with no
additional financial impact.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. THAT the facts and opinions in the preamble are true and correct.
Section 2. THAT the City Council hereby authorizes the City Manager to execute Change
Order No. 1 to the contract with DRC Construction, LLC of Beaumont, Texas, extending the contract
time by 45 days to a new total of 120 days to complete the construction of the home at 1942 6th Street, in
substantially the same form as attached hereto as Exhibit "C", with no additional financial impact on the
construction costs.
Section 3. THAT a copy of the caption of this Resolution be spread upon the minutes of the
City Council.

El responded to a possible house fire at 1942 6th street. El arrived on scene to find smoke coming from the eaves of the
house.The house had a lot of debris and building materials in the front yard due to it still being under construction. Ela
perform a 360 degree size up and found that the back door was unlocked, but unopened. El crew pulled an 1.75 inch pre-
connect line and forced the front door.Once inside, El crew made our way to the B side of the structure were we found
fire in the kitchen area.The fire was small and was extinguished quickly. E2 used a 2.75 inch line to supply its tank water
to El. Ll placed an electric fan at the front door and ventilated the windows in the kitchen to help clear the smoke out of
the building. Ll also performed a primary search of the building.
After the fire was out,an investigator was called out.While all crews were awaiting the investigator,everyone perform
overhaul and completed a secondary search. Due to the building being under construction,there was very little contents in
the home so overhaul was quick.All crews assisted with cleaning up tools and loading all hose back onto El.All units
returned to service leaving U3 on scene awaiting the investigator.

Unit 3 responded to a report of a house fire.After determining that there was a working fire,I had dispatch secure Firel on
the radio.Shortly after arriving,a PD officer informed me of a possible suspect if the cause if the fire was determined to be
arson.I called for an Arson Investigator and passed the information on to him via telephone once he was en route.
Crews had the fire under control fairly quickly.The home was under construction and had been dried-in,but there was no
furniture or contents aside from a few appliances,limiting the fire load and heat potential.Once the fire was extinguished
and hoses rolled,engines began returning to service and Firel was reopened.I waited on scene for the Investigator and
turned it over to him.

E2 responded to 1942 6 for a possible house fire. E2 arrived to find a new construction home with black smoke coming
from the front door. El had a line stretched and E2 captain and firefighter went in to assist in extinguishment and search.
The fire was out within seconds of going inside.Crews looked for extension by pulling ceiling and a secondary search was
performed.After picking up tools E2 was released by command and returned to service.

Ll dispatched to a house fire at 1942 6th street. Ll arrived on scene with El and found a one-story private dwelling with
moderate smoke showing.This home was under construction and near completion,there were no utilities ran to the home
at this time. Li completed a 360 and found an open window on the Bravo side of the structure with a small amount of fire
inside. El crew was able to find the fire quickly and extinguish it with a preconnected handline. Ll crew completed a
primary search with nothing found.Once completed Li finished ventilating the structure.Crews on scene worked together
to overhaul the structure and complete extinguishment.Crews on scene returned all equipment to service. Ll back in
service.
